Highland Park and was active in the Jewish Women's Foundation of the

WHEREAS, The institution of marriage is one of the cornerstones
upon which our society is built, and a marriage that has achieved a
notable longevity is truly a model for the people of the State of
Illinois; and
WHEREAS, It has come to our attention that Mr. and Mrs. Ed Franks
of Carlyle, Illinois, recently celebrated the fiftieth anniversary of
their marriage; and
WHEREAS, Ed Frank and Bea Clanton were united in holy matrimony on
January, 22, 1952, at St. Paul's Catholic Church in Highland by Msgr.
William B. Whalen; and
WHEREAS, They are the loving parents of Kevin Frank, Suzanne
(Richard) Christ, and the late Dan Frank; and the grandparents of Kevin
and Krista Frank and Steven and Laura Christ; and

plateaus when a couple such as Ed and Bea Frank celebrate their golden

HOUSE RESOLUTION 691
Offered by Representative Flowers:
WHEREAS, The members of the Illinois House of Representatives are
honored to recognize February as Black History Month and the
institutions that have provided the African-American community with
many years of constructive influence; and
WHEREAS, Shiloh Baptist Church in Englewood has exerted a profound
influence on its community by providing over a century of service and
worship; and

WHEREAS, In 1889, Mr. and Mrs. Thorton Jones held a prayer meeting
in their home that evolved into the Shiloh Baptist Church; the
beginning of a church home for Shiloh was in a storefront on 63rd and
Halsted where the Holland Jewelry Store in now located; and
WHEREAS, The first pastor of the Shiloh Baptist Church was Reverend
Richard DeBaptiste, an outstanding leader who helped organize the
National Baptist Convention and served as its Historian; he also served
as pastor of Olivet Baptist Church; and
WHEREAS, Reverend Dr. David H. Harris came to Shiloh in 1899 and
became the guide for the spiritual destiny of the church for more than
thirty years; it became apparent to Dr. Harris that Shiloh was an
essential and growing part of the religious life in the community, and
a new brick structure was built and dedicated to meet their needs; and
WHEREAS, The Reverend Thomas B. Chapman was called to Shiloh on
January 1, 1942; his wisdom and method of financing gained him the
reputation of a great church financier; under Rev. Chapman's guidance,
the church mortgage was paid and ceremonially burned on Sunday,
February 13, 1944; and
WHEREAS, Following Pastor Thomas Chapman, Reverend James R. C.
Penn, the first black park district policeman, was called to be pastor
of the Shiloh Baptist Church from 1947 to the spring of 1949; and
WHEREAS, In the fall of 1949, Reverend Owen D. Pelt came to Shiloh
and brought with him a rich spiritual life, wise administration,
endearing fellowship, active but humble service, and inspiring
leadership; and
WHEREAS, Under Rev. Pelt's leadership, Shiloh's first parsonage was
purchased in 1951 at 5948 South Throop Street and the mortgage was paid
nineteen years ahead of schedule; and
WHEREAS, Rev. Pelt organized the 12 month clubs, the men's club,
and the Federal Credit Union; and
WHEREAS, In November 1965, construction was started at 7058 South
Racine Avenue to build the dream of Rev. Pelts, a building that could
supply the physical and spiritual needs of the church membership and
community; sadly, Rev. Pelt passed away before its completion; and
WHEREAS, In addition to his service and dedication with his church,
Reverend Owen Pelt was active in the civil rights movement; on February
13, 1956, Rev. Pelt, with Martin Luther King, Jr., met with the United
Packinghouse Workers Union to discuss lobbying the Chicago-based parent
company of the Montgomery City Lines, the National Lines, in response
to the arrest of Rosa Parks; and
WHEREAS, Reverend Cleodus Jemison Brooks was called to Shiloh on
March 17, 1969, and served as the longest tenured pastor in the history
of the church; and
WHEREAS, Under Rev. Jemison Brooks, Shiloh reached its pinnacle of
financial stability; Rev. Brooks organized a gospel chorus and the
Mother's Board; he built and furnished a church in Lasoto, South
Africa, which is named for Shiloh; Reverend Jemison Brooks passed away
October 23, 1999; and
WHEREAS, Reverend Ervin R. Millsaps was elected as Pastor and
assumed the pulpit on Sunday, October 28, 2001; Rev. Millsaps received
a Bachelor of Arts degree from Shaw University in Religion and
Philosophy in 1992; in 1995, he received a Masters of Divinity with
Christian Education from the Southeastern Baptist Theological Seminary
in Wake Forest, North Carolina; later, in 1998, he received a Doctor of
Ministry Degree from United Theological Seminary in Dayton, Ohio; and
WHEREAS, Dr. Millsaps and his wife, Lizzie, have a daughter,
Octavia Ruth; Dr. Millsaps brings with him to Shiloh experience as a
mature teacher and pastor; he comes to break down some of the old staid
traditions and to build new traditions based on the Gospel; therefore,
be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND

