WHEREAS, This year the Young Men's Christian Association (YMCA)
will celebrate 150 years of service to young men and women across the
country; their mission "to put Christian principles into practice
through programs that build healthy spirit, mind and body for all" is
still as important today as it was all those years ago; and
WHEREAS, The YMCA serves 17.5 million people in communities across
the United States; the programs include teen clubs, sports leagues,
family nights, community service projects, gang prevention programs,
and many others; and
WHEREAS, The YMCA reaches 9 million kids and teens in nonschool
hours; the YMCA is the nation's largest provider of child care; 443
YMCAs work with juvenile courts; 323 work with public housing
developments; 1,626 work with elementary schools; and 1,197 work with
high schools; last year the YMCA raised $693 million for scholarships,
subsidies, and other community services; and
WHEREAS, The YMCA is volunteer-founded, volunteer-based, and
volunteer-led; more than 600,000 volunteers work together to keep the
YMCA meeting the needs of the community; and
WHEREAS, Programs at the YMCA include health and fitness, camping,
night schools, swimming lessons, lifesaving programs, and many others;
basketball, volleyball, and racquetball were all invented at YMCAs; and
the YMCA encourages healthy living through their many fitness and
sports programs; therefore, be it

WHEREAS, Jenn Scheitlin was recently crowned Miss Illinois County
Fair Queen for 2001 during the 42nd annual ceremony at the Crowne Plaza
Hotel in Springfield, Illinois; and
WHEREAS, Jenn Scheitlin, a native of Champaign, graduated from
Champaign Central High School; she is in her sophomore year at the
University of Illinois where she is majoring in elementary education;
and
WHEREAS, Jenn Scheitlin is active as a youth group leader for
sixth-grade girls at Vineyard Christian Fellowship in Urbana; she loves
sports especially soccer and running; and
WHEREAS, After previously winning the Champaign County pageant;
Miss Scheitlin represented Champaign County in the Miss Illinois County
Fair Pageant; her competition speech began: "How would you like to open
a gift every day of your life" in which she talked about enjoying the
simple things in life; she has expressed her desire to be able to make
an impact in children's lives through her studies; and has been
involved with designing a research web site through the University of
Illinois College of Agricultural, Consumer and Environmental Sciences;

WHEREAS, This is the second year in a row that a Miss Champaign
County will have the honor of reigning over the Illinois State Fair;

she was one of 68 county fair queens in the pageant; and

WHEREAS, Ms. Bringle is a resident of the Berwyn/Cicero area where
she serves as the Executive Director for the Community Mental Health
Board located in the Town of Cicero; and
WHEREAS, Ms. Bringle has been a dedicated supporter to the Seguin
Retarded Citizens Association for the past twenty-five years, and she
has taken part in many functions and special events sponsored by the
Association; and
WHEREAS, Ms. Bringle brings joy and exuberance to Seguin's annual
Christmas Party held at the Wishing Well Restaurant, where she can be
seen smiling and quietly generating a kindred spirit with her very
special friends; and

with finding the world's largest and most complete Tyrannosaurus Rex
skeleton, Sue, which was named in her honor and displayed in the Field
Museum of Natural History in Chicago, Illinois, has advanced the cause
of science; and
WHEREAS, Sue Hendrickson's unquenchable thirst for knowledge and
discovery has contributed to a greater public understanding and
appreciation of the world in which we live; and
WHEREAS, Sue Hendrickson's discovery of the Tyrannosaurus Rex has
aided researchers in learning more about a creature that remains a
mystery to the scientific world and helps put this gigantic animal into
its category in evolutionary history; and
WHEREAS, This discovery allows researchers to study and test

heightened the international acclaim of the Field Museum of Natural

changing Section 18 as follows:

