Turner MESSAGES FROM THE SENATE A message from the Senate by Mr. Harry, Secretary: Mr. Speaker -- I am directed to inform the House of Representatives that the Senate has concurred with the House in adoption of the following joint resolution, to-wit: HOUSE JOINT RESOLUTION NO. 5 Concurred in the Senate, February 1, 2001. Jim Harry, Secretary of the Senate HOUSE JOINT RESOLUTIONS CONSTITUTIONAL AMENDMENTS FIRST READING Representative Lang introduced the following: HOUSE JOINT RESOLUTION CONSTITUTIONAL AMENDMENT 2 RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE SENATE CONCURRING HEREIN, that there shall be submitted to the electors of the State for adoption or rejection at the general election next occurring at least 6 months after the adoption of this resolution a proposition to add Section 9 to Article XIII of the Illinois Constitution as follows: ARTICLE XIII GENERAL PROVISIONS (ILCON Art. XIII, Sec. 9 new) SECTION 9. INSURANCE COMMISSIONER There is created the office of Insurance Commissioner. The Insurance Commissioner shall regulate the insurance industry in Illinois. The Insurance Commissioner shall have such other powers and duties as provided by law. The Insurance Commissioner shall be elected by the electors of the State. The General Assembly shall provide by law for the qualifications, term of office, and manner of election of the Insurance Commissioner. SCHEDULE This Constitutional Amendment takes effect upon being declared adopted in accordance with Section 7 of the Illinois Constitutional Amendment Act. [February 5, 2001] 8 HOUSE JOINT RESOLUTION CONSTITUTIONAL AMENDMENT 3 WHEREAS, The Ninety-second Congress of the United States of America, at its Second Session, in both houses, by a constitutional majority of two-thirds, adopted the following proposition to amend the Constitution of the United States of America: "JOINT RESOLUTION RESOLVED BY THE HOUSE OF REPRESENTATIVES AND SENATE OF THE UNITED STATES OF AMERICA IN CONGRESS ASSEMBLED (TWO-THIRDS OF EACH HOUSE CONCURRING THEREIN), That the following article is proposed as an amendment to the Constitution of the United States, which shall be valid to all intents and purposes as a part of the Constitution when ratified by the legislatures of three-fourths of the several States within seven years from the date of its submission by the Congress: "ARTICLE ______ Section 1. Equality of rights under law shall not be denied or abridged by the United States or any State on account of sex. Section 2. The Congress shall have the power to enforce by appropriate legislation the provisions of this article. Section 3. This Amendment shall take effect two years after the date of ratification.""; and WHEREAS, A Joint Resolution is a resolution adopted by both houses of the General Assembly and does not require the signature of the Governor; a Joint Resolution is sufficient for Illinois' ratification of an amendment to the United States Constitution; and WHEREAS, The United States Congress has recently adopted the 27th Amendment to the Constitution of the United States, the so-called Madison Amendment, relating to Compensation of Members of Congress; this amendment was proposed 203 years earlier by our First Congress and only recently ratified by three-fourths of the States; the United States Archivist certified the 27th Amendment on May 18, 1992; and WHEREAS, The founders of our nation, James Madison included, did not favor further restrictions to Article V of the Constitution of the United States, the amending procedure; the United States Constitution is harder to amend than any other constitution in history; and WHEREAS, The restricting time limit for the Equal Rights Amendment ratification is in the resolving clause and is not a part of the amendment proposed by Congress and already ratified by 35 states; and WHEREAS, Having passed a time extension for the Equal Rights Amendment on October 20, 1978, Congress has demonstrated that a time limit in a resolving clause can be disregarded if it is not a part of the proposed amendment; and WHEREAS, The United States Supreme Court in Coleman v. Miller, 307 U.S. 433, at 456 (1939), recognized that Congress is in a unique position to judge the tenor of the nation, to be aware of the political, social, and economic factors affecting the nation, and to be aware of the importance to the nation of the proposed amendment; and WHEREAS, If an amendment to the Constitution of the United States has been proposed by two-thirds of both houses of Congress and ratified by three-fourths of the state legislatures, it is for Congress under the principles of Coleman v. Miller to determine the validity of the state ratifications occurring after a time limit in the resolving clause, but not in the amendment itself; and WHEREAS, Constitutional equality for women and men continues to be timely in the United States and worldwide, and a number of other nations have achieved constitutional equality for their women and men; therefore, be it RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE SENATE CONCURRING HEREIN, that the proposed amendment to the Constitution of the United States of America set forth in this resolution is ratified; and be it further RESOLVED, That a certified copy of this resolution be forwarded to the Archivist of the United States, the Administrator of General Services of the United States, the President pro tempore of the Senate

