IN ACCEPTANCE OF GOVERNOR'S RECOMMENDATIONS
Amend Senate Bill 175 as follows:
on page 3, line 34, by inserting "or to the dependent children of
victims" after "victims"; and
on page 3, line 34, by replacing "as defined in" with "pursuant to";
and
on page 4, line 1, by deleting "Section 103 of"; and
on page 4, line 2, by replacing "to the dependent children of victims
of domestic" with "the Domestic Violence Shelters Act"; and
on page 4, line 3, by deleting "violence"; and
on page 4, line 3, by inserting "of such a building or other structure"
after "feet"; and
on page 4, line 4, by inserting ""Domestic violence" has the meaning
ascribed to it in Section 103 of the Illinois Domestic Violence Act of

"or when the alcohol concentration in the person's blood or

breath units contained in Section 11-501.2 of the Illinois
Vehicle Code"; and
on page 1, line 29, by replacing "or act as a crew member of" with "or

WHEREAS, The members of the Illinois House of Representatives wish
to express their sincere condolences to the family and friends of
Anthony Lamor Birk, who passed away on September 12, 2001; and
WHEREAS, Anthony Lamor Birk was born to Harold and Carrie Birk on
July 23, 1954; he received his formal education from the Chicago Public
School system, graduated from Harper High School, and attended Daley
College; and
WHEREAS, Mr. Birk's professional career included being a Cook
County Sheriff, for which he received numerous awards within the law
enforcement system; and
WHEREAS, Mr. Birk was active in the community and was a member of
the Crime Stoppers; he was also a member of Sacred Heart Church; and
WHEREAS, The passing of Anthony Lamor Birk will be deeply felt by
all who knew and loved him, especially his wife of 25 years, Carol; his
sons, Mark, Myron, and Antwan; his daughter, Mia; his parents, Harold
and Carrie Birk; his grandchildren, Tatiara Flowers, Briana Birk, and
Mya Birk; his brothers, Harold Birk, Jr., Eddie Birk, and Everett Birk;
his sisters, Virginia McClendon-Jones and Theresa Birk; his aunt, Marie
Coleman; his uncles, Eddie Jenkins, Jr., Willie D. Jenkins, Tommie
Smith, and Manley Birk; his mother-in-law, Ruth Brown; his
sisters-in-law, Regina Connor, Denise Birk, Karen Birk, and Brenda
Nelson; his brothers-in-law, Robert Nelson, Keith Connor, Jimmy Flood,
and Johnny Jones; and a host of nieces, nephews, cousins, and friends;

WHEREAS, Anthony Birk was a loving husband, devoted father,
respectful son, good neighbor, and trusting friend who was loved by all

HOUSE RESOLUTION 537
Offered by Representative Acevedo-Mendoza:
WHEREAS, The members of the Illinois House of Representatives wish
to express their sincere condolences to the family and friends of
Officer Brian T. Strouse, who was killed in the line of duty on July 1,
2001; and
WHEREAS, Born June 1, 1968 to Paul and Ann Marie Strouse, Brian
Strouse grew up in the Montclare neighborhood on Chicago's Northwest
side; he was a graduate of Lane Tech High School and attended Wright
Junior College; and
WHEREAS, After graduation, Officer Strouse enlisted in the United
States Marine Corps and served for four years, including a tour of duty
in the Persian Gulf; and
WHEREAS, After military service, Officer Strouse joined the Chicago
Police Department where he served the 12th District as a member of the
Monroe District tactical unit, a unit of elite officers who perform
some of the most dangerous assignments on the 13,500 member force; he
often worked out of uniform in high crime neighborhoods to monitor drug
and gang activity; and
WHEREAS, Officer Strouse was a natural-born leader who became his
tactical team's "ringleader" largely because of his affable personality
and tendency to crack a joke or quip what became known as "Strousisms";
he was known as "the Preacher" because of his tendency to offer kind
lectures to youth in the district about staying in school and getting
jobs; and
WHEREAS, During his career, Officer Strouse received 61
departmental commendations including an honor for rescuing, along with
two other officers, Yolanda Ellis from a burning apartment building on

