To the President of the Senate and the Speaker of the House of
Representatives:
We, the conference committee appointed to consider the differences
between the houses in relation to House Amendments No. 1, 2 and 3 to
Senate Bill 0618, recommend the following:
1. that the Senate non-concur with House Amendments No. 1, 2 and
3; and,
2. that the title of the bill be replaced with the following:
"AN ACT making appropriations."; and
3. that Senate Bill 618 be amended by deleting everything after
the enacting clause and inserting in lieu thereof the following:
"Section 1. "AN ACT regarding appropriations and reappropriations,"
Public Act 91-8, approved June 2, 1999, is amended by changing Sections
230 and 270 of Article 1 as follows:

Sec. 230. The sum of $100,000, or so much thereof as may be
necessary, is appropriated from the Fund for Illinois' Future to the
Department of Commerce and Community Affairs Board of Higher Education
for a grant to Dupage County the Victoria Foundation for Career
Connector Program start up costs.

Section 3. "AN ACT regarding appropriations and reappropriations,"
Public Act 91-8, approved June 2, 1999, is amended by repealing

WHEREAS, Molly Smith was the beloved daughter of William and Ada
McCall; she was one of a set of twins in a family with nine children;
she attended school in Yazoo City, Mississippi; she accepted Jesus
Christ as her Savior and was married to Napoleon Smith before they
moved to Chicago in 1945; and
WHEREAS, Molly Smith worked in the food industry, part-time with
the City of Chicago, and worked to raise her children; while working,
she also attended night school at Parker High School; and
WHEREAS, Molly Smith is survived by her children, Charlie, Johnnie

WHEREAS, Carlos D. Hevia continued his education and training
throughout his career in order to improve his service to society; he

operations, worked on international child abduction cases, helped
establish the Illinois State Police Command School, and supervised the

WHEREAS, Colleen Sullivan is one such person; she retired October
29, 1999 after thirty-three years of processing circuit court jurors at
the Peoria County Courthouse; and
WHEREAS, Colleen Mary Kelleher Sullivan was born on June 13, 1924;
she is the loving mother of ten children, Mike, Margaret, Mary, Pat,
Susie, Tracy, Becky, Colleen, Dodie, and Maureen, and the proud
grandmother of twenty-two grandchildren and six great-grandchildren;
and
WHEREAS, Since 1966, Colleen Sullivan has dealt with more than
500,000 jurors during her service with the Jury Commission; her
personality and calm manner have earned her the respect and admiration
of all; and
WHEREAS, After retirement, she is planning on taking a trip to
Ireland, traveling, getting reunited with her brothers and sisters, and

WHEREAS, On January 30, 2000, the St. Louis Rams, led by
quarterback Kurt Warner, won Super Bowl XXXIV in Atlanta, Georgia, over
the Tennessee Titans by the final score of 23-16; and
WHEREAS, The Rams' great on-field leader, quarterback Kurt Warner,
would not let adversity get in his way and led the Rams to their season
of greatness; and
WHEREAS, During his 4 years of college at Northern Iowa University,
Kurt Warner, even though he never got a chance to play until his senior
season, refused to give up on his dream to play professional football
and always gave 100% for the team; and
WHEREAS, In 1994, Kurt Warner was cut by the Green Bay Packers
during training camp; and
WHEREAS, Kurt Warner then spent 3 years playing for the Iowa
Barnstormers in the Arena Football League; and
WHEREAS, During that time, Kurt Warner met his wife and partner in
life, Brenda Warner, who also rejected the idea that Kurt give up his
dream to play professional football in the NFL; and
WHEREAS, During that period, Kurt Warner persevered by working as a
grocery store clerk, stocking shelves and bagging groceries to help
support his wife and children; and
WHEREAS, In 1997, Kurt Warner was signed by the St. Louis Rams and
spent a season playing for the Amsterdam Admirals in the NFL Europe;