Sec. 18. Visiting professor, physician, or resident permits.
(A) Visiting professor permit.
(1) A visiting professor permit shall entitle a person to
practice medicine in all of its branches or to practice the
treatment of human ailments without the use of drugs and without
operative surgery provided:
(a) the person maintains an equivalent authorization to
practice medicine in all of its branches or to practice the
treatment of human ailments without the use of drugs and
without operative surgery in good standing in their native
licensing jurisdiction during the period of the visiting
professor permit; and
(b) the person has received a faculty appointment to
teach in a medical, osteopathic or chiropractic school in
Illinois; and.
(c) the Department may prescribe the information
necessary to establish an applicant's eligibility for a
permit. This information shall include without limitation (i)
a statement from the dean of the medical school at which the
applicant will be employed describing the applicant's
qualifications and (ii) a statement from the dean of the
medical school listing every affiliated institution in which
the applicant will be providing instruction as part of the
medical school's education program and justifying any clinical
activities at each of the institutions listed by the dean.
(2) Application for visiting professor permits shall be made
to the Department, in writing, on forms prescribed by the
Department and shall be accompanied by the required fee established
by rule, which shall not be refundable. Any application shall
require the information as, in the judgment of the Department, will
enable the Department to pass on the qualifications of the
applicant.
(3) A visiting professor permit shall be valid for no longer
than 2 years one year from the date of issuance or until the time
the faculty appointment is terminated, whichever occurs first, and
may be renewed only in accordance with subdivision (A)(6) of this
Section once.
(4) The applicant may be required to appear before the
Medical Licensing Board for an interview prior to, and as a
requirement for, the issuance of the original permit and the
renewal.
(5) Persons holding a permit under this Section shall only
practice medicine in all of its branches or practice the treatment
of human ailments without the use of drugs and without operative
surgery in the State of Illinois in their official capacity under
their contract within the medical school itself and any affiliated
institution in which the permit holder is providing instruction as
part of the medical school's educational program and for which the
medical school has assumed direct responsibility.
(6) A visiting professor permit shall be valid until the last
day of the next physician license renewal period, as set by rule,
and may only be renewed for applicants who meet the following
requirements:
(i) have obtained the required continuing education
hours as set by rule; and
(ii) have paid the fee prescribed for a license under
Section 21 of this Act.
For initial renewal, the visiting professor must successfully pass
a general competency examination authorized by the Department by rule.
(B) Visiting physician permit.
(1) The Department may, in its discretion, issue a temporary

visiting physician permit, without examination, provided:
(a) (blank);
(b) that the person maintains an equivalent
authorization to practice medicine in all of its branches or
to practice the treatment of human ailments without the use of
drugs and without operative surgery in good standing in his or
her native licensing jurisdiction during the period of the
temporary visiting physician permit;
(c) that the person has received an invitation or
appointment to study, demonstrate, or perform a specific
medical, osteopathic, chiropractic or clinical subject or
technique in a medical, osteopathic, or chiropractic school, a
hospital licensed under the Hospital Licensing Act, a hospital
organized under the University of Illinois Hospital Act, or a
facility operated pursuant to the Ambulatory Surgical
Treatment Center Act; and
(d) that the temporary visiting physician permit shall
only permit the holder to practice medicine in all of its
branches or practice the treatment of human ailments without
the use of drugs and without operative surgery within the
scope of the medical, osteopathic, chiropractic, or clinical
studies for which the holder was invited or appointed.
(2) The application for the temporary visiting physician
permit shall be made to the Department, in writing, on forms
prescribed by the Department, and shall be accompanied by the
required fee established by rule, which shall not be refundable.
The application shall require information that, in the judgment of
the Department, will enable the Department to pass on the
qualification of the applicant, and the necessity for the granting
of a temporary visiting physician permit.
(3) A temporary visiting physician permit shall be valid for
180 days from the date of issuance or until the time the medical,
osteopathic, chiropractic, or clinical studies are completed,
whichever occurs first.
(4) The applicant for a temporary visiting physician permit
may be required to appear before the Medical Licensing Board for an
interview prior to, and as a requirement for, the issuance of a
temporary visiting physician permit.
(5) A limited temporary visiting physician permit shall be
issued to a physician licensed in another state who has been
requested to perform emergency procedures in Illinois if he or she
meets the requirements as established by rule.
(C) Visiting resident permit.
(1) The Department may, in its discretion, issue a temporary
visiting resident permit, without examination, provided:
(a) (blank);
(b) that the person maintains an equivalent
authorization to practice medicine in all of its branches or
to practice the treatment of human ailments without the use of
drugs and without operative surgery in good standing in his or
her native licensing jurisdiction during the period of the
temporary visiting resident permit;
(c) that the applicant is enrolled in a postgraduate
clinical training program outside the State of Illinois that
is approved by the Department;
(d) that the individual has been invited or appointed
for a specific period of time to perform a portion of that
post graduate clinical training program under the supervision
of an Illinois licensed physician in an Illinois patient care
clinic or facility that is affiliated with the out-of-State
post graduate training program; and
(e) that the temporary visiting resident permit shall
only permit the holder to practice medicine in all of its
branches or practice the treatment of human ailments without
the use of drugs and without operative surgery within the
scope of the medical, osteopathic, chiropractic or clinical

