MESSAGES FROM THE SENATE
A message from the Senate by
Mr. Harry, Secretary:
Mr. Speaker -- I am directed to inform the House of Representatives
that the Senate has adopted the following Senate Joint Resolution, in
the adoption of which I am instructed to ask the concurrence of the
House of Representatives, to-wit:
SENATE JOINT RESOLUTION NO. 43
WHEREAS, The Longtime Owner-Occupant Property Tax Relief Act was
enacted to provide relief to longtime homeowners faced with substantial
property tax increases as a consequence of the renovation of existing
housing stock, loft conversions, and the construction of new,
significantly higher-priced residences in their neighborhoods; and
WHEREAS, Almost 32,000 building permits were issued in the Chicago
area in 1997, making it the fourth busiest housing market in the
country, leading to increased property tax assessments; and
WHEREAS, Families, who are often on fixed or limited incomes, are
confronted with re-assessments which have substantially increased their
property tax bills, forcing them to sell their homes; and
WHEREAS, An example of the large property tax assessment increases
have occurred in many neighborhoods can be seen in the West Town area
of the City of Chicago; and
WHEREAS, Almost 1,164 building permits were issued in West Town in
1997, nearly double in the number in 1993, leading to the fifth highest
tax assessment increases among city communities during the 1997
re-assessment, the last re-assessment done in the City of Chicago; and
WHEREAS, Many West Town residents saw property tax assessment
increases of 40 or 50 percent and there are examples of as much as a
123 percent increase; and
WHEREAS, The City of Chicago launched the Chicago Homeowner
Assistance Program (CHAP) in response to the increase in property taxes
caused by development, allowing certain middle- and low-income
residents to receive a low-interest loan if their property tax
assessments rose significantly; and
WHEREAS, While CHAP is a well-intentioned program, it is not
meeting its stated goal of providing relief from increased assessments
that have resulted from Chicago's housing boom and as a result, only
346 of the 33,000 people eligible for CHAP applied in 1998; and
WHEREAS, Tax Increment Financing districts have contributed to
rapid increases in property values in nearby communities and there have
been twenty-four such districts approved in the City of Chicago in the
last two and one-half years, which is equivalent to the number approved
in the previous ten years, with twelve more districts being considered;

and
WHEREAS, The established programs are not providing adequate
property tax relief to these citizens and, as such, the Cook County
Board, under the Longtime Owner-Occupant Property Tax Relief Act, has
the authority to help these longtime residents remain in their homes
despite the rising property taxes; therefore be it
RESOLVED, BY THE SENATE OF THE NINETY-FIRST GENERAL ASSEMBLY OF THE
STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES CONCURRING HEREIN, That
we urge the Cook County Board exercise its authority under the Longtime
Owner-Occupant Property Tax Relief Act and grant an exemption and/or
deferral to reduce the property tax burden for longtime homeowners in
areas affected by dramatic increases in assessments due to development;
and be it further
RESOLVED, That suitable copies of this resolution be transmitted to
the Cook County Assessor's Office and the members of the Cook County
Board.

Mr. Speaker -- I am directed to inform the House of Representatives
that the Senate has adopted the following Senate Joint Resolution, in
the adoption of which I am instructed to ask the concurrence of the
House of Representatives, to-wit:
SENATE JOINT RESOLUTION NO. 48
WHEREAS, The Congress of the United States enacted the Education
for All Handicapped Children Act of 1975 (P.L. 94-142), now known as
the Individuals with Disabilities Education Act (IDEA), to ensure that
all children with disabilities in the United States have available to
them a free and appropriate public education that emphasizes special
education and related services designed to meet their unique needs, to
assure that the rights of children with disabilities and their parents
or guardians are protected, to assist states and localities to provide
for the education of all children with disabilities, and to assess and
assure the effectiveness of efforts to educate children with
disabilities; and
WHEREAS, Since 1975, federal law has authorized appropriation
levels for grants to states under the IDEA at 40% of the average
per-pupil expenditure in public elementary and secondary schools in the
United States; and
WHEREAS, Congress continued the 40% funding authority in Public Law
105-17, the Individuals with Disabilities Education Act Amendments of
1997; and
WHEREAS, Congress has never appropriated funds equivalent to the
authorized level, has never exceeded the 10% level, and has usually
only appropriated funding at about the 8% level; and
WHEREAS, The Illinois Budget for the 1999-2000 fiscal year proposes
$868,422,000 of funding for special education programs; and
WHEREAS, The State of Illinois anticipates receiving approximately
$195,787,282 in federal special education funds under Part B of the
IDEA for the 1999-2000 school year, even though the federally
authorized level of funding would provide over $477,529,900 annually to
Illinois; and
WHEREAS, Local educational agencies in Illinois are required to pay
for the underfunded federal mandates for special education programs, at
a statewide total cost of approaching $281,742,600 annually, from
regular education program money, thereby reducing the funding that is