WHEREAS, The Illinois House of Representative has learned with
great pride that March 5, 2002 will mark the 100th Anniversary of one
of the most recognizable consumer organizations in the nation; and
WHEREAS, After being founded as the Chicago Auto Club by a group of
farsighted leaders from various touring and motor car clubs, the AAA
Chicago Motor Club has grown to a national organization with 44,000,000
members; and
WHEREAS, While now a modern, full service organization, this
federation initially worked to improve horse paths to accommodate
automobiles and fought for the passage of the Federal Registration Bill
to eliminate State barriers to interstate travel; and
WHEREAS, During the 100 years of service, the number of motorists
who received jump starts, flats fixed or lock out assistance now totals
more than 30,000,000 million; and
WHEREAS Many national programs like the School Safety Patrols, the
Fuel Gauge Report, drivers' education and the Diamond Rating Service
were pioneered and promoted by this organization during the past

pleased to recognize milestone accomplishments in the lives of the

WHEREAS, It has come to our attention that McKendree College men's
basketball coach Harry Statham recently achieved his 800th win; and
WHEREAS, The Bearcats' longtime coach became just the fifth head
coach in basketball history to win 800 games at a four-year
institution; Coach Statham, who is in his 36th season at McKendree,
boosted his overall record to 800 wins and 316 losses; and
WHEREAS, Coach Statham joins retired coaching legends Dean Smith,
Adolph Rupp, and Clarence "Big House" Gaines, along with current Mount
St. Mary's (Maryland) College head coach Jim Phelan as the only coaches
to reach the 800-win mark; all five coaches on the list coached at one
school their entire careers; and
WHEREAS, McKendree College held a post-game celebration following
the win, which included game ball presentations by both the current
Bearcat team and McKendree president Dr. James M. Dennis; fans in
attendance received a commemorative miniature basketball with Coach

jazz band; he does all of this while maintaining a grade point average

WHEREAS, Former Illinois and Chicago resident, Catherine A.
Bertini, has lead the United Nations World Food Program (WFP) with
distinction as Executive Director since 1992; and
WHEREAS, Serving as the Chief Executive Officer of the world's
largest humanitarian organization and the leader in providing aid in
emergencies such as those in Afghanistan, Kosovo, North Korea, and the
Horn of Africa, Ms. Bertini has managed the work of emergency, refugee,
and development food aid operations in 83 countries around the world;
and
WHEREAS, As the WFP Executive Director, Ms. Bertini is an Under
Secretary General of the United Nations, the first American and first
female to lead the WFP; and
WHEREAS, During her 10-year tenure at the WFP, Ms. Bertini raised
$15 billion in voluntary contributions, allowing 31 million tons of
food to be shipped to the hungry poor around the world; and
WHEREAS, Ms. Bertini has made a very significant contribution in
raising awareness and arousing action in response to the needs of the
hungry poor, particularly in working to close the "gender gap" in
Afghanistan, where the WFP created bakeries run by women and supported
school-based feeding programs; and
WHEREAS, Prior to her appointment as Executive Director of the WFP
by the Secretary General of the United Nations, Ms. Bertini served as
the Assistant Secretary of the United States Department of Agriculture
from 1989 to 1992, responsible for food assistance programs, including
Food Stamps, school breakfast and lunch programs, and the Women,
Infants and Children (WIC) Program; and
WHEREAS, Ms. Bertini began her distinguished federal government
career as the Acting Assistant Secretary of the United States
Department of Health and Human Services, responsible for managing and
developing the nation's policy for the (former) Aid to Families with
Dependent Children program, as well as welfare reform, child support
enforcement, refugee resettlement and community services; and
WHEREAS, During her residency in Illinois and Chicago, Ms. Bertini
served as the Manager of Public Policy and State and Local Public
Affairs for Container Corporation of America, a member of the Illinois
Human Rights Commission, a fellow at Harvard University's Kennedy
School of Government, and the President of the 43rd Ward Republican
Party under Committeeman Ron Gidwitz; and
WHEREAS, Ms. Bertini will complete the maximum 10-year, two-term
tenure as Executive Director of the WFP in April, 2002, completing a
remarkable and distinguished career increasing awareness, and
financial and food contributions, as well as health and nutrition to
the hungry poor of the world; therefore be it