WHEREAS, In 1998, Kurt Warner was named the third string
quarterback for the St. Louis Rams; and
WHEREAS, In 1999, when the starting quarterback of the St. Louis
Rams was injured during a pre-season game, Kurt Warner was thrust into
the limelight and handed the reins of the St. Louis Rams; and
WHEREAS, Kurt Warner guided the St. Louis Rams to a 13-3 regular
season, a NFC best record; and
WHEREAS, In the 1999 season, Kurt Warner threw for 4,353 yards and
41 touchdowns, becoming only the second quarterback in NFL history to
throw for over 40 touchdowns in a season; and
WHEREAS, Because of this effort Kurt Warner was named the NFL's MVP
for 1999; and
WHEREAS, Kurt Warner and the St. Louis Rams continued their
historic season by winning the NFC Western Division title; and
WHEREAS, Kurt Warner and the St. Louis Rams fought on against a
tough opponent and won the NFC championship game against the Tampa Bay
Buccaneers, by the final score of 11-6; and
WHEREAS, In Super Bowl XXXIV, Kurt Warner threw for 414 yards, a
Super Bowl record, and two touchdowns; and
WHEREAS, Kurt Warner guided his team to the greatest victory in the
history of the St. Louis Rams, by winning the Lombardi Trophy and Super
Bowl XXXIV over the Tennessee Titans by the final score of 23-16; and
WHEREAS, By leading his team to victory in Super Bowl XXXIV, Kurt
Warner was named the Super Bowl MVP; and
WHEREAS, Kurt Warner, who through his hard work and dedication, his
never ending faith in God, his strong family ties and family values,
his outright refusal to quit and let life get the best of him, and his
refusal to give up on belief in himself and his dreams, has become a
shining example of leadership through adversity, and a true modern day

serving the Democratic Party 84 years in Olive I Township; and
WHEREAS, The late Hank Augustine served Olive Township 54 years; he
first served upon his election as a Justice of the Peace; he went on to
serve as Democratic Precinct Committeman and Township Trustee; after
his passing, his memory was preserved on a plaque given by Olive
Township, celebrating his 54 years of service; and
WHEREAS, J.H. "Jim" Augustine was first elected Democratic Precinct
Committeman on St. Patrick's Day, March 17, 1970; in addition to
serving as Committeman, Mr. Augustine serves on the Madison County
Board, and has also served as a Township Trustee in the past; and
WHEREAS, Together this father and son have served and are serving
the people of Madison County and Olive Township I for 84 years;

"Section 2. The Criminal Code of 1961 is amended by changing
Section 11-9.4 as follows:
(720 ILCS 5/11-9.4)
Sec. 11-9.4. Approaching, contacting, or communicating with a child
within public park zone by child sex offenders prohibited.
(a) It is unlawful for a child sex offender to knowingly be
present in any public park building or on real property comprising any
public park when persons under the age of 18 are present in the
building or on the grounds and to approach, contact, or communicate
with a child under 18 years of age, unless the offender is a parent or
guardian of a person under 18 years of age present in the building or
on the grounds.
(b) It is unlawful for a child sex offender to knowingly loiter on
a public way within 500 feet of a public park building or real property
comprising any public park while persons under the age of 18 are
present in the building or on the grounds and to approach, contact, or
communicate with a child under 18 years of age, unless the offender is
a parent or guardian of a person under 18 years of age present in the
building or on the grounds.
(c) It is unlawful for a child sex offender to knowingly operate,
manage, be employed by, volunteer at, be associated with, or knowingly
be present at any facility providing programs or services exclusively
directed towards persons under the age of 18. This does not prohibit a
child sex offender from owning the real property upon which the
programs or services are offered, provided the child sex offender
refrains from being present on the premises for the hours during which
the programs or services are being offered.
(c-5) It is unlawful for a child sex offender to be knowingly
present in any place in which programs, services, or lessons are
provided to persons under 18 years of age and where children under 18
years of age are present during which the programs services, or lessons
are provided.
(d) Definitions. In this Section:
(1) "Child sex offender" means any person who:
(i) has been charged under Illinois law, or any
substantially similar federal law or law of another state,
with a sex offense set forth in paragraph (2) of this
subsection (d) or the attempt to commit an included sex
offense, and:
(A) is convicted of such offense or an attempt to
commit such offense; or
(B) is found not guilty by reason of insanity of
such offense or an attempt to commit such offense; or
(C) is found not guilty by reason of insanity
pursuant to subsection (c) of Section 104-25 of the Code
of Criminal Procedure of 1963 of such offense or an
attempt to commit such offense; or
(D) is the subject of a finding not resulting in an