the morning of November 2, 1999; and
WHEREAS, Officer Brian Strouse enjoyed playing softball and golf
and was an avid Chicago Cubs fan; and
WHEREAS, The passing of Officer Brian Strouse will be deeply felt
by all who knew and loved him, especially his parents, Paul and Ann
Marie Strouse; his sisters, Kathleen Noncz, Paula Strouse, and Cynthia
Strouse; his childhood friends, Chris Roy, Joey Samansky, and Rocco
Spizzirri; and a host of additional relatives, friends, and colleagues
at the 12th District of the Chicago Police Department where his
presence will be dearly missed; therefore, be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we mourn, along with
all who knew him, the death of Officer Brian Strouse of Chicago,

HOUSE RESOLUTION 538
Offered by Representative Leitch:
WHEREAS, The members of the Illinois House of Representatives wish
to express their sincere condolences to the family and friends of
former Illinois State Legislator Fred J. Tuerk, who passed away on
August 16, 2001; and
WHEREAS, Representative Tuerk was elected to the Illinois House of
Representatives in 1968 and served 20 years before retiring; he was a
member of the House Republican leadership and helped pass legislation
that created tax increment financing, used extensively for city
redevelopment projects; and
WHEREAS, Fred J. Tuerk was born on July 19, 1922 in Peoria,
Illinois to Fred W. and Anna L. Meagher Tuerk; he married Mary M.
Kieffer on March 17, 1945 in Des Moines, Iowa; and
WHEREAS, Representative Tuerk served in the Mediterranean during
World War II in the United States Navy, where he attained the rank of
lieutenant junior grade; and
WHEREAS, Representative Tuerk earned a bachelor of journalism
degree from the University of Missouri in 1946; after graduation, he
worked as a sports writer for the former Peoria Star; he later worked
as an industrial news writer for Caterpillar Inc., editor of
Caterpillar World magazine and Caterpillar Folks newspaper, and as a
legislative and press relations spokesman for Caterpillar; and
WHEREAS, While editing Caterpillar publications, Representative
Tuerk received numerous awards and commendations from the International
Council of Industrial Editors and won three Freedom Foundation awards;
and
WHEREAS, As a state legislator, Representative Tuerk was
instrumental in landing State money for the construction of the Peoria
Civic Center and Comisky Park, home to the Chicago White Sox; in
addition, he backed legislation that led to the construction of the
second span of the McClugage Bridge and the extension of the Interstate
474 bypass to Illinois Route 29; and
WHEREAS, During his tenure in the Illinois House, Representative
Tuerk received numerous citations for his legislative accomplishments,
including the Peoria Jaycees Good Government Award in 1979, and is
listed in the "Who's Who in American Politics"; he was named honorary
chairman of the Peoria Republican Central Committee and served as a
member of the Peoria County Republican organization and the Second Ward
Republican Club; and
WHEREAS, Representative Tuerk served on the legislative committees
of the Illinois State Chamber of Commerce and the Illinois
Manufacturers' Association; he served as director, vice chairman, and
chairman of Peoria Savings and Loan Association and as director of
River Valley Savings Bank; and
WHEREAS, Representative Tuerk served as a Peoria Park Board trustee
from 1963 to 1971; in addition, he was a member and past president of
the Illinois Valley Press Club and was a member of the Peoria

Association of Commerce, the Guardian Angel Home advisory board, the
Knights of Columbus 427 Third Degree Spalding Council, the Peoria
Public Relations Association, and the Creve Coeur Club; he was also a
member, lector, and extraordinary minister at St. Vincent de Paul
Catholic Church; and
WHEREAS, Representative Tuerk was actively involved in fundraising
efforts for the United Way, St. Francis Medical Center, Bergan and
Spalding high schools, the Boy Scouts, St. Jude, and the American
Cancer Society; and
WHEREAS, The passing of Representative Fred Tuerk will be deeply
felt by all who knew and loved him, especially his wife, Mary; his
sons, William (wife, Vivian) Tuerk and John (wife, Donna) Tuerk; his
daughters, Therese Tuerk, Ellen Tuerk, Margaret Tuerk, Mary Tuerk,
Barbara (husband, Rich) McDermott, and Tina (husband, Kelly) O'Keeffe;
his 11 grandchildren; his nieces and nephews; and his many colleagues
and friends on both sides of the aisle in the Illinois State
Legislature; therefore, be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we mourn, along with
all who knew him, the death of former Illinois State Representative
Fred J. Tuerk of Peoria, Illinois; and be it further