to Springfield from Champaign in 1961; and
WHEREAS, Pat entered the association management business in 1972
and has been an honorable, hardworking, dedicated, and loyal employee
of the Illinois Movers and Warehousemen's Association for the past 30
years, serving as their Executive Director since 1989; and
WHEREAS, Pat served her association and the public by helping to
create the Illinois Movers and Warehousemen's Risk Management Group (a

self-funded workers' compensation pool) and she still serves as its
Executive Director; and
WHEREAS, Pat organized the Governmental Oversight Information
Network, a coalition to provide consumer protection against fraudulent
moving and storage practices; and continues to serve as Executive
Director of the Illinois Movers Tariff Bureau; and
WHEREAS, Pat led her organization at the national level in various
capacities including three terms as chair of the National Council of
Moving Associations and three terms on the Board of Directors of the
National Moving and Storage Association, and in 2000 became a member of
the editorial advisory board for MOVER Magazine; and
WHEREAS, Pat's peers in association management acknowledged her
leadership skills while serving from 1975-1980 as the Executive
Director of the Illinois Society of Association Executives (ISAE);
serving on the ISAE Board of Directors from 1981-1986, being elected
ISAE President in 1986, and receiving the ISAE Distinguished Member
award in 1991; and
WHEREAS, Pat is a registered lobbyist in Illinois, a member of the
Illinois Commerce Commission's Household Goods Advisory Committee, and
in 1995-96, she served as President of the Rotary Club of Springfield
South; and
WHEREAS, Pat is a friend, a mentor, a creative problem solver who
demonstrates a deep enthusiasm and genuine caring for the moving

Sec. 25. Wholesale drug distributor licensing requirements. All
wholesale distributors and pharmacy distributors, wherever located, who

engage in wholesale distribution into, out of, or within the State
shall be subject to the following requirements:
(a) No person or distribution outlet shall act as a wholesale drug
distributor without first obtaining a license to do so from the
Department and paying any reasonable fee required by the Department,
the fee not to exceed $200 per year.
(b) The Department may grant a temporary license when a wholesale
drug distributor first applies for a license to operate within this
State. A temporary license shall remain valid until the Department
finds that the applicant meets or fails to meet the requirements for
regular licensure. Nevertheless, no temporary license shall be valid
for more than 90 days from the date of issuance. Any temporary license
issued under this subsection shall be renewable for a similar period of
time not to exceed 90 days under policies and procedures prescribed by
the Department.
(c) No license shall be issued or renewed for a wholesale drug
distributor to operate unless the wholesale drug distributor shall
operate in a manner prescribed by law and according to the rules and
regulations promulgated by the Department.
(d) The Department may require a separate license for each
facility directly or indirectly owned or operated by the same business
entity within this State, or for a parent entity with divisions,
subsidiaries, and affiliate companies within this State when operations
are conducted at more than one location and there exists joint
ownership and control among all the entities.
(e) As a condition for receiving and renewing any wholesale drug
distributor license issued under this Act, each applicant shall satisfy
the Department that it has and will continuously maintain:
(1) acceptable storage and handling conditions plus
facilities standards;
(2) minimum liability and other insurance as may be required
under any applicable federal or State law;
(3) a security system that includes after hours, central
alarm or comparable entry detection capability; restricted premises
access; adequate outside perimeter lighting; comprehensive
employment applicant screening; and safeguards against employee
theft;
(4) an electronic, manual, or any other reasonable system of
records, describing all wholesale distributor activities governed
by this Act for the 2 year period following disposition of each
product and reasonably accessible during regular business hours as
defined by the Department's rules in any inspection authorized by
the Department;
(5) officers, directors, managers, and other persons in
charge of wholesale drug distribution, storage, and handling who
must at all times demonstrate and maintain their capability of
conducting business according to sound financial practices as well
as State and federal law;
(6) complete, updated information, to be provided the
Department as a condition for obtaining and renewing a license,
about each wholesale distributor to be licensed under this Act,
including all pertinent licensee ownership and other key personnel
and facilities information deemed necessary for enforcement of this
Act. Any changes in this information shall be submitted at the time
of license renewal or within 45 days from the date of the change;
(7) written policies and procedures that assure reasonable
wholesale distributor preparation for, protection against and
handling of any facility security or operation problems, including,
but not limited to, those caused by natural disaster or government
emergency; inventory inaccuracies or product shipping and
receiving; outdated product or other unauthorized product control;
appropriate disposition of returned goods; and product recalls;
(8) sufficient inspection procedures for all incoming and
outgoing product shipments; and
(9) operations in compliance with all federal legal
requirements applicable to wholesale drug distribution.

