Offered by Representative Schoenberg:
WHEREAS, The members of the Illinois House of Representatives are
proud to congratulate Stewart L. Grill of Evanston for being selected
by the American Jewish Committee for the Professional Achievement
Award, which will be presented on June 6, 2002; and
WHEREAS, Steward Grill earned his degree in Light Construction
Engineering from Michigan State University in 1958, after serving two
years in the U.S. Army; and
WHEREAS, Mr. Grill co-founded the 3-H Building Corporation in 1962
and became Chairman in 1969; in 1972, after building 3,500 homes and
various office, apartment, and commercial projects, 3-H was acquired by
US Home Corporation; and
WHEREAS, From 1972 to 1978, Mr. Grill was the Real Estate
consultant for the Pritzker Family real estate interests; since 1977,
he has been a Consultant for various corporations, accounting, and law
firms; Mr. Grill has been involved as a Development Partner in many
Chicago-area new and rehab projects including 540 Lake Shore Drive,
Three O'Hare Towers, and The Regensteiner Printing Complex; and
WHEREAS, Mr. Grill has been a director/trustee of many real estate
organizations including The Hotel Corporation of Israel, Michigan State
Construction Alumni Association, and The Home Builders Association of
Greater Chicago; he is Past President and Life Director of the
Residential Construction Employers Council; and
WHEREAS, Mr. Grill is active in the community and has served as
Director of LaRabida Childrens Hospital, United Jewish Appeal Young

business, Polk Brothers; he achieved an Executive Vice Presidency at
Heitman Financial and was President of Philipsborn Equities, the real
estate subsidiary of I.C. Industries; and
WHEREAS, In 1981, Mr. Bachmann established his own real estate
firm, Bachmann Associates, Ltd., where he has been active in
development and mortgage brokerage; he is a real estate broker and a
certified property manager; and
WHEREAS, Mr. Bachmann enjoys his responsibilities serving as
President of the Jewish Community Centers of Chicago; he is a Board
Member of the Polk Bros. Foundation and mentors an "I have a Dream"
class of students now completing their college education; Mr. Bachmann
is an Associate National Commissioner of the Anti-Defamation League and
a Director for Life of the Jewish Council for Youth Services; he is a
member of the Chicago Committee, U.S. Holocaust Memorial Museum, and a
Board Member of the Jewish Federation of Metropolitan Chicago; his love
for his Jewish heritage, as well as the children of Israel and the
world, was evident during his presidency of Israel Children's Centers;
and
WHEREAS, Bruce Bachmann married his college sweetheart, Ann Cohen,
and together they raised four children, Steve, Cathy (Douglas)
Ethridge, Betsy (Jeffrey) Kushen, and Andy; they are the proud

proud to congratulate Dr. William W. Small of Frankfort on his
retirement as Superintendent in District 143 on June 30, 2002; and
WHEREAS, Dr. Small has been in the field of education since 1971 as
a teacher, at St. Agnes from 1971 to 1972 and Dirksen Jr. High School
from 1972 to 1977; he was a principal and administrative assistant from
1977 to 1985 at Frankfort Junior High School; and he was superintendent
from 1985 to 1989 for District 133 and from 1989 to the present for
District 143; and
WHEREAS, Dr. Small received his Bachelor's degree in political
science from Northern Illinois University in 1970; he earned his
Master's degree in elementary education from Roosevelt University in
1975 and another Master's degree in educational administration from St.
Xavier University in 1978; he earned his Doctorate in educational
administration from Illinois State University in 1987; and

