4 | "Section 1. Short title. This Act may be cited as the | ||||||
5 | Abraham Lincoln Presidential Library and Museum Act. | ||||||
6 | Section 5. Definitions. As used in this Act: | ||||||
7 | "Agency" means the Abraham Lincoln Presidential Library | ||||||
8 | and Museum. | ||||||
9 | "Board" means the Board of Trustees of the Abraham Lincoln | ||||||
10 | Presidential Library and Museum.
| ||||||
11 | "Executive Director" means the Executive Director of the | ||||||
12 | Abraham Lincoln Presidential Library and Museum. | ||||||
13 | "Library" means the Abraham Lincoln Presidential Library. | ||||||
14 | "Museum" means the Abraham Lincoln Presidential Museum. | ||||||
15 | Section 10. Abraham Lincoln Presidential Library and |

| |||||||
1 | Museum; establishment. | ||||||
2 | (a) The Abraham Lincoln Presidential Library and Museum, | ||||||
3 | formerly a constituent unit of the Illinois Historic | ||||||
4 | Preservation Agency, is created as an independent State agency | ||||||
5 | within the Executive Branch of State government. | ||||||
6 | (b) The Agency shall have control and custody of the | ||||||
7 | Abraham Lincoln Presidential Library and Museum complex, | ||||||
8 | including the Abraham Lincoln Presidential Library and Museum, | ||||||
9 | the Abraham Lincoln Presidential Library and Museum's parking | ||||||
10 | garage, Union Station, and Union Park, in Springfield. | ||||||
11 | (c) The Agency shall be under the supervision and direction | ||||||
12 | of the Executive Director of the Abraham Lincoln Presidential | ||||||
13 | Library and Museum. | ||||||
14 | Section 15. Board. There shall be a Board of Trustees of | ||||||
15 | the Abraham Lincoln Presidential Library and Museum to set | ||||||
16 | policy and advise the Abraham Lincoln Presidential Library and | ||||||
17 | Museum and the Executive Director on programs related to the | ||||||
18 | Abraham Lincoln Presidential Library and Museum and to exercise | ||||||
19 | the powers and duties given to it under Section 25 of this Act. | ||||||
20 | The Abraham Lincoln Presidential Library and Museum and the | ||||||
21 | Abraham Lincoln Presidential Library Foundation shall mutually | ||||||
22 | co-operate to maximize resources available to the Abraham | ||||||
23 | Lincoln Presidential Library and Museum and to support, | ||||||
24 | sustain, and provide educational programs and collections at | ||||||
25 | the Abraham Lincoln Presidential Library and Museum. Any |
| |||||||
| |||||||
1 | membership fees collected by the Abraham Lincoln Presidential | ||||||
2 | Library Foundation may be used to support the Abraham Lincoln | ||||||
3 | Presidential Library and Museum programs or collections at the | ||||||
4 | Foundation's discretion. | ||||||
5 | Section 20. Composition of the Board. The Board of Trustees | ||||||
6 | shall consist of 11 members to be appointed by the Governor, | ||||||
7 | with the advice and consent of the Senate. The Board shall | ||||||
8 | consist of members with the following qualifications: | ||||||
9 | (1) One member shall have recognized knowledge and ability | ||||||
10 | in matters related to business administration. | ||||||
11 | (2) One member shall have recognized knowledge and ability | ||||||
12 | in matters related to the history of Abraham Lincoln. | ||||||
13 | (3) One member shall have recognized knowledge and ability | ||||||
14 | in matters related to the history of Illinois. | ||||||
15 | (4) One member shall have recognized knowledge and ability | ||||||
16 | in matters related to library and museum studies. | ||||||
17 | (5) One member shall have recognized knowledge and ability | ||||||
18 | in matters related to historic preservation. | ||||||
19 | (6) One member shall have recognized knowledge and ability | ||||||
20 | in matters related to cultural tourism. | ||||||
21 | (7) One member shall have recognized knowledge and ability | ||||||
22 | in matters related to conservation, digitization, and | ||||||
23 | technological innovation. | ||||||
24 | The initial terms of office shall be designated by the | ||||||
25 | Governor as follows: one member to serve for a term of one |