(f) The Department shall consider, at a minimum, the following
factors in reviewing the qualifications of persons who engage in
wholesale distribution of prescription drugs in this State:
(1) any conviction of the applicant under any federal, State,
or local laws relating to drug samples, wholesale or retail drug
distribution, or distribution of controlled substances;
(2) any felony convictions of the applicant under federal,
State, or local laws;
(3) the applicant's past experience in the manufacture or
distribution of prescription drugs, including controlled
substances;
(4) the furnishing by the applicant of false or fraudulent
material in any application made in connection with drug
manufacturing or distribution;
(5) suspension or revocation by federal, State, or local
government of any license currently or previously held by the
applicant for the manufacture or distribution of any drug,
including controlled substances;
(6) compliance with licensing requirements under previously
granted licenses, if any;
(7) compliance with requirements to maintain and make
available to the Department or to federal, State, or local law
enforcement officials those records required by this Act; and
(8) any other factors or qualifications the Department
considers relevant to and consistent with the public health and
safety, including whether the granting of the license would not be
in the public interest.
(9) All requirements set forth in this subsection shall
conform to wholesale drug distributor licensing guidelines formally
adopted by the U.S. Food and Drug Administration (FDA). In case of
conflict between any wholesale drug distributor licensing
requirement imposed by the Department and any FDA wholesale drug
distributor licensing guideline, the FDA guideline shall control.
(g) An agent or employee of any licensed wholesale drug
distributor need not seek licensure under this Section and may lawfully
possess pharmaceutical drugs when the agent or employee is acting in
the usual course of business or employment.
(h) The issuance of a license under this Act shall not change or
affect tax liability imposed by the State on any wholesale drug
distributor.
(i) A license issued under this Act shall not be sold,
transferred, or assigned in any manner.

Sec. 35. Fees; Illinois State Pharmacy Disciplinary Fund.
(a) The Department shall provide by rule for a schedule of fees
for the administration and enforcement of this Act, including but not
limited to original licensure, renewal, and restoration. The fees shall
be nonrefundable. The following fees shall be imposed by the Department
and are not refundable.
(1) The fee for application for a certificate of registration
as a wholesale drug distributor is $200.
(2) The fee for the renewal of a certificate of registration
as a wholesale drug distributor is $200 per year.
(3) The fee for the change of person responsible for drugs is
$50.
(4) The fee for the issuance of a duplicate license to
replace a license that has been lost or destroyed is $25.
(5) The fee for certification of a registrant's record for
any purpose is $25.
(6) The fee for a roster of licensed wholesale drug
distributors shall be the actual cost of producing the roster.
(7) The fee for wholesale drug distributor licensing,
disciplinary, or investigative records obtained under subpoena is
$1 per page.