studies for which the holder was invited or appointed.
(2) The application for the temporary visiting resident
permit shall be made to the Department, in writing, on forms
prescribed by the Department, and shall be accompanied by the
required fee established by rule. The application shall require
information that, in the judgment of the Department, will enable
the Department to pass on the qualifications of the applicant.
(3) A temporary visiting resident permit shall be valid for
180 days from the date of issuance or until the time the medical,
osteopathic, chiropractic, or clinical studies are completed,
whichever occurs first.
(4) The applicant for a temporary visiting resident permit
may be required to appear before the Medical Licensing Board for an
interview prior to, and as a requirement for, the issuance of a
temporary visiting resident permit.

Sec. 5-2. Classes of Persons Eligible. Medical assistance under
this Article shall be available to any of the following classes of
persons in respect to whom a plan for coverage has been submitted to
the Governor by the Illinois Department and approved by him:
1. Recipients of basic maintenance grants under Articles III and
IV.
2. Persons otherwise eligible for basic maintenance under Articles
III and IV but who fail to qualify thereunder on the basis of need, and
who have insufficient income and resources to meet the costs of
necessary medical care, including but not limited to the following:
(a) All persons otherwise eligible for basic maintenance
under Article III but who fail to qualify under that Article on the
basis of need and who meet either of the following requirements:
(i) their income, as determined by the Illinois
Department in accordance with any federal requirements, is
equal to or less than 70% in fiscal year 2001, equal to or
less than 85% in fiscal year 2002, and equal to or less than
100% in fiscal year 2003 and thereafter of the nonfarm income
official poverty line, as defined by the federal Office of
Management and Budget and revised annually in accordance with
Section 673(2) of the Omnibus Budget Reconciliation Act of
1981, applicable to families of the same size; or
(ii) their income, after the deduction of costs incurred
for medical care and for other types of remedial care, is
equal to or less than 70% in fiscal year 2001, equal to or
less than 85% in fiscal year 2002, and equal to or less than
100% in fiscal year 2003 and thereafter of the nonfarm income
official poverty line, as defined in item (i) of this

subparagraph (a).
(b) All persons who would be determined eligible for such
basic maintenance under Article IV by disregarding the maximum
earned income permitted by federal law.
3. Persons who would otherwise qualify for Aid to the Medically
Indigent under Article VII.
4. Persons not eligible under any of the preceding paragraphs who
fall sick, are injured, or die, not having sufficient money, property
or other resources to meet the costs of necessary medical care or
funeral and burial expenses.
5. (a) Women during pregnancy, after the fact of pregnancy has
been determined by medical diagnosis, and during the 60-day period
beginning on the last day of the pregnancy, together with their
infants and children born after September 30, 1983, whose income
and resources are insufficient to meet the costs of necessary
medical care to the maximum extent possible under Title XIX of the
Federal Social Security Act.
(b) The Illinois Department and the Governor shall provide a
plan for coverage of the persons eligible under paragraph 5(a) by
April 1, 1990. Such plan shall provide ambulatory prenatal care to
pregnant women during a presumptive eligibility period and
establish an income eligibility standard that is equal to 133% of
the nonfarm income official poverty line, as defined by the federal
Office of Management and Budget and revised annually in accordance
with Section 673(2) of the Omnibus Budget Reconciliation Act of
1981, applicable to families of the same size, provided that costs
incurred for medical care are not taken into account in determining
such income eligibility.
(c) The Illinois Department may conduct a demonstration in at
least one county that will provide medical assistance to pregnant
women, together with their infants and children up to one year of
age, where the income eligibility standard is set up to 185% of the
nonfarm income official poverty line, as defined by the federal
Office of Management and Budget. The Illinois Department shall
seek and obtain necessary authorization provided under federal law
to implement such a demonstration. Such demonstration may
establish resource standards that are not more restrictive than
those established under Article IV of this Code.
6. Persons under the age of 18 who fail to qualify as dependent
under Article IV and who have insufficient income and resources to meet
the costs of necessary medical care to the maximum extent permitted
under Title XIX of the Federal Social Security Act.
7. Persons who are 18 years of age or younger and would qualify as
disabled as defined under the Federal Supplemental Security Income
Program, provided medical service for such persons would be eligible
for Federal Financial Participation, and provided the Illinois
Department determines that:
(a) the person requires a level of care provided by a
hospital, skilled nursing facility, or intermediate care facility,
as determined by a physician licensed to practice medicine in all
its branches;
(b) it is appropriate to provide such care outside of an
institution, as determined by a physician licensed to practice
medicine in all its branches;
(c) the estimated amount which would be expended for care
outside the institution is not greater than the estimated amount
which would be expended in an institution.
8. Persons who become ineligible for basic maintenance assistance
under Article IV of this Code in programs administered by the Illinois
Department due to employment earnings and persons in assistance units
comprised of adults and children who become ineligible for basic
maintenance assistance under Article VI of this Code due to employment
earnings. The plan for coverage for this class of persons shall:
(a) extend the medical assistance coverage for up to 12
months following termination of basic maintenance assistance; and
(b) offer persons who have initially received 6 months of the