the family of Representative Fred J. Tuerk with our sincere
condolences.
HOUSE RESOLUTION 539
Offered by Representative Reitz:
WHEREAS, The members of the Illinois House of Representatives are
pleased to recognize milestone events in the lives of the citizens of
the State of Illinois; and
WHEREAS, It has come to our attention that Frank M. Clark has been
appointed to the position of president of ComEd; and
WHEREAS, Frank M. Clark is president of ComEd and senior vice
president of Exelon Corporation and Exelon Energy Delivery, which is
the distribution business unit for Exelon Corporation headquartered in
Chicago, Illinois; and
WHEREAS, A principal subsidiary of Exelon Corporation, ComEd is
engaged in the production, purchase, transmission, distribution, and
sale of electricity to wholesale and retail customers; with nearly
8,000 employees, ComEd provides service across one-fifth of Northern
Illinois, serving approximately 3.4 million customers or 70 percent of
the State's population; and
WHEREAS, Prior to his appointment as President, Mr. Clark served as
Executive Vice President responsible for various ComEd functions
including: Customer Service Operations; Marketing and Sales;
Regulatory; Governmental and Community Affairs; Distribution Support
Services; Communications Services; Labor Relations; Human Resources;
and Information Technology; since joining ComEd in 1966, he has held
various positions in both corporate support and line functions; and
WHEREAS, Mr. Clark serves on the board of directors for
Metropolitan Family Services, Governors State University Foundation,
the Illinois State Chamber of Commerce, and the Chicago Legal Clinic,
and on the board of trustees of Roosevelt University and the Adler
Planetarium; he is also a member of the Chicago Bar Association, The
Economic Club of Chicago, and the Executives' Club of Chicago; and
WHEREAS, Mr. Clark received both his law and business
administration degrees from DePaul University; and
WHEREAS, Mr. Clark was born in Chicago, Illinois and resides in
Hazel Crest with his wife, Vera; they are the parents of two sons,
Frank III and Steve; therefore, be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we congratulate Frank
M. Clark on his new appointment as President of ComEd and we wish him
well in his new venture; and be it further

WHEREAS, The members of the Illinois House of Representatives are
pleased to recognize milestone events in the history of education in
the State of Illinois; and
WHEREAS, It has come to our attention that Union Ridge School in
Harwood Heights was the recent recipient of the prestigious Blue Ribbon
Award presented by the U.S. Secretary of Education; and
WHEREAS, The Blue Ribbon program spotlights schools from around the
country that have excelled in school leadership, teaching, curriculum,
student achievement and parental involvement; the program sponsored by
the Office of Educational Research and Improvement of the U.S.
Department of Education, has recognized America's top schools since

pleased to recognize the accomplishments of native Illinoisans; and
WHEREAS, Jerry Colangelo was born and raised in the "Hungry Hill"
neighborhood of Chicago Heights; as a youth he was one of the top
pitchers on a team that also featured the talents of future New York
Yankee Jim Bouton; he was also an excellent basketball player,
capturing All-State honors and leading Bloom Township High School to a
49-8 mark and two appearances in the Illinois State Tournament; his
outstanding athletic ability led to 66 college scholarship offers for
basketball and seven professional baseball contract offers; he was
honored with the dedication of the Jerry Colangelo Gymnasium at Bloom
Township High School in 1996; and
WHEREAS, At the University of Illinois, Jerry Colangelo played two
seasons of baseball and four seasons of basketball; he earned All-Big
Ten basketball honors, averaging 15 points a game; he was the team
captain as a senior and he has been inducted into the Illinois
Basketball Hall of Fame; and
WHEREAS, Mr. Colangelo's professional career in sports began when
he became head scout and director of merchandising for the Chicago
Bulls in 1966; in 1968 he moved to Arizona and became the general
manager of the expansion Phoenix Suns, making him the youngest general
manager in professional sports; in 1987, he led a group of investors
that purchased the Suns and he became the team's CEO; and
WHEREAS, After earning an unprecedented fourth NBA Executive of the
Year award in 1993, he began negotiating with Major League Baseball to
bring an expansion team to Arizona and he was awarded the franchise