| |||||||
1 | year, 2 members to serve for a term of 2 years, 2 members to | ||||||
2 | serve for a term of 3 years, 2 members to serve for a term of 4 | ||||||
3 | years, 2 members to serve for a term of 5 years, and 2 members | ||||||
4 | to serve for a term of 6 years. Thereafter, all appointments | ||||||
5 | shall be for a term of 6 years. The Governor shall appoint one | ||||||
6 | of the members to serve as chairperson at the pleasure of the | ||||||
7 | Governor. | ||||||
8 | The members of the Board shall serve without compensation | ||||||
9 | but shall be entitled to reimbursement for all necessary | ||||||
10 | expenses incurred in the performance of their official duties | ||||||
11 | as members of the Board from funds appropriated for that | ||||||
12 | purpose. | ||||||
13 | To facilitate communication and cooperation between the | ||||||
14 | Agency and the Abraham Lincoln Presidential Library | ||||||
15 | Foundation, the Foundation CEO shall serve as a non-voting, | ||||||
16 | ex-officio member of the Board. | ||||||
17 | Section 25. Powers and duties of the Board. The Board | ||||||
18 | shall: | ||||||
19 | (a) Set policies and establish programs for implementation | ||||||
20 | in support of the mission and goals of the Agency. | ||||||
21 | (b) Create and execute such seminars, symposia, or other | ||||||
22 | conferences as may be necessary or advisable to the Agency. | ||||||
23 | (c) Report annually to the Governor and the General | ||||||
24 | Assembly on the status of the Agency and its programs. | ||||||
25 | (d) Accept, hold, maintain, and administer, as trustee, |
| |||||||
| |||||||
1 | property given in trust for education or historic purposes for | ||||||
2 | the benefit of the people of the State of Illinois and dispose | ||||||
3 | of any property under the terms of the instrument creating the | ||||||
4 | trust. | ||||||
5 | (e) Accept, hold, maintain, and administer donated | ||||||
6 | property of historical significance, such as books, papers, | ||||||
7 | records, and personal property of any kind, including | ||||||
8 | electronic and digital property, pursuant to gifting | ||||||
9 | instruments, agreements, or deeds of gift, including but not | ||||||
10 | limited to the King Hostick Public Trust Fund, and enter into | ||||||
11 | such agreements as may be necessary to carry out the Board's | ||||||
12 | duties and responsibilities under this Section. | ||||||
13 | (f) Lease concessions at the Library and Museum. All | ||||||
14 | leases, for whatever period, shall be made subject to the | ||||||
15 | written approval of the Governor's Office of Management and | ||||||
16 | Budget. All concession leases extending for a period in excess | ||||||
17 | of 10 years shall contain provisions for the Agency to | ||||||
18 | participate, on a percentage basis, in the revenues generated | ||||||
19 | by any concession operation. | ||||||
20 | (g) Enforce the laws of the State and the rules of the | ||||||
21 | Agency. | ||||||
22 | (h) Cooperate with private organizations and agencies of | ||||||
23 | the State of Illinois by providing areas and the use of staff | ||||||
24 | personnel where feasible for the sale of publications on the | ||||||
25 | historic and cultural heritage of the State and craft items | ||||||
26 | made by Illinois craftsmen. These sales shall not conflict with |
| |||||||
| |||||||
1 | existing concession agreements. The Board is authorized to | ||||||
2 | negotiate and approve agreements with the organizations and | ||||||
3 | agencies for a portion of the moneys received from sales to be | ||||||
4 | returned to the Agency for the furtherance of interpretative | ||||||
5 | and restoration programs. | ||||||
6 | (i) Accept offers of gifts, gratuities, or grants from the | ||||||
7 | federal government, its agencies, or offices, or from any | ||||||
8 | person, firm, or corporation. | ||||||
9 | (j) Subject to the provisions of the Illinois | ||||||
10 | Administrative Procedure Act, make reasonable rules as may be | ||||||
11 | necessary to discharge the duties of the Agency. | ||||||
12 | (k) Charge and collect admission fees and rental for access | ||||||
13 | to and use of the facilities of the Library and Museum. | ||||||
14 | (l) Operate a restaurant, cafe, or other food serving | ||||||
15 | facility at the Museum or lease the operation of such a | ||||||
16 | facility under reasonable terms and conditions, and provide | ||||||
17 | vending services for food, beverages, or other products deemed | ||||||
18 | necessary and proper, consistent with the purposes of the | ||||||
19 | Library and Museum. | ||||||
20 | (m) Engage in marketing activities designed to promote the | ||||||
21 | Library and Museum. In undertaking these activities, the Board | ||||||
22 | may take all necessary steps with respect to products and | ||||||
23 | services, including, but not limited to, retail sales, | ||||||
24 | wholesale sales, direct marketing, mail order sales, telephone | ||||||
25 | sales, advertising and promotion, purchase of product and | ||||||
26 | materials inventory, design and printing and manufacturing of |
| |||||||
| |||||||
1 | new products, reproductions, and adaptations, copyright and | ||||||
2 | trademark licensing and royalty agreements, and payment of | ||||||
3 | applicable taxes. In addition, the Board shall have the | ||||||
4 | authority to sell advertising in its publications and printed | ||||||
5 | materials. | ||||||
6 | Section 30. Administration of the Agency. The Board shall | ||||||
7 | appoint an Executive Director of the Agency. The Executive | ||||||
8 | Director shall serve at the pleasure of the Board for a term of | ||||||
9 | 4 years. The Executive Director shall, subject to applicable | ||||||
10 | provisions of law, execute and discharge the powers and duties | ||||||
11 | of the Agency. The Executive Director shall have hiring power | ||||||
12 | and shall appoint (a) a Library Facilities Operations Director; | ||||||
13 | and (b) a Director of the Library. The Executive Director shall | ||||||
