I have been appointed by the Speaker of the House to serve as a member
of the Health Care Availability & Access, Human Services Appropriations
5 [February 15, 2001]
and State Procurement Committees.
I am writing to disclose that I am licensed as a General Dentist in the
State of Illinois and currently in private practice. My
responsibilities include, but not limited to, the treatment of diseases
of the oral cavity and related structures.
Many of the patients that I treat are eligible for Public Aid
Assistance for dental care. My practice does accept reimbursement from
the State of Illinois for services of this clientele. Consequently, I
may have a conflict of interest on certain pieces of legislation that
may be considered by these committees and the House of Representatives.
If presented with a conflict situation, it is my intent to follow the
guides to conduct Legislators set forth in Section 3/202 of the
"Illinois Governmental Ethics Act."
Please forward a copy of this disclosure to the committee clerk of the
aforementioned committees with instructions that it be made a part of
the permanent committee record. In addition, I request that the
content of this letter be included in the House Journal.

WHEREAS, The members of the Illinois House of Representatives wish
to express their sincere condolences to the family and friends of
William P. "Bill" Durbin, the brother of United States Senator from
Illinois, Dick Durbin, who passed away on February 8, 2001; and
WHEREAS, William Durbin was born on August 28, 1929 in East St.
Louis, Illinois to William P. Durbin, Sr. and Ann Durbin; he graduated
from Central Catholic High School in 1947, from St. Louis University in
1958, and did graduate work at Ohio State University; and
WHEREAS, William Durbin served in the United States Navy on the USS
Eversole during the Korean War and later worked for the United States
Defense Mapping Agency in St. Louis, Missouri and Washington, D.C; and
WHEREAS, William Durbin and his family lived in East St. Louis,
Illinois until moving to the Washington, D.C. area in 1973; he was a
resident of Kensington, Maryland; and
WHEREAS, William Durbin helped improve the children's ward of the
hospital in his mother's home village of Jurbarkas, Lithuania, which he
and Senator Dick Durbin visited in 1997; following his mother's death,
he established the Ann Kutkaite-Durbin Memorial Project to help fund
improvements for the Jurbarkas Hospital; he also took an active role in
other efforts to strengthen United States ties to the Baltic nations of
Lithuania, Latvia and Estonia; and

WHEREAS, The passing of William P. Durbin will be deeply felt by
all who knew and loved him, especially his loving wife of 48 years,
Lorraine; his nine sons; his daughter; his nineteen grandchildren; and

RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND

"Section 1. Short title. This Act may be cited as the MTBE
Elimination Act.
Section 5. Findings. The General Assembly finds that methyl
tertiary butyl ether (MTBE) presents substantial environmental risks to
the water quality in Illinois, as well as to the public health, safety,
and welfare of the people of the State of Illinois.
Section 10. Definitions. As used in this Act:
"MTBE" means methyl tertiary butyl ether.
"Agency" means the Illinois Environmental Protection Agency.
Section 15. MTBE Prohibitions. Beginning 3 years after the
effective date of this Act, no person shall use, sell, offer for sale,
distribute, blend, or manufacture MTBE as a fuel additive in Illinois.
Section 20. Programs. The Agency is hereby directed to coordinate
with the United States Environmental Protection Agency, other federal,
state, and local governmental agencies, and private entities to develop
accurate and improved MTBE groundwater testing methodologies and to
develop more efficient and cost effective remediation procedures for
public water supplies and sources contaminated with MTBE.
Section 99. Effective date. This Act takes effect upon becoming
law.".

AMENDMENT NO. 1. Amend House Bill 41 by replacing the title with
the following:
"AN ACT in relation to criminal law."; and
by replacing everything after the enacting clause with the following:
"Section 5. The Unified Code of Corrections is amended by adding
Section 3-12-16 as follows:
(730 ILCS 5/3-12-16 new)
Sec. 3-12-16. Helping Paws Service Dog Program.
(a) In this Section:
"Disabled person" means a person who suffers from a physical or
mental impairment that substantially limits one or more major life
activities.
"Program" means the Helping Paws Service Dog Program created by
this Section.
"Service dog" means a dog trained in obedience and task skills to
meet the needs of a disabled person.
"Animal care professional" means a person certified to work in
animal care related services, such as grooming, kenneling, and any
other related fields.
"Service dog professional" means a person certified to train
service dogs by an agency, organization, or school approved by the
Department.
(b) The Department shall establish the Helping Paws Service Dog
Program to train committed persons to be service dog trainers and
animal care professionals. The Department shall select committed
persons in various correctional institutions and facilities to
participate in the Program.
(c) Priority for participation in the Program must be given to
committed persons who either have a high school diploma or have passed
the high school level Test of General Educational Development (GED).
(d) The Department shall contract with service dog professionals
to train committed persons to be certified service dog trainers.
Service dog professionals shall train committed persons in dog
obedience training, service dog training, and animal health care. Upon
successful completion of the training, a committed person shall receive
certification by an agency, organization, or school approved by the
Department.
(e) The Department shall designate a non-profit organization to
select animals from humane societies and shelters for the purpose of
being trained as service dogs and for participation in any program

designed to train animal care professionals.
(f) After a dog is trained by the committed person as a service
dog, a review committee consisting of an equal number of persons from
the Department and the non-profit organization shall select a disabled
person to receive the service dog free of charge.
(g) Employees of the Department shall periodically visit disabled
persons who have received service dogs from the Department under this
Section to determine whether the needs of the disabled persons have
been met by the service dogs trained by committed persons.
(h) Employees of the Department shall periodically visit committed
persons who have been certified as service dog trainers or animal care
professionals and who have been paroled or placed on mandatory
supervised release to determine whether the committed persons are using
their skills as certified service dog trainers or animal care
professionals.
Section 99. Effective date. This Act takes effect upon becoming
law.".