WHEREAS, Dr. Small has received several awards and has been a
member of many professional organizations, including the Bremen
Association of School Administrators, of which he was past president in
1991; he was president of the South Cook County School Administrators'
Association in 1992, the South Cook director from 1994-2000 of the
Illinois Association of School Administrators; he was a member of the
American Association of School Administrators, the Illinois Principals'
Association, the Illinois Association for Supervision and Curriculum
Development, the National School Public Relations Association, the
Superintendents' Round Table/Study Club of Northern Illinois, and the
Phi Delta Kappa professional fraternity, Homewood Chapter; Those Who
Excel Award of Merit was given Dr. Small by the Illinois State Board of
Education in 1995; and he is an Honorary Life Member of Illinois
Congress of Parents and Teachers; and
WHEREAS, Dr. Small was instrumental in getting the Governors of
this State to visit Midlothian; Governor Edgar visited in March 1997 to
make a campaign commercial in District 143 and in December 1997 for the
signing if House Bill 452 in District 143; Former Governor Edgar
visited in November 1999 for the Edgar addition to Kolmar School; and
Governor Ryan visited in July 1999 for the signing of House Bill 1134;
and
WHEREAS, Dr. Small reinstated the band program and expanded the
technology throughout District 143; he initiated after-school,
year-round tutoring for students in jeopardy of failing and adopted the
Reading Recovery program; and
WHEREAS, Dr. Small and his wife of 28 years, Bonnie, have 4
children, Jimmy, Jon, Jason, and Jenny; therefore, be it

have devoted considerable time to coaching local sports' teams,

a Chicago police officer, detective, sergeant, lieutenant, and now

Northwestern University with a Bachelor of Science Degree in
organization behavior and was inducted into the Alpha chapter of Alpha
Sigma Lambda, a national honor society for evening colleges of liberal
arts; he went on to graduate school at Saint Xavier University, earned
a Master of Business Administration Degree in 1999, and was inducted
into Kappa Gamma Pi, a national graduate honor society; Mr. Evans was
bestowed the H.J. Hwang Award for academic excellence, having earned a
perfect 4.0 grade point average; and
WHEREAS, Mr. Evans is a former member and past president of the St.
Christina School Board, Co-Chairman of the St. Christina Parish
Advisory Committee, Vice-Chairman of the St. Christina Parish Pastoral
Council, a committee member of the St. Christina Summerfest, a member

Committee member of the St. Christina Holy Name Society; he serves as

President of the Y-ME National Breast Cancer Organization; she is a
member of the Little Company of Mary Hospital Foundation Board, the St.
Xavier University President's Advisory Council, Vice President of the
Irish Fellowship Club of Chicago, Kiwanis, Brother Rice High School
Board of Directors, and the Beverly Art Center; she was appointed to
Richard M. Daley's Task Force on Women's Health and the Cook County
Women's Commission; and
WHEREAS, Ms. Rugai began her career as an English teacher at Queen
Peace High School with a bachelor of science from Loyola University;
before becoming an Alderman, she served as Assistant to the Director of
the Beverly Area Planning Association, was a member of the Illinois
Senate Staff, and an Administrative Aid to State Senator Jeremiah
Joyce; and
WHEREAS, During her 25 years of community service, Ms. Rugai has
served as a volunteer member and/or chaired committees on the Far
Southwest Mental Health Council, the Beverly Family Center, the Ridge
Park Advisory Council, Marist High School Mother's Club, Mt. Carmel
Women's Club, St. Ignatius Mother's Club, the Beverly Improvement

proud to congratulate Ronald and Stanley Jensen of Momence, who were
named the 2002 Momence Citizens of the Year; and
WHEREAS, The Jensen brothers are natives of Momence and each has
given over half a century of volunteerism to the community for the
simple reason that it is home; and
WHEREAS, At the age of 79, Stanley Jensen is a city alderman, a
Lions Club member, and has worked on the Gladiolus Festival 5 and 10K
race; he has long maintained the Lions club paper recycling trailer and
is in charge of changing the announcements on the community sign;
Stanley Jensen also worked on Momence's Millenium New Year's Eve
celebration; his most recent project has been the renovation of a
southside car dealership into a community hall; and
WHEREAS, Stanley Jensen is a member of Our Savior Lutheran Church
in Momence, a long-time board member for Municipal Bank, and a member
of the American Legion; in his free time, he enjoys golfing; and
WHEREAS, Ronald Jensen, at 77, is commonly seen with his brother
setting up for Lions Club pancake breakfasts or mowing entryways into
the city that need a trim; his long list of volunteerism includes being
a school board member for 10 years and the Lions Club president for
three; in the Lions Club, he initiated the purchase a community sign
and not only sets up, but works the pancake breakfasts; and