14 | appoint those other employees of the Agency as he or she deems | ||||||
15 | appropriate and shall fix the compensation of the Library | ||||||
16 | Facilities Operations Director, the Director of the Library and | ||||||
17 | other employees. The Executive Director may make provision to | ||||||
18 | establish and collect admission and registration fees, operate | ||||||
19 | a gift shop, and publish and sell educational and informational | ||||||
20 | materials. | ||||||
21 | Section 35. Executive Director; exchange historical | ||||||
22 | records. The Executive Director shall make all necessary rules, | ||||||
23 | regulations, and bylaws not inconsistent with law to carry into | ||||||
24 | effect the purposes of this Act and to procure from time to |
| |||||||
| |||||||
1 | time as may be possible and practicable, at reasonable costs, | ||||||
2 | all books, pamphlets, manuscripts, monographs, writings, and | ||||||
3 | other material of historical interest and useful to the | ||||||
4 | historian bearing upon the political, physical, religious, or | ||||||
5 | social history of the State of Illinois from the earliest known | ||||||
6 | period of time. The Executive Director may, with the consent of | ||||||
7 | the Board, exchange any books, pamphlets, manuscripts, | ||||||
8 | records, or other materials which such library may acquire that | ||||||
9 | are of no historical interest or for any reason are of no value | ||||||
10 | to it, with any other library, school or historical society. | ||||||
11 | The Executive Director shall distribute volumes of the series | ||||||
12 | known as the Illinois Historical Collections now in print, and | ||||||
13 | to be printed, to all who may apply for same and who pay to the | ||||||
14 | Library and Museum for such volumes an amount fixed by the | ||||||
15 | Executive Director sufficient to cover the expenses of printing | ||||||
16 | and distribution of each volume received by such applicants. | ||||||
17 | However, the Executive Director shall have authority to furnish | ||||||
18 | 25 of each of the volumes of the Illinois Historical | ||||||
19 | Collections, free of charge, to each of the authors and editors | ||||||
20 | of the Collections or parts thereof; to furnish, as in his or | ||||||
21 | her discretion he or she deems necessary or desirable, a | ||||||
22 | reasonable number of each of the volumes of the Collections | ||||||
23 | without charge to archives, libraries, and similar | ||||||
24 | institutions from which material has been drawn or assistance | ||||||
25 | has been given in the preparation of such Collections, and to | ||||||
26 | the officials thereof; and to furnish, as in his or her |
| |||||||
| |||||||
1 | discretion he or she deems necessary or desirable, a reasonable | ||||||
2 | number of each of the volumes of the Collections without charge | ||||||
3 | to the University of Illinois Library and to instructors and | ||||||
4 | officials of that University, and to public libraries in the | ||||||
5 | State of Illinois. The Executive Director may, with the consent | ||||||
6 | of the Board, also make exchanges of the Historical Collections | ||||||
7 | with any other library, school or historical society, and | ||||||
8 | distribute volumes of the Collections for review purposes. | ||||||
9 | Section 40. Illinois State Historian; appointment. The | ||||||
10 | Executive Director, with the advice and consent of the Board, | ||||||
11 | shall appoint the Illinois State Historian, who shall provide | ||||||
12 | historical expertise, support, and service on civic engagement | ||||||
13 | to educators and not-for-profit educational groups, including | ||||||
14 | historical societies. The State Historian is the State's | ||||||
15 | leading authority on the history of Illinois. | ||||||
16 | Section 45. State Historian; historical records. The State | ||||||
17 | Historian shall establish and supervise a program within the | ||||||
18 | Agency designed to preserve as historical records selected past | ||||||
19 | editions of newspapers of this State. Such editions shall be | ||||||
20 | preserved in accordance with industry standards. The negatives | ||||||
21 | of microphotographs and other materials shall be stored in a | ||||||
22 | place provided by the Agency. | ||||||
23 | The State Historian shall determine on the basis of | ||||||
24 | historical value the
various newspaper edition files which |
| |||||||
| |||||||
1 | shall be preserved and shall
arrange a schedule for such | ||||||
2 | preservation. The State Historian shall
supervise the making of | ||||||
3 | arrangements for acquiring access to past edition
files with | ||||||
4 | the editors or publishers of the various newspapers.
| ||||||
5 | The method of microphotography to be employed in this | ||||||
6 | program shall
conform to the standards established pursuant to | ||||||
7 | Section 17 of The State
Records Act. | ||||||
8 | Upon payment to the Agency of the required fee, any person | ||||||
9 | or organization shall be supplied with any prints requested to | ||||||
10 | be made from the newspapers and all records. The fee required | ||||||
11 | shall be determined by the State Historian and shall be equal | ||||||
12 | in amount to the costs incurred by the Agency in supplying the | ||||||
13 | requested prints. | ||||||
14 | Section 50. Gifts to the Illinois State Historical Library. | ||||||
15 | Those programs, collections, and functions heretofore | ||||||
16 | administered by the Illinois State Historical Library or the | ||||||
17 | Historic Preservation Agency's Historical Library Division | ||||||
18 | shall be administered by the Agency. All gifts made | ||||||
19 | specifically to the Illinois State Historical Library shall | ||||||
20 | remain at all times within the Agency. | ||||||
21 | Section 55. Director of the Library; historical | ||||||
22 | collections. The Director of the Library shall make all | ||||||
23 | necessary rules, regulations, and bylaws not inconsistent with | ||||||
24 | law to carry into effect the purpose of this Act and to procure |