coverage provided in paragraph (a) above, the option of receiving
an additional 6 months of coverage, subject to the following:
(i) such coverage shall be pursuant to provisions of the
federal Social Security Act;
(ii) such coverage shall include all services covered
while the person was eligible for basic maintenance
assistance;
(iii) no premium shall be charged for such coverage; and
(iv) such coverage shall be suspended in the event of a
person's failure without good cause to file in a timely
fashion reports required for this coverage under the Social
Security Act and coverage shall be reinstated upon the filing
of such reports if the person remains otherwise eligible.
9. Persons with acquired immunodeficiency syndrome (AIDS) or with
AIDS-related conditions with respect to whom there has been a
determination that but for home or community-based services such
individuals would require the level of care provided in an inpatient
hospital, skilled nursing facility or intermediate care facility the
cost of which is reimbursed under this Article. Assistance shall be
provided to such persons to the maximum extent permitted under Title
XIX of the Federal Social Security Act.
10. Participants in the long-term care insurance partnership
program established under the Partnership for Long-Term Care Act who
meet the qualifications for protection of resources described in
Section 25 of that Act.
11. Persons with disabilities who are employed and eligible for
Medicaid, pursuant to Section 1902(a)(10)(A)(ii)(xv) of the Social
Security Act, as provided by the Illinois Department by rule.
12. Subject to federal approval, for the receipt of family
planning services, persons whose income is less than 200% of the
poverty guidelines updated annually in the Federal Register by the U.S.
Department of Health and Human Services under authority of 42 U.S.C.
9902(2). The Department must request federal approval of coverage under
this paragraph 12 within 30 days after the effective date of this
amendatory Act of the 92nd General Assembly.
The Illinois Department and the Governor shall provide a plan for
coverage of the persons eligible under paragraph 7 as soon as possible
after July 1, 1984.
The eligibility of any such person for medical assistance under
this Article is not affected by the payment of any grant under the
Senior Citizens and Disabled Persons Property Tax Relief and
Pharmaceutical Assistance Act or any distributions or items of income
described under subparagraph (X) of paragraph (2) of subsection (a) of
Section 203 of the Illinois Income Tax Act. The Department shall by
rule establish the amounts of assets to be disregarded in determining
eligibility for medical assistance, which shall at a minimum equal the
amounts to be disregarded under the Federal Supplemental Security
Income Program. The amount of assets of a single person to be
disregarded shall not be less than $2,000, and the amount of assets of
a married couple to be disregarded shall not be less than $3,000.
To the extent permitted under federal law, any person found guilty
of a second violation of Article VIIIA shall be ineligible for medical
assistance under this Article, as provided in Section 8A-8.
The eligibility of any person for medical assistance under this
Article shall not be affected by the receipt by the person of donations
or benefits from fundraisers held for the person in cases of serious
illness, as long as neither the person nor members of the person's
family have actual control over the donations or benefits or the
disbursement of the donations or benefits.