available for other education programs; and
WHEREAS, The 1999 decision of the Supreme Court of the United
States in the case of Cedar Rapids Community Sch. Dist. v. Garret F.
(143 L.Ed 2d 154) has had the effect of creating an additional mandate
for providing specialized health care that will significantly increase
the costs associated with providing special education services; and
WHEREAS, Whether or not Illinois participates in the IDEA grant
program, the State has to meet the requirements of Section 504 of the
federal Rehabilitation Act of 1973 (29 U.S.C. Sec. 701) and its
implementing regulations (34 C.F.R. 104), which prohibit recipients of
federal financial assistance, including educational institutions, from
discriminating on the basis of disability, yet no federal funds are
available under the Act for state grants; and
WHEREAS, Illinois is committed to providing a free and appropriate
public education to children and youth with disabilities, in order to
meet their unique needs; and
WHEREAS, The Illinois General Assembly is extremely concerned that,
since 1978, Congress has not provided states with the full amount of
financial assistance necessary to achieve its goal of ensuring children
and youth with disabilities equal protection of the laws; therefore, be
it
RESOLVED, BY THE SENATE OF THE NINETY-FIRST GENERAL ASSEMBLY OF THE
STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES CONCURRING HEREIN, that
we respectfully memorialize the President and the Congress of the
United States to provide the full 40% federal share of funding for
special education programs so that Illinois and other states
participating in these critical programs will not be required to take
funding from other vital state and local programs in order to fund this
underfunded mandate; and be it further
RESOLVED, That suitable copies of this resolution be delivered to
the President and the Vice-President of the United States, to the
Majority Leader of the Senate of the United States, to the Speaker of
the House of Representatives of the United States, to the Chair of the
United States Senate Budget Committee, to the Chair of the United
States House Budget Committee, to the United States Senate Committee on
Appropriations, to the United States House Committee on Appropriations,
to each member of the Illinois congressional delegation, and to the
United States Secretary of Education.

Mr. Speaker -- I am directed to inform the House of Representatives
that the Senate has adopted the following Senate Joint Resolution, in
the adoption of which I am instructed to ask the concurrence of the
House of Representatives, to-wit:
SENATE JOINT RESOLUTION NO. 53
WHEREAS, Individuals, over the age of 17, with Acquired Brain
Injuries may require supervision and care following medical
rehabilitation which can only be provided within a structured
residential setting; and
WHEREAS, over 5,500 head injuries were reported to the Department
of Public Health Trauma Register for each of the calendar years of 1996
and 1997; and
WHEREAS, the Department of Public Health Trauma Register reports
that following emergency treatment that three out of every four head
injury patients were discharged to their homes and communities without