HOUSE RESOLUTION 26 Offered by Representative Osmond: WHEREAS, The members of the Illinois House of Representatives are pleased to recognize milestone events in the lives of the citizens of the State of Illinois; and WHEREAS, It has come to our attention that Lake Villa Township Supervisor, Sue Hanson, is retiring from her duties on April 10, 2001; and WHEREAS, Sue Hanson was elected to the position of Lake Villa Township Clerk in 1985 and then elected Township Supervisor, where she has served loyally from 1989 to the present day; and WHEREAS, Sue Hanson was a very diligent and hard worker during her township service, and her many accomplishments illustrate this; some of her accomplishments include: creating the Township Food Pantry, distributing food baskets during the holiday season, establishing a Township Plan Commission, establishing a curbside recycling and yard-waste pick up program, offering an AIDS/HIV Health Education program, and establishing a Meals on Wheels Coordinator for the Lake Villa Township Area; she has also established many community services for Lake Villa Township which include: cardboard recycling, Share Foods, vehicle stickers, notary township maps, a handicap parking card, school physicals, lifeline communicators, state identification applications, a reduced fare for taxi and the bus, RTA Train and Bus photos, and passport application processing; therefore, be it RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we congratulate Sue Hanson for her years of dedicated service as Lake Villa Township Clerk and Supervisor and wish her well in all of her future endeavors; and be it further RESOLVED, That a suitable copy of this resolution be presented to Sue Hanson as an expression of our esteem. HOUSE RESOLUTION 27 Offered by Representative Johnson: WHEREAS, The members of the Illinois House of Representatives are pleased to honor milestones in the lives of the citizens of the State of Illinois; and WHEREAS, For the past 56 Christmas seasons, longtime St. Charles resident, John Forni, has visited Chicago-area nursing homes, retirement facilities, hospitals and children's homes as Santa Claus, lending an ear and sometimes a lap as a labor of love; and WHEREAS, It all started 56 years ago when John Forni heard about a hospitalized young girl in the St. Charles area; he rented a Santa suit visited her and found out that she wanted a doll, so he went out and bought her a doll and presented it to her; and WHEREAS, For more than five decades and several Santa suits later, John Forni still dresses up as Santa each holiday season just to see the look in children's eyes as he walks into a room; and WHEREAS, After his first appearance, John Forni moved into his role as the Fox Valley's Santa with gusto, taking the initiative to tour hospitals on his own; and WHEREAS, John Forni previously worked as a voluntary firefighter for the Geneva Fire Department, and that eventually led to the annual gig as Santa for the fire department in St. Charles nearly 30 years ago; and WHEREAS, Over the years portraying Santa Claus, John Forni has worn out nearly five suits; on October 28, 2000 fellow St. Charles Park District board member, Clint Hull, conducted a fund-raiser to raise money to purchase a new suit for Santa Claus; in all, the majority of the money raised went to buy John Forni a new suit, and the rest went to "Toys for Tots"; and

HOUSE RESOLUTION 28 Offered by Representatives Leitch - Slone: WHEREAS, The members of the Illinois House of Representatives are pleased to honor the Human Service Center in Peoria, Illinois, as the staff prepares to celebrate twenty-five years of quality care to the Peoria area; and WHEREAS, The Human Service Center was established in 1976; the Center was started as a result of the consolidation of the Comprehensive Mental Health Board of Central Illinois, the Peoria Mental Health Clinic, the Stonehedge Foundation, Inc., and the Peoria Area Council on Alcoholism; and WHEREAS, The Human Service Center's statement of purpose is "to provide a program of mental health and substance abuse services which is comprehensive in scope, fully acceptable to those needing these services, integrating with other social and health care systems, and responsive to the