(a) "Council" means the Illinois Historic Sites Advisory Council;
(b) "Demolish" means raze, reconstruct or substantially alter;
(c) "Agency" means the Historic Preservation Agency;
(d) "Director" means the Director of Historic Preservation who
will serve as the State Historic Preservation Officer;
(e) "Place" means (1) any parcel or contiguous grouping of parcels
of real estate under common or related ownership or control, where any
significant improvements are at least 40 years old, or (2) any
aboriginal mound, fort, earthwork, village, location, burial ground,
historic or prehistoric ruin, mine case or other location which is or
may be the source of important archeological data;
(f) "Registered Illinois Historic Place" means any place listed on
the "Illinois Register of Historic Places" pursuant to Section 6 of
this Act;
(g) "Person" means any natural person, partnership, corporation,
trust, estate, association, body politic, agency, or unit of government
and its legal representatives, agents, or assigns; and
(h) "Municipal Preservation Agency" means any agency described in
Section 11-48.2-3 of the "Illinois Municipal Code", as now or hereafter
amended, or any agency with similar authority created by a municipality
under Article VII, Section 6 of the Illinois Constitution.
(i) "Critical Historic Feature" means those physical and
environmental components which taken singly or together, make a place
eligible for designation as a Registered Illinois Historic Place.
(j) "ILHABS" means the Illinois Historic American Building Survey,
a survey of a building or buildings required in accordance with the
provisions of the Illinois State Agency Historic Resources Preservation
Act (20 ILCS 3420), consisting of architectural drawings, historic
context studies, photographs, and other similar elements.
(k) "ILHAER" means the Illinois Historic American Engineering
Record, a survey of a structure or structures required in accordance
with the provisions of the Illinois State Agency Historic Resources
Preservation Act (20 ILCS 3420), consisting of engineering drawings,
historic context studies, photographs, and other similar elements.
(l) "Archaeological survey" means the archaeological investigation
required in accordance with the provisions of the Illinois State Agency
Historic Resources Preservation Act (20 ILCS 3420), consisting of field
inspections, excavations, lab work, written reports, curation, and
other similar elements.

Sec. 20. Cultural Resources Mitigation Grant Program.
(a) Subject to appropriations, the Agency is authorized to conduct
and carry out a pilot program of cultural resources mitigation grants
to any person required by the Agency to conduct a survey or undertake
an ILHABS or ILHAER project in accordance with the Illinois State
Agency Historic Resources Preservation Act (20 ILCS 3420). The grants
shall be available only in counties with more than 40% of their area
falling within the high probability area for archaeology as defined in
Section 3 of the Illinois State Agency Historic Resources Preservation
Act (20 ILCS 3420/3) and having a population of more than 250,000 in
the 2000 Census or in any county adjacent to such a county, as long as

the adjacent county has more than 40% of its area falling within the
high probability area for archaeology. The grants shall be known as
Cultural Resources Mitigation Grants. Cultural Resources Mitigation
Grant Program funds shall not be provided to any other State department
or agency. No grant shall be given for the removal of burials, nor
shall any grant be given for a project that would damage a publicly or
privately owned site listed in the National Register of Historic
Places.
(b) Grants shall be awarded for Phase II and III Archaeological
reports, or an ILHABS or ILHAER, subject to availability of funding.
(c) Grant applications may be accepted by the Agency on or after
July 1 of each fiscal year, subject to available funding.
(d) The Agency must notify, in writing, the grant applicant, no
later than 30 days after the grant application has been received by the
Agency, of acceptance or denial.
(e) Each grant shall be limited to a maximum of $75,000 and no
entity shall receive more than one grant per site per fiscal year.
(f) A grant amount shall not exceed 75% of the project amount for
a Phase III survey and shall not exceed 50% of an ILHABS or ILHAER
project, with the remainder to be provided as matching funds by the
applicant.
(g) The Agency may enter into any contracts or agreements that may
be necessary to carry out its duties or responsibilities under this
Section. The Agency may adopt rules setting forth procedures and
criteria for administering the Cultural Resources Mitigation Grant
Program. The rules adopted by the Agency may include but shall not be
limited to the following:
(1) purposes for which grants are available;
(2) content of applications;
(3) procedures and criteria for Agency review of grant
applications, grant approvals and denials, and grantee acceptance;
(4) grant payment schedules;
(5) grantee responsibilities for work schedules, work plans,
reports, and record keeping;
(6) evaluation of grantee performance, including but not
limited to auditing of and access to sites and records;
(7) requirements applicable to contracting and subcontracting
by the grantee;
(8) penalties for noncompliance with grant requirements and
conditions, including stop-work orders, termination of grants, and
recovery of grant funds; and
(9) indemnification of this State and the Agency by the
grantee.
(h) There is created in the State treasury a special fund to be
known as the Cultural Resources Mitigation Grant Fund. Funds from the
Cultural Resources Mitigation Grant Fund shall be appropriated only for
the purpose of this Section. The Fund shall consist of all moneys that
may be appropriated to it by the General Assembly, any gifts,
contributions, grants, or bequests received from federal, private, or
other sources, and moneys from the repayment of any grants terminated,
suspended, or revoked pursuant to this Section. Notwithstanding any
other provision of law, no portion of the Fund, including interest,
shall be transferred to the General Revenue Fund at the end of any
fiscal year.
(i) At least annually, the State Treasurer shall certify to the
Agency the amount deposited into the Cultural Resources Mitigation
Grant Fund.
(j) Any portion of the Cultural Resources Mitigation Grant Fund
not immediately needed for the Cultural Resources Mitigation Grant
Program shall be invested by the State Treasurer as provided by the
laws of this State. All income from such investments shall be deposited
into the Cultural Resources Mitigation Grant Fund.
Section 10. The Illinois State Agency Historic Resources
Preservation Act is amended by adding Section 10 as follows:

Sec. 10. Appeals.