acquittal at a hearing conducted pursuant to subsection
(a) of Section 104-25 of the Code of Criminal Procedure
of 1963 for the alleged commission or attempted
commission of such offense; or
(E) is found not guilty by reason of insanity
following a hearing conducted pursuant to a federal law
or the law of another state substantially similar to
subsection (c) of Section 104-25 of the Code of Criminal
Procedure of 1963 of such offense or of the attempted
commission of such offense; or
(F) is the subject of a finding not resulting in an
acquittal at a hearing conducted pursuant to a federal
law or the law of another state substantially similar to
subsection (a) of Section 104-25 of the Code of Criminal
Procedure of 1963 for the alleged violation or attempted
commission of such offense; or
(ii) is certified as a sexually dangerous person
pursuant to the Illinois Sexually Dangerous Persons Act, or
any substantially similar federal law or the law of another
state, when any conduct giving rise to such certification is
committed or attempted against a person less than 18 years of
age; or
(iii) is subject to the provisions of Section 2 of the
Interstate Agreements on Sexually Dangerous Persons Act.
Convictions that result from or are connected with the same
act, or result from offenses committed at the same time, shall be
counted for the purpose of this Section as one conviction. Any
conviction set aside pursuant to law is not a conviction for
purposes of this Section.
(2) "Sex offense" means:
(i) A violation of any of the following Sections of the
Criminal Code of 1961: 10-7 (aiding and abetting child
abduction under Section 10-5(b)(10)), 10-5(b)(10) (child
luring), 11-6 (indecent solicitation of a child), 11-6.5
(indecent solicitation of an adult), 11-9 (public indecency
when committed in a school, on the real property comprising a
school, on a conveyance owned, leased, or contracted by a
school to transport students to or from school or a school
related activity, or in a public park), 11-9.1 (sexual
exploitation of a child), 11-15.1 (soliciting for a juvenile
prostitute), 11-17.1 (keeping a place of juvenile
prostitution), 11-18.1 (patronizing a juvenile prostitute),
11-19.1 (juvenile pimping), 11-19.2 (exploitation of a child),
11-20.1 (child pornography), 11-21 (harmful material), 12-14.1
(predatory criminal sexual assault of a child), 12-33
(ritualized abuse of a child), 11-20 (obscenity) (when that
offense was committed in any school, on real property
comprising any school, on any conveyance owned, leased, or
contracted by a school to transport students to or from school
or a school related activity, or in a public park). An
attempt to commit any of these offenses.
(ii) A violation of any of the following Sections of the
Criminal Code of 1961, when the victim is a person under 18
years of age: 12-13 (criminal sexual assault), 12-14
(aggravated criminal sexual assault), 12-15 (criminal sexual
abuse), 12-16 (aggravated criminal sexual abuse). An attempt
to commit any of these offenses.
(iii) A violation of any of the following Sections of
the Criminal Code of 1961, when the victim is a person under
18 years of age and the defendant is not a parent of the
victim:
10-1 (kidnapping),
10-2 (aggravated kidnapping),
10-3 (unlawful restraint),
10-3.1 (aggravated unlawful restraint).
An attempt to commit any of these offenses.

(iv) A violation of any former law of this State
substantially equivalent to any offense listed in clause
(2)(i) of this subsection (d).
(3) A conviction for an offense of federal law or the law of
another state that is substantially equivalent to any offense
listed in paragraph (2) of this subsection (d) shall constitute a
conviction for the purpose of this Section. A finding or
adjudication as a sexually dangerous person under any federal law
or law of another state that is substantially equivalent to the
Sexually Dangerous Persons Act shall constitute an adjudication for
the purposes of this Section.
(4) "Public park" includes a park, forest preserve, or
conservation area under the jurisdiction of the State or a unit of
local government.
(5) "Facility providing programs or services directed towards
persons under the age of 18" means any facility providing programs
or services exclusively directed towards persons under the age of
18.
(6) "Loiter" means:
(i) Standing, sitting idly, whether or not the person is
in a vehicle or remaining in or around public park property.
(ii) Standing, sitting idly, whether or not the person
is in a vehicle or remaining in or around public park
property, for the purpose of committing or attempting to
commit a sex offense.
(e) Sentence. A person who violates this Section is guilty of a
Class 4 felony.