WHEREAS, Ronald Jensen is a member of the Momence VFW and commander
of the American Legion Post 40; he is a member of the First United
Methodist Church, where is a member of the choir and chairman of the
board of trustees; Ronald Jensen helped spearhead and renew the 5 and
10K race that has long been a popular part of the Gladiolus Festival
activities; he has worked several Kankakee River clean-up projects and
is a substitute bus driver when able; in his free time, Ronald Jensen
dabbles in woodworking; and
WHEREAS, Ronald Jensen's wife, Phyllis, is a retired school teacher
and together, they have three daughters, Julie (Bob) Tallman, Jane
Jensen, and Jennifer (Darin) Morse; they also have four grandchildren;
and
WHEREAS, The Jensen brothers were both Marines during World War II,
Stanley serving in the Marine Air Corps and Ronald in field artillery;
and
WHEREAS, For 35 years together, they operated a farm that included
various pieces of ground all around Momence; and
WHEREAS, Since Ronald and Stanley Jensen's retirement in 1990,
things have not slowed down, but given them more time to get involved
with different projects, be it for church, community, or city;

retiring from his position as superintendent of Bradley-Bourbonnais
Community High School after 31 years with the school; and
WHEREAS, Dennis Bossinger grew up in East Chicago, Indiana; he
attended Indiana University for a time before returning to East Chicago
to work in the steel mills as a millwrights helper; he then decided to
go to Eastern Illinois University, where he played football and made
the decision to become a teacher; and
WHEREAS, He received a master's degree at the University of
Illinois at Urbana-Champaign, received a certificate of advanced study
at Illinois State University, and has studied at DePaul University and
the University of Chicago; and
WHEREAS, Dennis Bossinger began his 31-year career at
Bradley-Bourbonnais Community High School as a social studies teacher
and a track and basketball coach; during his time at
Bradley-Bourbonnais Community High School, Dennis Bossinger held the
positions of dean of students, head of student affairs, assistant to
the superintendent in charge of Title I, and business manager; and
WHEREAS, During his time at Bradley-Bourbonnais Community High
School, many changes have taken place at the school, including
expansion of the curriculum, athletics, and the special education
program; and
WHEREAS, Dennis Bossinger plans to keep busy after his retirement
with volunteer work, reading, and spending time with his family,
including his wife, Cindy, four children, two step-children, and two

Visually Impaired; and
WHEREAS, Mrs. Aldridge began her teaching career at the Illinois
School for the Visually Impaired in 1954; and
WHEREAS, Mrs. Aldridge is an accomplished vocalist and music lover
who integrates music into her regular classroom routine; her students
are exposed to a myriad of musical styles and begin learning to make
music of their own using simple instruments; and
WHEREAS, Mrs. Aldridge's dedication to her students has led her to
write and Braille several books; over the years, she has personally
adapted numerous toys and school supplies to meet the educational needs
of her students; even on her well-deserved vacations, she is constantly
looking for items she can bring back to her classroom to help the
children understand different parts of the world; and
WHEREAS, Life skills are an important part of the instruction for
visually impaired children; after 47 years, Mrs. Aldridge has developed
a style of teaching that is at the same time both strict and adaptable;
her no-nonsense approach has helped many children develop self-help
skills that most sighted children acquire simply by watching others;
yet she is flexible when the situation calls for it, making sure the
children have fun learning; and
WHEREAS, The teaching profession has changed enormously over the
past 47 years, yet Mrs. Aldridge's dedication to her students and love
for teaching has not wavered; therefore, be it

HOUSE RESOLUTION 950
Offered by Representative Monique Davis:
WHEREAS, Juneteenth is the oldest known celebration of the ending
of slavery; and
WHEREAS, It was on June 19, 1865 that the Union soldiers, led by
Major General Gordon Granger, landed at Galveston, Texas with news that
the Civil War had ended and that the enslaved were now free; and