(a) Any person who is required by the Agency to conduct an
archaeological investigation or to undertake an ILHABS or ILHAER
project under the provisions of this Act may in writing appeal such
requirement by submitting the following to the Director within 14
calendar days of receiving the Agency's request for such work:
(1) A brief description of the reasons why the work should
not be required, or should not be required in the manner requested,
under this Act.
(2) Any supporting materials.
(3) The name and contact information of the individual who
will serve as the contact for purposes of the written appeal.
(b) Within 30 calendar days the Agency shall provide written
reasons as to why the investigation or project will be required as
requested, not required at all, or required in a modified manner.
(c) The Agency shall maintain a record of all such appeals and the
decisions made.
Section 15. The State Finance Act is amended by adding Section
5.545 as follows:

Sec. 7-1. Districts in one educational service region - changing
boundaries.
(a) School district boundaries lying entirely within any
educational service region may be changed by detachment, annexation,
division or dissolution or any combination thereof by the regional
board of school trustees of such region, or by the State Superintendent
of Education as provided in subsection (l) of Section 7-6, when
petitioned by the boards of each district affected or by a majority of
the registered voters in each district affected or by two-thirds of the
registered voters in any territory proposed to be detached from one or
more districts or in each of one or more districts proposed to be
annexed to another district. Registered voters shall be determined by
the official voter registration lists as of the date the petition is
filed. No signatures shall be added after the date the petition is
filed. If there are no registered voters within the territory proposed
to be detached from one or more districts, then the petition may be
signed by all of the owners of record of the real estate of the
territory. Notwithstanding any other provisions of this Article, if
pursuant to a petition filed under this subsection all of the territory
of a school district is to be annexed to another school district, any
action by the regional board of school trustees or State Superintendent
of Education in granting or approving the petition and any change in
school district boundaries pursuant to that action is subject to and
the change in school district boundaries shall not be made except upon
approval at a regular scheduled election, in the manner provided by
Section 7-7.7, of a proposition for the annexation of all of the
territory of that school district to the other school district.

Each page of the circulated petition shall include the full prayer
of the petition, and each signature contained therein shall match the
official signature and address of the registered voters as recorded in
the office of the election authority having jurisdiction over the
county. Each petitioner shall also record the date of his signing.
Each page of the petition shall be signed by a circulator who has
witnessed the signature of each petitioner on that page. The length of
time for signatures to be valid, before filing of the petition, shall
not exceed 6 months.
Where there is only one school building in an approved operating
district, the building and building site may not be included in any
detachment proceeding unless petitioned by two-thirds of the registered
voters within the entire district wherein the school is located.
(b) Any elementary or high school district with 100 or more of its
students residing upon territory located entirely within a military
base or installation operated and maintained by the government of the
United States, or any unit school district or any combination of the
above mentioned districts with 300 or more of its students residing
upon territory located entirely within a military base or installation
operated and maintained by the government of the United States, shall,
upon the filing with the regional board of school trustees of a
petition adopted by resolution of the board of education or a petition
signed by a majority of the registered voters residing upon such
military base or installation, have all of the territory lying entirely
within such military base or installation detached from such school
district, and a new school district comprised of such territory shall
be created. The petition shall be filed with and decided solely by the
regional board of school trustees of the region in which the regional
superintendent of schools has supervision of the school district
affected. The regional board of school trustees shall have no
authority to deny the detachment and creation of a new school district
requested in a proper petition filed under this subsection. This
subsection shall apply only to those school districts having a
population of not fewer than 1,000 and not more than 500,000 residents,
as ascertained by any special or general census.
The new school district shall tuition its students to the same
districts that its students were previously attending and the districts
from which the new district was detached shall continue to educate the
students from the new district, until the federal government provides
other arrangements. The federal government shall pay for the education
of such children as required by Section 6 of Public Law 81-874.
If a school district created under this subsection (b) has not
elected a school board and has not become operational within 2 years
after the date of detachment, then this district is automatically
dissolved and the territory of this district reverts to the school
district from which the territory was detached or any successor
district thereto. Any school district created under this subsection
(b) on or before September 1, 1996 that has not elected a school board
and has not been operational since September 1, 1996 is automatically
dissolved on the effective date of this amendatory Act of 1999, and on
this date the territory of this district reverts to the school district
from which the territory was detached. For the automatic dissolution
of a school district created under this subsection (b), the regional
superintendent of schools who has supervision of the school district
from which the territory was detached shall certify to the regional
board of school trustees that the school district created under this
subsection (b) has been automatically dissolved.