that became the Arizona Diamondbacks; and
WHEREAS, As Chairman and CEO, Mr. Colangelo has built the Arizona
Diamondbacks into a team that, with its thrilling victory over the New
York Yankees in seven games in 2001, won the World Series in only its
fourth year, which is the shortest time in which an expansion team has
ever won the World Series; and
WHEREAS, Jerry Colangelo has distinguished himself as one of
Arizona's most active community leaders; he serves either as a board
member, executive, or member of charitable, civic, cultural, athletic,
and religious organizations; and
WHEREAS, Although his time is always at a premium, Jerry Colangelo
has found time to author the book "How You Play the Game", which gives
insight into the business of sports; and
WHEREAS, Jerry Colangelo and his wife, Joan, reside in Phoenix,

WHEREAS, On Tuesday, November 13, 2001, the United States
Conference of Catholic Bishops elected Bishop Wilton Gregory as its
first African American president; and
WHEREAS, Bishop Wilton Gregory was born on December 7, 1947 to a
"generically Christian" family on the South Side of Chicago; he

converted to Catholicism in the 6th grade shortly after his parents
enrolled him at St. Carthage School at 73rd and Yale in Englewood;
within weeks, he had designs on becoming a priest; and
WHEREAS, Bishop Gregory attended Quigley Preparatory Seminary
South, Niles College of Loyola University and St. Mary of the Lake
Seminary; he was ordained a priest on May 3, 1973 and served his first
assignment as associate pastor of Our Lady of Perpetual Help in
Glenview; he rose quickly through the ranks of the Chicago church to
become its first black auxiliary bishop in 1983; a decade later, Pope
John Paul II named him bishop of the Diocese of Belleville, which
includes 28 counties in Southern Illinois; in addition, he helped
establish the Office for Black Catholics of the Chicago archdiocese;
and
WHEREAS, Bishop Gregory was elected vice president of the National
Conference of Catholic Bishops/U.S. Catholic Conference in 1998; he is
known as a stirring orator and a moving preacher and he has written
extensively on important issues; therefore, be it

terrorist activities has had a negative impact on the timely payment of
tax bills for taxpayers; and
WHEREAS, The threat of anthrax contamination has caused the United
States Postal Service to process the mail more carefully; and
WHEREAS, As a result of the closer scrutiny applied to the mail, a
tax payment being mailed may not be post-marked until one or two days
after it is placed in the mail system; and
WHEREAS, The Internal Revenue Service considers a tax payment to be
timely if the postmark on the envelope containing the tax payment is on
or before the tax due date but imposes penalties and interest for late
payment of taxes if the envelope containing the tax payment is
postmarked after the tax due date; and
WHEREAS, Taxpayers should not be penalized for the failure of a tax
payment to receive a timely post mark even though the taxpayer placed
the payment in the mail system on or before the tax due date; therefore
be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND

taken up for consideration.
Representative Bost moved that the House concur with the Senate in
the adoption of Senate Amendment No. 1.
And on that motion, a vote was taken resulting as follows:

adoption of Senate Amendment No. 1 to HOUSE BILL 1973.

RECEDE OR REFUSAL TO RECEDE
FROM HOUSE AMENDMENTS TO SENATE BILLS
House Amendments numbered 1 and 2 to SENATE BILL 397, having been
printed, were taken up for consideration.
Representative Reitz then moved that the House refuse to recede
from said amendments and that a Committee of Conference, consisting of
five members on the part of the House and five members on the part of
the Senate, be appointed to consider the differences arising between
the two Houses.
The motion prevailed.
The Speaker appointed as such committee on the part of the House:
Representatives Reitz, Dart, Currie; Tenhouse and Bost.
Ordered that the Clerk inform the Senate.

suspend the posting requirements on SENATE BILL 1264 in he Committee on
Revenue to be heard in committee

o'clock p.m.
