RESOLUTIONS

The following resolutions were offered and placed in the Committee
on Rules.
HOUSE RESOLUTION 437
Offered by Representative Lang:
WHEREAS, Workers' compensation self-insurance pools allow small
employers with the same risk characteristics to self-insure their
workers' compensation liabilities on a group basis; and
WHEREAS, Illinois employers have been statutorily authorized to
form self-insurance pools since 1980; and
WHEREAS, The Director of Insurance has regulatory authority over
workers' compensation self-insurance pools under Article V 3/4 of the
Insurance Code; and
WHEREAS, As part of the state's regulatory scheme over the
self-insurance pools, the state has established the Group Workers'
Compensation Pool Insolvency Fund; and
WHEREAS, The purpose of the Group Workers' Compensation Pool
Insolvency Fund is to pay workers' compensation awards to injured
workers whose employers belong to insolvent workers' compensation
self-insurance pool; and
WHEREAS, Since October 2000, four workers' compensation
self-insurance pools have been declared insolvent by the Director of
the Department of Insurance; and
WHEREAS, The total, unpaid claims owed by these insolvent pools are
estimated by the Department of Insurance to be between $17 million and
$20 million; and
WHEREAS, The Group Workers' Compensation Pool Insolvency Fund is
funded by means of regular assessments imposed on the self-insurance
pools, and these assessments are set at a rate of 0.5% of total
workers' compensation claims paid by a pool; and
WHEREAS, The Director of Insurance is responsible for collecting
assessments for the Workers' Compensation Pool Insolvency Fund; and
WHEREAS, The Illinois Insurance Code provides that, in the event of
insolvency of a workers' compensation self-insurance pool, the director
may impose additional assessments on the employer members of the
insolvent pool; and
WHEREAS, The Illinois Insurance Code further provides that, where
the balance of the Workers' Compensation Pool Insolvency Fund falls
below $1 million, the director of Insurance may impose additional
assessments upon the solvent self-insurance pools in order to pay the
claims against the insolvent pools; and
WHEREAS, During its entire history, the Workers' Compensation Pool
Insolvency Fund has collected only about $800,000 in assessments; and
WHEREAS, The current assets of the Workers' Compensation Pool
Insolvency Fund are woefully inadequate to pay the awarded claims
against the insolvent pools; and
WHEREAS, The efforts of the Director of Insurance, as receiver of
the insolvent pools, to collect available assets from the estates of
the insolvent pools is not expected to yield sufficient revenues to pay
the full amount of the awarded claims within the near future; and
WHEREAS, The director's current efforts to collect assets from the
employer members of the insolvent pools likewise do not appear likely
to yield sufficient assets for the Insolvency Fund to pay all of the
claims against the insolvent pools; and
WHEREAS, The director has not, as yet, collected any additional
assessments from the solvent self-insurance pools; and
WHEREAS, As a result of the self-insurance pool insolvencies, some
injured workers have not been able to receive the workers' compensation
and medical benefits to which they are entitled under law for a period
of over 6 months; and
WHEREAS, Many of these injured workers are in desperate financial
straits, being physically unable to earn wages for themselves and their
families through gainful employment; and
WHEREAS, It is therefore imperative that the Director of Insurance
step up his efforts to collect additional assessments, both from the

solvent pools and the employer members of the insolvent pools; and
WHEREAS, The solvent pools appear to be raising every possible
legal objection to avoid becoming liable for additional assessments;
and
WHEREAS, It is therefore appropriate that the General Assembly take
steps to monitor the efforts taken by the Director of Insurance to
collect additional assessments for the Workers' Compensation Pool
Insolvency Fund; therefore be it
RESOLVED, BY THE NINETY-SECOND GENERAL ASSEMBLY OF THE STATE OF
ILLINOIS, That the House of Representatives urges the Director of
Insurance to make all possible efforts to collect additional
assessments for the Workers' Compensation Pool Insolvency Fund; and be
it further
RESOLVED, That the Director of Insurance pursue all possible
avenues to collect assessments, including, but not limited to, the
possible filing of lawsuits against the solvent pools; and be it
further
RESOLVED, That within 30 days of the passage of this resolution,
the Director of Insurance shall submit a report describing the efforts
he has taken to collect additional assessments from the solvent
workers' compensation self-insurance pools, as well as the employer
members of the insolvent pools; and be it further
RESOLVED, That the report shall summarize the dollar amounts
collected as assessments from each pool and employer, as well as the
total dollar amounts of the collected assessments, the claims paid from
the Insolvency Fund, and the Insolvency Fund balance, and be it further
RESOLVED, That the report shall provide detailed explanations of
any failures by those assessed to pay assessments that the director has
levied, the efforts taken by the director to correct these failures,
reason given for failure to pay by those assessed, and a litigation
plan where appropriate; and be it further
RESOLVED, That a suitable copy of this resolution shall be
delivered to the Governor and the Director of Insurance.
HOUSE RESOLUTION 450
Offered by Representative Granberg:
WHEREAS, Any child, whether he or she is natural, adopted, or
foster, is an integral part of any family unit; and
WHEREAS, Children serve as a source of happiness for many parents,
grandparents, and great-grandparents, as well as older and younger
siblings; and
WHEREAS, Our children are the basic resource for the future of
mankind; and
WHEREAS, With the breakdown of the family unit, the role of the
child has become devalued; therefore, be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we recognize August 5,
2001 as "Children's Day" in the State of Illinois in celebration of the
love and pride that children can bring to many lives; and be it further
RESOLVED, That as protectors, we need to educate our children for a
successful future, promote a suitable value system, and protect and
provide a system of support for them from the cruelty and abuse that
may unexpectedly enter their lives.
HOUSE RESOLUTION 456
Offered by Representatives Lawfer - Winters - Wait:
WHEREAS, The level of crime, suicide, and bankruptcy in a community
invariably increases as a casino opens its doors; and
WHEREAS, Local communities have no authority to declare whether or
not large scale Native American gambling should take place in their
towns; and
WHEREAS, Native American casinos have been known to attract
organized crime; and
WHEREAS, Current Native American gambling policy has corrupted the