(105 ILCS 5/7-2) (from Ch. 122, par. 7-2)
Sec. 7-2. Districts in two or more counties; Change of boundaries.
Boundaries of existing school districts lying within two or more
counties may be changed by detachment, annexation, division,
dissolution or any combination thereof by the concurrent action of,
taken following a joint hearing before, the regional boards of school
trustees of each region affected. For purposes of this Section and
Section 7-6, an educational service region shall be deemed to be a

region affected if any portion of the territory which the petition
seeks to have detached from any school district is located in the
region. The petition may be by the boards of each district affected, or
by a majority of the legal voters residing in each district affected,
or by two-thirds of the legal voters residing in any territory proposed
to be detached from one or more districts or in each of one or more
districts proposed to be annexed to another district. The original
petition shall be filed with the regional board of school trustees of
the region in which the territory being detached is located or if
territory is being detached from more than one region then the petition
shall be filed with the regional board of school trustees of the region
in which the regional superintendent has supervision over the greatest
portion of such territory. A certified true copy of the petition shall
be filed with the regional board of school trustees of each other
region affected. Notwithstanding any other provisions of this Article,
if pursuant to a petition filed under this Section all of the territory
of a school district is to be annexed to another school district, any
action by the regional boards of school trustees in granting the
petition and any changes in school district boundaries pursuant to that
action is subject to and the change in school district boundaries shall
not be made except upon approval at a regular scheduled election, in
the manner provided by Section 7-7.7, of a proposition for the
annexation of all of the territory of that school district to the other
school district.
The regional board of school trustees in whose region the joint
hearing on the original petition is conducted shall send a certified
true copy of the transcript of the hearing to each other region
affected. If there are no legal voters residing within the territory
proposed to be detached from one or more districts, then the petition
may be signed by all of the owners of record of the real estate of the
territory. The annexing district is that district to which territory
is proposed to be added.
Where there is only one school building in an approved operating
district, the building and building site may not be included in any
detachment proceeding unless petitioned by two-thirds of the eligible
voters within the entire district wherein the school is located.
After September 23, 1983, no petition shall be filed under Sections
7-1 and 7-2 to form a new school district under this Article except
that such a petition may be filed under Section 7-1 to form a new
school district where the boundaries of such new school district lie
entirely within the boundaries of a military base or installation
operated and maintained by the government of the United States.

Sec. 7-4. Requirements for granting petitions. No petition shall
be granted under Sections 7-1 or 7-2 of this Act:
(a) If there will be any non-high school territory resulting from
the granting of the petition.
(b) Unless after granting the petition any community unit
district, community consolidated district, elementary district or high
school district created shall have a population of at least 2,000 and
an equalized assessed valuation of at least $6,000,000 based upon the
last value as equalized by the Department of Revenue as of the date of
filing of the petition.
(c) Unless the territory within any district so created or any
district whose boundaries are affected by the granting of a petition
shall after the granting thereof be compact and contiguous except as
provided in Section 7-6 of this Act. The fact that a district is
divided by territory lying within the corporate limits of the city of
Chicago shall not render it non-compact or non-contiguous.
(d) To create any school district with a population of less than
2,000 unless the State Board of Education and the regional
superintendent of schools for the region in which the proposed district
will lie shall certify to the regional board or boards of school
trustees that the creation of such new district will not interfere with
the ultimate reorganization of the territory of such proposed district

as a part of a district having a population of 2,000 or more.
Notwithstanding any other provisions of this Article, the granting or
approval by a regional board or regional boards of school trustees or
by the State Superintendent of Education of a petition that under
subsection (b-5) of Section 7-6 is required to request the submission
of a proposition at a regular scheduled election for the purpose of
voting for or against the annexation of the territory described in the
petition to the school district proposing to annex that territory is
subject to, and any change in school district boundaries pursuant to
the granting of the petition shall not be made except upon, approval of
the proposition at the election in the manner provided by Section
7-7.7.