2 | number of each of the volumes of the Collections without charge | ||||||
3 | to the University of Illinois Library and to instructors and | ||||||

5 | the State of Illinois. The Director of the Library may also | ||||||
6 | make exchanges of the Historical Collections with any other | ||||||

9 | Section 60. State Historical Library. The rights, powers, | ||||||
10 | and duties vested by law in the State Historical Library or any | ||||||
11 | office, division, or bureau thereof are hereby transferred to | ||||||
12 | the Abraham Lincoln Presidential Library and Museum. | ||||||
13 | Section 65. Separation from the Historic Preservation | ||||||
14 | Agency. On the effective date of this Act, all of the powers, | ||||||
15 | duties, assets, liabilities, employees, contracts, property | ||||||
16 | (real and personal), including any items formerly contained in | ||||||
17 | the Illinois State Historical Library now presently held in the | ||||||
18 | Abraham Lincoln Presidential Library and Museum, records, | ||||||
19 | pending business, and unexpended appropriations of the | ||||||
20 | Historic Preservation Agency related to the administration and | ||||||
21 | enforcement of Sections 17, 32, and 33 of the Historic | ||||||
22 | Preservation Agency Act are transferred to the Agency created | ||||||
23 | under this Act.
The status and rights of the transferred | ||||||
24 | employees, and the rights of the State of Illinois and its |
| |||||||
| |||||||
1 | agencies, under the Personnel Code and applicable collective | ||||||
2 | bargaining agreements or under any pension, retirement, or | ||||||
3 | annuity plan are not affected (except as provided in Sections | ||||||
4 | 14-110 and 18-127 of the Illinois Pension Code) by that | ||||||
5 | transfer or by any other provision of this Act. | ||||||
6 | Section 70. Rulemaking authority. The Agency may adopt | ||||||
7 | rules in contravention of this Act in order to comply with | ||||||
8 | federal laws or regulations that apply to Presidential | ||||||
9 | Libraries administered by the Office of Presidential Libraries | ||||||
10 | under the National Archives and Records Administration, | ||||||
11 | including, but not limited to, 44 U.S.C. 21, 44 U.S.C. 22, and | ||||||
12 | 36 CFR 1270. | ||||||
13 | Section 75. The Historic Preservation Agency Act is amended | ||||||
14 | by changing Sections 2 and 4 as follows:

10 | Sec. 4. The Board shall be responsible for setting and | ||||||
11 | determining
policy for the Agency. Within the Agency, there | ||||||
12 | shall be a Historic Sites and Preservation Division. The Agency | ||||||
13 | shall consist of: (1) an Abraham Lincoln
Presidential Library | ||||||
14 | and Museum and (2) a Historic Sites and Preservation
Division. | ||||||
15 | Except as
otherwise provided in this Act, any reference
in any | ||||||
16 | other Act to the Historic Preservation Agency shall be deemed | ||||||
17 | to be a
reference to the Historic Sites and Preservation | ||||||
18 | Division and any reference to
the Director of
Historic | ||||||
19 | Preservation shall be deemed to be a reference to the Director | ||||||
20 | of
Historic Sites and Preservation, unless the context clearly | ||||||
21 | indicates
otherwise.
| ||||||
22 | The Board shall appoint a chief executive officer of the | ||||||
23 | Agency who shall
be known as the Director of Historic Sites and | ||||||
24 | Preservation. The Director
shall
serve at the pleasure of the | ||||||
25 | Board. The Director shall, subject to
applicable provisions of |
| |||||||
| |||||||
1 | law, execute the powers and discharge the duties
vested in the | ||||||
2 | Historic Sites and Preservation Division of the Agency by law
| ||||||
3 | and implement the
policies set by the Board.
The Director shall | ||||||
4 | manage the Historic Sites and Preservation Division of the
| ||||||
5 | Agency. The Director, with
the concurrence of the Board, shall | ||||||
6 | appoint Division Chiefs and the Deputy
Director of the Historic | ||||||
7 | Sites and Preservation Division of the Agency.
Subject to | ||||||
8 | concurrence by the Board, the Director shall appoint such other
| ||||||
9 | employees of the Historic Sites and Preservation Division of | ||||||
10 | the Agency as
he or she deems
appropriate and shall fix the
| ||||||
11 | compensation of such Division Chiefs, the Deputy Director and | ||||||
12 | other employees.
The Board shall appoint the Illinois State | ||||||
13 | Historian, who shall provide
historical expertise, support, | ||||||
14 | and service to all divisions of the Historic
Preservation | ||||||
15 | Agency. The State Historian is the State's authority on Abraham
| ||||||
16 | Lincoln and the history of Illinois.

18 | Section 80. The Illinois Historic Preservation Act is | ||||||
19 | amended by changing Section 3 as follows:

21 | Sec. 3.
There is recognized and established hereunder the | ||||||
22 | Illinois Historic
Sites Advisory Council, previously | ||||||
23 | established pursuant to Federal regulations,
hereafter called | ||||||
24 | the Council. The Council shall consist of
15 members. Of these, |
| |||||||
| |||||||
1 | there shall be at least 3 historians, at least 3
architectural | ||||||
2 | historians, or architects with a preservation background,
and | ||||||
3 | at least 3 archeologists. The remaining 6 members shall be | ||||||
4 | drawn from
supporting fields and have a preservation interest. | ||||||
5 | Supporting fields shall
include but not be limited to | ||||||
6 | historical geography, law, urban planning,
local government | ||||||
7 | officials, and members of other preservation commissions.
All | ||||||
8 | shall be appointed by the Director of Historic Sites and | ||||||
9 | Preservation,
with the consent of the Board.
| ||||||
10 | The Council Chairperson shall be appointed by the Director | ||||||
11 | of Historic
Sites and Preservation from the Council
membership | ||||||
12 | and shall serve at the Director's pleasure.
| ||||||
13 | The Executive Director of the Abraham Lincoln Presidential | ||||||
14 | Library and Museum and the Director of
the Illinois State | ||||||
15 | Museum shall serve on the Council
in advisory capacity as | ||||||
16 | non-voting members.
| ||||||
17 | Terms of membership shall be 3 years and shall be staggered | ||||||
18 | by the Director
to assure continuity of representation.
| ||||||
19 | The Council shall meet at least 3 times each year. | ||||||