political process in some states and communities to the point that
legislative initiatives with overwhelming popular support have no
chance of passage due to the enormous political power of the gambling
industry; and
WHEREAS, Current Native American policy has become so intertwined
with the corruptive effects of the gambling industry that it has lost
almost all credibility; therefore, be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we support the proposed
federal Tribal and Local Communities Relationship Act; this Act will
require that the State legislatures and governors give their consent to
any new gaming compacts and uses of newly acquired land for Class III
gambling before any gambling expansion can take place; and be it
further
RESOLVED, That we support that portion of the Act that will further
limit Native American tribes so that in the future they may conduct
Class III gaming on only one parcel of land per tribe; and be it
further
RESOLVED, That we support that portion of the Act that shall
establish a Federal Native American Policy Commission to report and
make legislative suggestions on the following:
(1) the economic, environmental, and social impact of Indian gaming
facilities on local communities;
(2) the influence of non-Native American private investors on the
Indian Federal Recognition Process;
(3) the influence of non-Native American private investors on the
establishment and operation of Indian gaming facilities;
(4) the influence of organized crime on Indian gaming;
(5) how to improve the living standards of Native Americans; and be
it further
RESOLVED, That we support that portion of the Act that directs the
Federal Native American Policy Commission to impose minimum
requirements for federal regulations regarding the following:
(1) security in Indian casinos;
(2) rules of play of games and controls of games;
(3) credit and debit collection controls;
(4) accounting and auditing procedures; and be it further
RESOLVED, That suitable copies of this resolution be presented to
the President of the United States and to each member of the Illinois
congressional delegation.
HOUSE RESOLUTION 457
Offered by Representative Granberg:
WHEREAS, The members of the Illinois House of Representatives are
pleased to acknowledge the accomplishments of Illinois natives; and
WHEREAS, Andy J. Kindle was born and raised in Central City; he
attended Central City Grade School, Centralia High School, and
Centralia Junior College; and
WHEREAS, Mr. Kindle is a television sports director and has
received sixteen Emmy awards for his work, and is considered a leader
in his field; he is most known for his work covering the Olympic Games
and NFL Football; and
WHEREAS, A few years ago, Andy took time from a very busy schedule
to return to his hometown to organize and direct a celebration of
ninety years of basketball at Centralia High School, the winningest
high school team in the nation; and
WHEREAS, The Village of Central City is very proud of Mr. Kindle's
accomplishments and wishes to place signs at the village limits
recognizing those achievements; therefore, be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we urge the Illinois
Department of Transportation to approve the placement of signs honoring
Andy J. Kindle on Route 51 north and south and Green Street Road in the
Village of Central City; and be it further
RESOLVED, That a suitable copy of this resolution be presented to

the Illinois Department of Transportation and to Andy J. Kindle.
HOUSE RESOLUTION 460
Offered by Representative Curry:
WHEREAS, Project Success is a program of the State of Illinois,
administered under the auspices of the Department of Human Services;
and
WHEREAS, The two main goals of Project Success are to support
systemic changes that improve collaboration and resource-sharing
between state and local agencies and improve the well-being of children
and families by providing services that stress school success, local
decision-making, parental involvement and prevention; and
WHEREAS, Project Success needs to continue to function with the
full support of the State of Illinois and the General Assembly; and
WHEREAS, The Project Success Oversight Committee was established by
House Resolution 350 during the Ninety-second General Assembly to
provide on-going oversight of the Project Success program; and
WHEREAS, The Project Success Oversight Committee has been thwarted
in its attempts to obtain documents and other necessary information
needed to fulfill its duties; therefore, be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that the Department of Human
Services is encouraged to provide documents, testimony, and other
information that is needed by the Project Success Oversight Committee
to fulfill its legislative duties.
HOUSE JOINT RESOLUTION 50
Offered by Representative Bill Mitchell:
WHEREAS, The Korean War has played an important part in American
history, and the veterans of the Korean War have earned the respect and
admiration of all people; and
WHEREAS, An armed conflict began in June of l950 and ended in July
of 1953; it exacted a heavy toll: 33,629 Americans were killed in
action and 20,617 died of injuries or disease; and
WHEREAS, The Korean War began when the United Nations urged UN
members to repel the Communist aggressors in Korea; in July of 1950 the
UN Security Council recommended that member nations contributing to the
defense of South Korea make their troops available to a unified command
headed by the United States; and
WHEREAS, It is appropriate for us to remember the many sacrifices
and contributions to the cause of freedom made by the outstanding men

WHEREAS, There are bridges on Illinois Route 51 in Decatur, Macon
County, Illinois, known as Route 51 Bridge Number 058-0010 Northbound
and Bridge Number 058-0049 Southbound; therefore, be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE SENATE CONCURRING
HEREIN, that in recognition of the 50th Anniversary of the Korean
Conflict, Route 51 Bridge Number 058-0010 Northbound and Bridge Number
058-0049 Southbound be named Korean War Veterans Memorial Bridge; and
be it further
RESOLVED, That the Illinois Department of Transportation is
requested to erect, at suitable locations consistent with State and
federal regulations, appropriate plaques or signs giving notice of the
name; and be it further
RESOLVED, That a suitable copy of this resolution be delivered to
the Illinois Secretary of Transportation.