WHEREAS, Although President Abraham Lincoln's Emancipation
Proclamation was made official on January 1, 1863, it had little effect
in Texas due to the minimal number of Union troops to enforce the
executive order; however, with the surrender of General Robert E. Lee
in 1865, and the arrival of Major General Granger's regiment, the
forces were finally strong enough to influence and overcome the
resistance; and
WHEREAS, The celebration of June 19th was coined "Juneteenth" and
grew with more participation from descendents of slaves; the
celebration is a time for reassuring each other, for praying, and for
gathering remaining family members; it continues to be highly revered
in Texas, decades later, with many former slaves and descendants making
an annual pilgrimage back to Galveston on June 19th; and
WHEREAS, Juneteenth today celebrates African-American freedom while
encouraging self-development and respect for all cultures; this
celebration has continued to enjoy a growing and healthy interest from
communities and organizations across the country seeking to promote and
cultivate knowledge and appreciation of African-American history and
culture; therefore, be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-SECOND
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we designate June 19,
2002 as "Juneteenth Day" in the State of Illinois in appreciation of

HOUSE RESOLUTION 954

WHEREAS, The State of Illinois is currently suffering from a
serious budgetary shortfall; and
WHEREAS, Illinois is currently in litigation with 4 law firms over
a claim for $780,000,000 in attorney fees from Illinois' share of the
national tobacco settlement; and
WHEREAS, The litigation is being heard before Judge James F. Henry;
Judge Henry has now ordered Illinois Attorney General Jim Ryan and the
tobacco litigation lawyers to engage in settlement before an
independent mediator; and
WHEREAS, The State of Illinois has a duty to provide humane and
fundamental aid and treatment to its most vulnerable citizens who carry
on their backs the devastating effects of the budgetary shortfall and
who are the rightful and needing recipients of the tobacco settlement
dollars; and
WHEREAS, Judge Henry has stated that the case "cries out to be
settled" and that "the case is ripe for settlement"; therefore be it
RESOLVED, BY THE HOUSE OF REPRESENTATIVE OF THE NINETY- SECOND
GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we urge Illinois
Attorney General Jim Ryan to negotiate a settlement and use the offices
of the mediator concerning the attorney fee litigation as rapidly as
possible so that tobacco settlement moneys can be used for health and
human services programs; and be it further

Illinois Attorney General Jim Ryan and to the Speaker and Minority
Leader of the Illinois House of Representatives and the President and

HOUSE JOINT RESOLUTION 79
Offered by Representative Stephens:
WHEREAS, All of Illinois is proud of the service to our country
provided by the 173rd Airborne Brigade; and
WHEREAS, The Greatest chapter of the Brigade's history began in
21 [May 23, 2002]
1963; the 173rd Airborne Brigade (Separate) was activated on the island
of Okinawa on March 26, 1963; the "Sky Soldier" as the nationalist
Chinese paratroopers called the 173rd, made thousands of training
parachute jumps in a dozen different pacific area countries; the
Brigade was the first Army unit sent to the republic of South Vietnam
in May 1965; and
WHEREAS, In the combat operations to follow, the paratroopers made
their superb training payoff; in "War Zone D" they destroyed enemy base
camps, and they took part in battles such as the iron triangle, Pleiku,
and Kontum and many others; they conducted the only major combat
parachute jump in the Tay Ninh Area and blocked North Vietnam
incursions during the bloodiest fighting of the war at "Dak To" during
the summer and fall of 1967, culminating in the capture of "Hill 875";
elements of the Brigade conducted an amphibious assault against North
Vietnam and Viet Cong forces as part of an operation to clear the rice
growing lowlands along the "Bong Song" Littoral; and
WHEREAS, The Troopers of the 173rd Airborne Brigade (SEP) wear
their combat badges and decorations with pride; during more than six
years of nearly continuous combat in Vietnam, the brigade earned 14
campaign streamers and four unit citations, had 13 Medal of Honor
winners, had over 130 distinguished service crosses winners, and was
awarded over 6,000 purple hearts; and they conducted the only U.S.