medical follow-up.
WHEREAS, Individuals with Acquired Brain Injuries needing this type
of long term care have no consistent access to residential services and
are typically found ineligible for any existing residential option; and
WHEREAS, Without appropriate supervision in a structured
residential setting individuals with Acquired Brain Injuries can become
a severe burden upon family and communities; and
WHEREAS, Individuals with Acquired Brain Injuries deserve an array
of treatment options including appropriate residential care which
provides needed supervision, treatment, and stimulation; and
WHEREAS, Individuals with Acquired Brain Injuries have recently
acquired access to community based services through the Department of
Human Services which does not provide for appropriate residential
services through the Medicaid Waiver program; and
WHEREAS, The Department of Human Services has issued the Final
Report of the Illinois Traumatic Brain Injury Planning Project in
January 1998; and
WHEREAS, This report identifies that existing residential options
provide inappropriate care, and when appropriate residential services
are available they are in short supply; therefore, be it
RESOLVED, BY THE SENATE OF THE NINETY-FIRST GENERAL ASSEMBLY OF THE
STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES CONCURRING HEREIN, that
the Community and Residential Services Authority shall convene a Task
Force to investigate the extent to which appropriate residential care
facilities for Individuals with Acquired Brain Injuries exist and
explore options for providing appropriate residential facilities; and
be it further
RESOLVED, That in addition to a representative of the Community and
Residential Services Authority who shall be Chairperson, the membership
of the Task Force shall include a representative of the Department of
Human Services, a representative of the State Board of Education, a
representative of the Brain Injury Association, one member of the
Senate and one public member appointed by the President of the Senate,
one member of the Senate and one public member appointed by the
Minority Leader of the Senate, one member of the House and one public
member appointed by the Speaker of the House of Representatives, and
one member of the House and one public member appointed by the Minority
Leader of the House of Representatives. All of who shall serve without
compensation but shall be reimbursed for their reasonable and necessary
expenses. Public members shall be experienced or knowledgeable
relative to provision of services for individuals with Acquired Brain
Injuries. Staff assistance for the Task Force will be provided by the
Community and Residential Services Authority and the Task Force
expenses shall be paid from the appropriation for ordinary and
contingent expenses of the Authority; and be it further
RESOLVED, That the findings and recommendations of the Task Force
be delivered to the House and Senate by filing copies of its report
with the Clerk of the House and the Secretary of the Senate on or
before December 31, 2001; and that upon filing its report, the Task
Force is dissolved.

WHEREAS, The members of the Illinois House of Representatives wish
to express their sincere condolences to the family and friends of
Clifton Howard, who recently passed away; and
WHEREAS, Clifton "Button Man" Howard was born in Ridgeland,
Mississippi, on April 23, 1919; his parents were George and Lillian
Howard; and
WHEREAS, Clifton Howard moved to Chicago in his early twenties,
where rejoined his sister, brother, and mother; he and his brother,
Charles, both served in World War II; after the war ended, Mr. Howard
returned to Chicago and worked for the post office until 1950; and
WHEREAS, Clifton Howard then went to work at the Wisconsin Steel
Mill; in 1955 he married Mae Jones; and
WHEREAS, Clifton Howard participated in the 1963 civil rights rally
in Washington, D.C., the campaign to elect Mayor Harold Washington, the
city council wars, the organization of filling buses for the million
man march, and many other activities; and
WHEREAS, Clifton Howard last served as a Tahitian Noni salesman
under the direction of George Robinson; he was known for his ability to
laugh at life and the fact that he was a great talker; and
WHEREAS, Clifton Howard is survived by his loving wife, Mae; his
son, Michael Tyler and his wife, Yvette Tyler; his sisters, Arlene
Brigham, Mozella Colliger, and Roberta Hayes; his four great-grandsons;
and many other relatives and friends; therefore, be it

31, 1942, the son of Virgie and Matthew Moore, Sr.; he was educated in

education of children and youth with disabilities; and

three books entitled "Reduction of School Violence: Alternatives to

WHEREAS, The Georgia Voluntary Prekindergarten Program provides
children with quality preschool experiences necessary for future school
success and provides resources and support for parents to ensure that
success; and
WHEREAS, Georgia's program provides children with experiences that
foster the essentials for school readiness in order to lower school
drop-out rates, raise test scores, and increase participation in
postsecondary education; and
WHEREAS, House Bill 4325 creates a voluntary prekindergarten
program similar to Georgia's program, with the program being offered
free statewide to all children who are 4 years of age through
partnerships with licensed child care facilities and public and private

RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-FIRST
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that the State Board of
Education shall assess the current effort made in this State to provide
prekindergarten classes to children, including the number of children
attending prekindergarten classes, which communities have
prekindergarten classes, what kinds of programs offer prekindergarten
classes, and how much money the State Board of Education budgets and
spends for prekindergarten classes, and shall acquire information, if
available, from other sources concerning prekindergarten; and be it
further
RESOLVED, That the State Board of Education shall assess the impact
of prekindergarten on school readiness; and be it further
RESOLVED, That the State Board of Education shall determine the
level of need for school readiness and prekindergarten and whether
current prekindergarten efforts should remain at the same level or
should be expanded; and be it further
RESOLVED, That the State Board of Education may survey community
interest in prekindergarten and hold regional hearings to determine the
interest in and need for prekindergarten; and be it further
RESOLVED, That the State Board of Education shall review other
states' initiatives concerning prekindergarten, especially Georgia's
program; and be it further
RESOLVED, That the State Board of Education shall study the
feasibility of a program in this State similar to Georgia's program and
shall map a strategy for full implementation of this program within 5
years; and be it further
RESOLVED, That the State Board of Education shall assess possible
funding sources for prekindergarten, the cost of implementing a
voluntary prekindergarten program similar to Georgia's program, and how
that cost should be met; and be it further
RESOLVED, That the State Board of Education shall report its
findings and recommendations concerning prekindergarten to the General
Assembly, by filing copies of its report with the Clerk of the House
and the Secretary of the Senate, and to the Governor on or before March

HOUSE RESOLUTION 669

WHEREAS, The Terminal Automation Radar Display System (TARDIS) is
an important tool for airport safety; and
WHEREAS, In 1999, Waukegan Regional Airport had 99,061 flights,
Southern Illinois Airport in Carbondale had 112,037 flights, and
Decatur Airport had 55,304 flights; and
WHEREAS, Waukegan Regional Airport, Southern Illinois Airport, and
Decatur Airport are not equipped with TARDIS systems; and
WHEREAS, Meigs Airport in Chicago, which had only 65,000 flights in
1999, is equipped with a TARDIS system; and
WHEREAS, A National Transportation Safety Board (NTSB) team
investigating the February 8, 2000 midair collision near Waukegan
Regional Airport has suggested that the accident might have been
prevented if the airport had been equipped with a TARDIS system;
therefore, be it
RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-FIRST
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we urge the Federal
Aviation Administration (FAA) to immediately provide TARDIS systems at
Waukegan Regional Airport, Southern Illinois Airport, and Decatur

Foundation is holding its 16th Annual Cystic Fibrosis Casino Fling on
April 29, 2000 at the Fairmount Hotel in Chicago; and
WHEREAS, PathoGenesis Corporation, whose executive offices are
located in Skokie, Illinois, is the title sponsor of Casino Fling 2000;
and
WHEREAS, Wilbur Gantz, CEO of PathoGenesis Corporation and his
wife, Linda Gantz, are the Honorary Chairpersons of Casino Fling 2000;
and
WHEREAS, Cystic Fibrosis is the most common fatal genetic disease
among Caucasians, afflicting over 30,000 children and young adults in
North America; and
WHEREAS, In 1955 the Cystic Fibrosis Foundation was founded to
raise money and foster research to find the cure for cystic fibrosis
and to develop treatments to combat this disease; and
WHEREAS, Great scientific advancements have been made in fighting
this disease due in part to the donations of many Illinois corporations

WHEREAS, Since its inception, the Greater Illinois Chapter's Casino
Fling has raised over $1.7 million net dollars for research to fight
cystic fibrosis; therefore, be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-FIRST
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we declare April 29,
2000 to be Cystic Fibrosis Casino Fling Day in the State of Illinois;
and we congratulate the Greater Illinois Chapter of the Cystic Fibrosis
Foundation, PathoGenesis Corporation, and Wilbur and Linda Gantz,
Honorary Chairpersons of Casino Fling, for their hard work and
dedication to finding the cure for cystic fibrosis; and be it further
RESOLVED, That suitable copies of this resolution be presented to
Ashton Chase, Executive Director of the Greater Illinois Chapter of the
Cystic Fibrosis Foundation, PathoGenesis Corporation, and Wilbur and
Linda Gantz, Honorary Chairpersons of Casino Fling 2000.
At the hour of 2:05 o'clock p.m., Representative Currie moved that