(b) All fees collected under this Act shall be deposited into the
Illinois State Pharmacy Disciplinary Fund and shall be appropriated to
the Department for the ordinary and contingent expenses of the
Department in the administration of this Act. All moneys received by
the Department under this Act shall be deposited into the Illinois
State Pharmacy Disciplinary Fund in the State Treasury and shall be
used only for the following purposes: (i) by the State Board of
Pharmacy in the exercise of its powers and performance of its duties,
as such use is made by the Department upon the recommendations of the
State Board of Pharmacy, (ii) for costs directly related to license
renewal of persons licensed under this Act, and (iii) for direct and
allocable indirect costs related to the public purposes of the
Department of Professional Regulation. Moneys in the Fund may be
transferred to the Professions Indirect Cost Fund as authorized by
Section 2105-300 of the Department of Professional Regulation Law (20
ILCS 2105/2105-300).
The moneys deposited into the Illinois State Pharmacy Disciplinary
Fund shall be invested to earn interest which shall accrue to the Fund.
The Department shall present to the Board for its review and
comment all appropriation requests from the Illinois State Pharmacy
Disciplinary Fund. The Department shall give due consideration to any
comments of the Board in making appropriation requests.
(c) Any person who delivers a check or other payment to the
Department that is returned to the Department unpaid by the financial
institution upon which it is drawn shall pay to the Department, in
addition to the amount already owed to the Department, a fine of $50.
The fines imposed by this Section are in addition to any other
discipline provided under this Act for unlicensed practice or practice
on a nonrenewed license. The Department shall notify the person that
payment of fees and fines shall be paid to the Department by certified
check or money order within 30 calendar days of the notification. If,
after the expiration of 30 days from the date of the notification, the
person has failed to submit the necessary remittance, the Department
shall automatically terminate the license or certificate or deny the
application, without hearing. If, after termination or denial, the
person seeks a license or certificate, he or she shall apply to the
Department for restoration or issuance of the license or certificate
and pay all fees and fines due to the Department. The Department may
establish a fee for the processing of an application for restoration of
a license or certificate to pay all expenses of processing this
application. The Director may waive the fines due under this Section
in individual cases where the Director finds that the fines would be
unreasonable or unnecessarily burdensome.
(d) The Department shall maintain a roster of the names and
addresses of all registrants and of all persons whose licenses have
been suspended or revoked. This roster shall be available upon written
request and payment of the required fee.

bonds, or other obligations (and in connection with that issuance,
establish a line of credit with a bank) in an amount not to exceed 85%
of the amount of property taxes most recently levied for educational
and building purposes. Moneys thus borrowed shall be applied to the
purposes for which they were obtained and no other purpose. All moneys
so borrowed shall be repaid exclusively from property tax revenues
within 60 days after the property tax revenues have been received by
the board.
(b) Borrowing authorized under subsection (a) of this Section
shall bear interest at a rate not to exceed the maximum rate authorized
by the Bond Authorization Act, from the date of issuance until paid.
(c) Prior to the board borrowing or establishing a line of credit
under this Section, the board shall authorize, by resolution, the
borrowing or line of credit. The resolution shall set forth facts
demonstrating the need for the borrowing or line of credit, state the
amount to be borrowed, establish a maximum interest rate limit not to
exceed that set forth in subsection (b) of this Section, and provide a
date by which the borrowed funds shall be repaid. The resolution shall
direct the relevant officials to make arrangements to set apart and
hold the taxes, as received, that will be used to repay the borrowing.
In addition, the resolution may authorize the relevant officials to
make partial repayments of the borrowing as the taxes become available
and may contain any other terms, restrictions, or limitations not
inconsistent with the provisions of this Section.".

numbered 1 and 2 were ordered engrossed; and the bill, as amended, was
held on the order of Second Reading.

By unanimous consent, on motion of Representative Lindner, HOUSE

moved to accept the Governor's Specific Recommendations for Change to
HOUSE BILL 3247, by adoption of the following amendment:
I move to accept the specific recommendations of the Governor as to
House Bill 3247 in manner and form as follows:
AMENDMENT TO HOUSE BILL 3247
IN ACCEPTANCE OF GOVERNOR'S RECOMMENDATIONS
Amend House Bill 3247 on page 74, immediately below line 30, by
inserting the following:
"Language establishing a reverter without further action to the
State of Illinois should the land be used for purposes other than
public purposes shall be placed in the quitclaim deed conveying said
property."; and
on page 77, immediately below line 32, by inserting the following:
"Language establishing a reverter without further action to the
State of Illinois should the land be used for purposes other than
public purposes shall be placed in the quitclaim deed conveying said
property."; and
on page 79, line 2, by replacing "100" with "10"; and
on page 79, line 3, by replacing "east" with "west"; and