AMENDMENT NO. 2 TO SENATE BILL 1657
AMENDMENT NO. 2. Amend Senate Bill 1657 on page 1, by replacing
lines 4 and 5 with the following:
"Section 5. The Illinois Vehicle Code is amended by changing
Sections 11-907, 11-908, and 12-215 as follows:
(625 ILCS 5/11-907) (from Ch. 95 1/2, par. 11-907)
Sec. 11-907. Operation of vehicles and streetcars on approach of
authorized emergency vehicles.
(a) Upon the immediate approach of an authorized emergency vehicle
making use of audible and visual signals meeting the requirements of
this Code or a police vehicle properly and lawfully making use of an
audible or visual signal,
(1) the driver of every other vehicle shall yield the
right-of-way and shall immediately drive to a position parallel to,
and as close as possible to, the right-hand edge or curb of the
highway clear of any intersection and shall, if necessary to permit
the safe passage of the emergency vehicle, stop and remain in such
position until the authorized emergency vehicle has passed, unless
otherwise directed by a police officer and
(2) the operator of every streetcar shall immediately stop
such car clear of any intersection and keep it in such position
until the authorized emergency vehicle has passed, unless otherwise
directed by a police officer.
(b) This Section shall not operate to relieve the driver of an
authorized emergency vehicle from the duty to drive with due regard for
the safety of all persons using the highway.
(c) Upon approaching a stationary authorized emergency vehicle,
when the authorized emergency vehicle is giving a signal by displaying
alternately flashing red, red and white, blue, or red and blue lights
or amber or yellow warning lights, a person who drives an approaching
vehicle shall:
(1) proceeding with due caution, yield the right-of-way by
making a lane change into a lane not adjacent to that of the
authorized emergency vehicle, if possible with due regard to safety
and traffic conditions, if on a highway having at least 4 lanes
with not less than 2 lanes proceeding in the same direction as the

approaching vehicle; or
(2) proceeding with due caution, reduce the speed of the
vehicle, maintaining a safe speed for road conditions, if changing
lanes would be impossible or unsafe.
As used in this subsection (c), "authorized emergency vehicle"
includes any vehicle authorized by law to be equipped with oscillating,
rotating, or flashing lights under Section 12-215 of this Code, while
the owner or operator of the vehicle is engaged in his or her official
duties.
(d) A person who violates subsection (c) of this Section commits a
business offense punishable by a fine of not more than $10,000. A
person charged with the offense must appear in court to answer the
charges. It is a factor in aggravation if the person committed the
offense while in violation of Section 11-501 of this Code.
(e) If a violation of subsection (c) of this Section results in
damage to the property of another person, in addition to any other
penalty imposed, the person's driving privileges shall be suspended for
a fixed period of not less than 90 days and not more than one year.
(f) If a violation of subsection (c) of this Section results in
injury to another person, in addition to any other penalty imposed, the
person's driving privileges shall be suspended for a fixed period of
not less than 180 days and not more than 2 years.
(g) If a violation of subsection (c) of this Section results in
the death of another person, in addition to any other penalty imposed,
the person's driving privileges shall be suspended for 2 years.
(h) The Secretary of State shall, upon receiving a record of a
judgment entered against a person under subsection (c) of this Section:
(1) suspend the person's driving privileges for the mandatory
period; or
(2) extend the period of an existing suspension by the
appropriate mandatory period.

Sec. 11-908. Vehicle approaching or entering a highway
construction or maintenance area or zone.
(a) The driver of a vehicle shall yield the right of way to any
authorized vehicle or pedestrian actually engaged in work upon a
highway within any highway construction or maintenance area indicated
by official traffic-control devices.
(a-1) Upon entering a construction or maintenance zone when
workers are present, a person who drives a vehicle shall:
(1) proceeding with due caution, make a lane change into a
lane not adjacent to that of the workers present, if possible with
due regard to safety and traffic conditions, if on a highway having
at least 4 lanes with not less than 2 lanes proceeding in the same
direction as the approaching vehicle; or
(2) proceeding with due caution, reduce the speed of the
vehicle, maintaining a safe speed for road conditions, if changing
lanes would be impossible or unsafe.
(a-2) A person who violates subsection (a-1) of this Section
commits a business offense punishable by a fine of not more than
$10,000. A person charged with the offense must appear in court to
answer the charges. It is a factor in aggravation if the person

flagger or a traffic control signal and remain in such position until
signaled to proceed. If a driver of a vehicle fails to stop when
signaled to do so by a flagger, the flagger is authorized to report
such offense to the State's Attorney or authorized prosecutor. The
penalties imposed for a violation of this subsection (c) shall be in
addition to any penalties imposed for a violation of subsection (a-1).