current and changing needs primarily of the citizens who and or work in Peoria County, Illinois"; and WHEREAS, By the end of the first decade, the Human Service Center offered services at fourteen locations; there was an operating budget of $5.2 million; and the Human Service Center had received State-wide recognition as a provider of health care to the mentally ill; and WHEREAS, Throughout the years there have many changes in the Human Service Center; there have been good times and rough patches, but the Human Service Center has endured to become an important and vital part of Peoria and Peoria County; and WHEREAS, On February 25, 2001, a dinner will be held celebrating twenty-five years of service provided by the Human Service Center; therefore, be it RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we congratulate the men and women of the Human Service Center as they prepare to celebrate the organization's twenty-fifth anniversary; and be it further RESOLVED, That a suitable copy of this resolution be presented to the staff of the Human Service Center. Countryman is retiring from a career of public service to pursue his interests and dedicate more time to travel and his family; and WHEREAS, John W. Countryman was born in DeKalb County in 1945, the son of a prominent lawyer and State's Attorney, and has lived in DeKalb County his entire life; and WHEREAS, John W. Countryman earned his bachelor's degree from Northern Illinois University in 1967; and his Juris Doctorate, with distinction, from IIT Chicago-Kent College of Law in 1970; he was admitted to the Illinois Bar in 1970; and WHEREAS, John W. Countryman has served the people of the State of Illinois in all three branches of government over the years including
[February 5, 2001] 16 having served as a member and chairman of the State Board of Elections, a member of the Illinois General Assembly; and as the presiding Circuit Judge in the Sixteenth Judicial Circuit; and WHEREAS, John W. Countryman was a member of the State Board of Elections for five years serving as Vice-Chairman and Chairman; and WHEREAS, John W. Countryman as a legislator serving the 76th legislative district from 1983 until 1990 helped make improvements in the civil justice system, including enhancing the rights and protections afforded to participants in the criminal courts of our State; he sponsored many bills which became law benefiting Northern Illinois University and the entire 76th District of Illinois, and he served on many committees including Higher Education, Elections, Joint Committee on Administrative Rules as Co-Chairman and Judiciary as Minority Spokesman; and WHEREAS, John W. Countryman engaged in private law practice from 1970 through 1990, including practice in the State and Federal Courts, in addition, he was active in trial practice during those years; and WHEREAS, John W. Countryman has served as presiding Judge in the courts of DeKalb County for more than ten years, where he has rendered many important decisions affecting the well being of many Illinois residents, and decisions which have been affirmed by the Illinois Appellate and Supreme Courts, as proper interpretations of the Illinois Statutes and the Illinois Constitution; and WHEREAS, John W. Countryman has served in many other public positions throughout the years including Public Defender of DeKalb County, Adjunct Professor at Northern Illinois University College of Law, a member and President of the Kishwaukee Sunrise Rotary Club, Kishwaukee YMCA Board of Directors and Past President, Chairman of the International Council on Governmental Ethics laws, and as President of the DeKalb County Bar Association; and WHEREAS, John W. Countryman has received many honors and awards over the years which include the Bud Geigle Award for service to Northern Illinois University in 1990, and the Northern Illinois University Foundation Humanitarian Award for service to Higher Education in 1997, and legislative service awards from the Illinois Agriculture Association, Illinois Public Defender Association and the DeKalb County Board of Realtors during his tenure in the Illinois House; and WHEREAS, John W. Countryman and his wife Cheryl, to whom he has been a devoted husband for more than thirty-three years, reside in DeKalb where they successfully raised their three children Julia, Amy, and Jeffrey, to whom he has been a supporting father and role model; and WHEREAS, John W. Countryman is a long-suffering fan of the Chicago Cubs baseball team, having spent many an afternoon dreaming of the first time in his life that he will see the National League pennant flying over Wrigley Field; therefore, be it RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we honor the service of DeKalb County Circuit Judge and former member of the Illinois House of Representatives, John W.