"(b-5) (Blank). If a petition filed under subsection (a) of
Section 7-1 or under Section 7-2 proposes to annex all the territory of
a school district to another school district, the petition shall

for the purpose of voting for or against the annexation of the
territory described in the petition to the school district proposing to
annex that territory. No petition filed or election held under this
Article shall be null and void, invalidated, or deemed in noncompliance
with the Election Code because of a failure to publish a notice with
respect to the petition or referendum as required under subsection (g)
of Section 28-2 of that Code for petitions that are not filed under
this Article or Article 7A, 11A, 11B, or 11D of the School Code."; and
on page 14, by replacing line 5 with the following:
"generally permitted by law, provided that a community unit district
that is formed by combining one or more elementary districts and one or
more high school districts may levy an annual tax for working cash
purposes at a rate not to exceed 0.10% and may levy an annual tax for
leasing educational facilities or computer technology or both at a rate
not to exceed 0.10%, notwithstanding the limits otherwise provided in
this Code."; and
on page 14, by replacing lines 22 through 26 with "levy."; and
on page 20, by replacing line 24 with "referenda or projects resulting
from the formation of a cooperative high school under Section 10-22.22c
of this Code;".

AMENDMENT NO. 1. Amend House Bill 1087 by replacing everything
after the enacting clause with the following:
"Section 1. Short title. This Act may be cited as the Human
Services 211 Collaboration Board Act.
Section 5. Definition. In this Act.

"Board" means the Human Services 211 Collaboration Board.
"Calling area" means a 3-digit area code.
"In-kind support" means non-cash goods or services received at an
established fair market value.
Section 10. Human Services 211 Collaboration Board.
(a) The Human Services 211 Collaboration Board is established to
implement a statewide non-emergency telephone number that will provide
human services information concerning the availability of governmental
and non-profit services and provide referrals to human services
agencies. The Board shall consist of 16 members appointed by the
Governor. The Governor shall appoint one representative of each of the
following Offices and Departments as a member of the Board: the Office
of the Governor, the Department of Human Services, the Department of
Public Aid, the Department of Public Health, the Department of Children
and Family Services, the Department on Aging, the Department of
Employment Security, and the Illinois Commerce Commission. The
Governor shall appoint one representative of each of the following
organizations to the Board: the United Way of Illinois, the Illinois
Alliance of Information and Referral Systems, and the Illinois
Telecommunications Association. The Governor shall appoint one
representative of each of the following non-profit human services
agencies: Catholic Charities, Jewish Federation/Jewish United Fund of
Metropolitan Chicago, Lutheran Social Services of Illinois, Voices for
Illinois Children, and Work Welfare and Families. The Governor shall
designate one of the members as Chairperson. Members of the Board shall
serve 3-year terms and may be reappointed to serve additional terms.
(b) The Board shall establish standards consistent with the
standards established by the National 211 Collaborative and the
Alliance of Information and Referral Systems for providing information
about and referrals to human services agencies to 211 callers. The
standards shall prescribe the technology or manner of delivering 211
calls and shall not exceed any requirements for 211 systems set by the
Federal Communications Commission.
Section 15. Pilot project.
(a) The Board shall establish a pilot project to implement 211 as
a human services information and referral number. The Board may award
not less than 3 and not more than 6 grants to calling areas in various
geographical areas of the State in order to establish pilot 211
systems. A calling area may not be awarded more than one grant under
this Section.
(b) The Board shall establish eligibility criteria for the grants
awarded under this Section.
The criteria shall:
(1) Require 211 providers to submit a request for proposal to
the Board based upon the standards adopted by the Board.
(2) Require 211 providers to submit signed, written
documentation of agreements with other human services providers and
local governmental agencies reflecting collaboration within the
calling area.
(3) Require 211 providers to submit evidence of their ability
to match the financial support granted by the State. The 211
provider's match shall not be less than 50% of the grant. No more
than 25% of the match may be from in-kind support.
The Board shall award the grants based upon a 211 provider's
documented ability to serve the selected calling area with high quality
general information and referral services at a competitive cost.
Section 20. Reports. The Board shall annually report to the
Illinois Commerce Commission, the Governor, and the General Assembly on
the use of 211 services in Illinois.
Section 99. Effective date. This Act takes effect upon becoming
law.".