Sec. 4. (a) Each applicant for a Firearm Owner's Identification
Card must:
(1) Make application on blank forms prepared and furnished at
convenient locations throughout the State by the Department of
State Police, or by electronic means, if and when made available by
the Department of State Police; and
(2) Submit evidence to the Department of State Police that:
(i) He or she is 21 years of age or over, or if he or
she is under 21 years of age that he or she has the written
consent of his or her parent or legal guardian to possess and
acquire firearms and firearm ammunition and that he or she has
never been convicted of a misdemeanor other than a traffic
offense or adjudged delinquent, provided, however, that such
parent or legal guardian is not an individual prohibited from
having a Firearm Owner's Identification Card and files an
affidavit with the Department as prescribed by the Department
stating that he or she is not an individual prohibited from
having a Card;
(ii) He or she has not been convicted of a felony under
the laws of this or any other jurisdiction;
(iii) He or she is not addicted to narcotics;
(iv) He or she has not been a patient in a mental
institution within the past 5 years;
(v) He or she is not mentally retarded;
(vi) He or she is not an alien who is unlawfully present
in the United States under the laws of the United States;
(vii) He or she is not subject to an existing order of
protection prohibiting him or her from possessing a firearm;
(viii) He or she has not been convicted within the past
5 years of battery, assault, aggravated assault, violation of
an order of protection, or a substantially similar offense in
another jurisdiction, in which a firearm was used or
possessed;
(ix) He or she has not been convicted of domestic
battery or a substantially similar offense in another
jurisdiction committed on or after the effective date of this
amendatory Act of 1997; and
(x) He or she has not been convicted within the past 5
years of domestic battery or a substantially similar offense
in another jurisdiction committed before the effective date of
this amendatory Act of 1997; and
(3) Upon request by the Department of State Police, sign a
release on a form prescribed by the Department of State Police
waiving any right to confidentiality and requesting the disclosure

to the Department of State Police of limited mental health
institution admission information from another state, the District
of Columbia, any other territory of the United States, or a foreign
nation concerning the applicant for the sole purpose of determining
whether the applicant is or was a patient in a mental health
institution and disqualified because of that status from receiving
a Firearm Owner's Identification Card. No mental health care or
treatment records may be requested. The information received shall
be destroyed within one year of receipt.
(a-5) Each applicant for a Firearm Owner's Identification Card who
is over the age of 18 shall furnish to the Department of State Police
either his or her driver's license number or Illinois Identification
Card number.
(a-10) Each applicant for a Firearm Owner's Identification Card,
who is employed as an armed security officer at a nuclear energy,
storage, weapons, or development facility regulated by the Nuclear
Regulatory Commission and who is not an Illinois resident, shall
furnish to the Department of State Police his or her driver's license
number or state identification card number from his or her state of
residence. The Department of State Police may promulgate rules to
enforce the provisions of this subsection (a-10).
(b) Each application form shall include the following statement
printed in bold type: "Warning: Entering false information on an
application for a Firearm Owner's Identification Card is punishable as
a Class 2 felony in accordance with subsection (d-5) of Section 14 of
the Firearm Owners Identification Card Act.".
(c) Upon such written consent, pursuant to Section 4, paragraph
(a) (2) (i), the parent or legal guardian giving the consent shall be
liable for any damages resulting from the applicant's use of firearms
or firearm ammunition.

appearing in the abstract is the same as that of a person named in an
information or warrant, the abstract is prima facie evidence that the
person named in the information or warrant is the same person as the
person named in the abstract and is admissible for any prosecution
under this Act or any other applicable violation of law and may be
admitted as proof of any prior conviction or proof of records, notices,
or orders recorded on individual Firearm Owner's Identification Card
records maintained by the Department of State Police.".