10 | of the game and not after the 10-minute mark of the second half | ||||||
11 | of the game, or by a catering establishment which has rented | ||||||

from a board of trustees of a public community | ||||||
13 | college district, or in a restaurant that is operated by a | ||||||
14 | commercial tenant in the North Campus Parking Deck building | ||||||
15 | that (1) is located at 1201 West University Avenue, Urbana, | ||||||
16 | Illinois and (2) is owned by the Board of Trustees of the | ||||||
17 | University of Illinois, or, if
approved by the District board, | ||||||
18 | on land owned by the Metropolitan Sanitary
District of Greater | ||||||
19 | Chicago and leased to others for a term of at least
20 years. | ||||||
20 | Nothing in this Section precludes the sale or delivery of
| ||||||
21 | alcoholic liquor in the form of original packaged goods in | ||||||
22 | premises located
at 500 S. Racine in Chicago belonging to the | ||||||
23 | University of Illinois and
used primarily as a grocery store by | ||||||
24 | a commercial tenant during the term of
a lease that predates | ||||||
25 | the University's acquisition of the premises; but the
| ||||||
26 | University shall have no power or authority to renew, transfer, |
| |||||||
| |||||||
1 | or extend
the lease with terms allowing the sale of alcoholic | ||||||
2 | liquor; and the sale of
alcoholic liquor shall be subject to | ||||||
3 | all local laws and regulations.
After the acquisition by | ||||||
4 | Winnebago County of the property located at 404
Elm Street in | ||||||
5 | Rockford, a commercial tenant who sold alcoholic liquor at
| ||||||
6 | retail on a portion of the property under a valid license at | ||||||
7 | the time of
the acquisition may continue to do so for so long | ||||||
8 | as the tenant and the
County may agree under existing or future | ||||||
9 | leases, subject to all local laws
and regulations regarding the | ||||||
10 | sale of alcoholic liquor. Alcoholic liquors may be delivered to | ||||||
11 | and sold at Memorial Hall, located at 211 North Main Street, | ||||||
12 | Rockford, under conditions approved by Winnebago County and | ||||||
13 | subject to all local laws and regulations regarding the sale of | ||||||
14 | alcoholic liquor. Each
facility shall provide dram shop | ||||||
15 | liability in maximum insurance coverage
limits so as to save | ||||||
16 | harmless the State, municipality, State university,
airport, | ||||||
17 | golf course, faculty center, facility in which conference and
| ||||||
18 | convention type activities take place, park district, Forest | ||||||
19 | Preserve
District, public community college district, | ||||||
20 | aquarium, museum, or sanitary
district from all financial loss, | ||||||
21 | damage or harm. Alcoholic liquors may be
sold at retail in | ||||||
22 | buildings of golf courses owned by municipalities or Illinois | ||||||
23 | State University in
connection with the operation of an | ||||||
24 | established food serving facility
during times when food is | ||||||
25 | dispensed for consumption upon the premises.
Alcoholic liquors | ||||||
26 | may be delivered to and sold at retail in any building
owned by |
| |||||||
| |||||||
1 | a fire protection district organized under the Fire Protection
| ||||||
2 | District Act, provided that such delivery and sale is approved | ||||||
3 | by the board
of trustees of the district, and provided further | ||||||
4 | that such delivery and
sale is limited to fundraising events | ||||||
5 | and to a maximum of 6 events per year. However, the limitation | ||||||
6 | to fundraising events and to a maximum of 6 events per year | ||||||
7 | does not apply to the delivery, sale, or manufacture of | ||||||
8 | alcoholic liquors at the building located at 59 Main Street in | ||||||
9 | Oswego, Illinois, owned by the Oswego Fire Protection District | ||||||
10 | if the alcoholic liquor is sold or dispensed as approved by the | ||||||
11 | Oswego Fire Protection District and the property is no longer | ||||||
12 | being utilized for fire protection purposes.

13 | Alcoholic liquors may be served or sold in buildings under | ||||||
14 | the control of the Board of Trustees of the University of | ||||||
15 | Illinois for events that the Board may determine are public | ||||||
16 | events and not related student activities. The Board of | ||||||
17 | Trustees shall issue a written policy within 6 months of August | ||||||
18 | 15, 2008 ( the effective date of Public Act 95-847) this | ||||||
19 | amendatory Act of the 95th General Assembly concerning the | ||||||
20 | types of events that would be eligible for an exemption. | ||||||
21 | Thereafter, the Board of Trustees may issue revised, updated, | ||||||
22 | new, or amended policies as it deems necessary and appropriate. | ||||||
23 | In preparing its written policy, the Board of Trustees shall, | ||||||
24 | among other factors it considers relevant and important, give | ||||||
25 | consideration to the following: (i) whether the event is a | ||||||
26 | student activity or student related activity; (ii) whether the |
| |||||||
| |||||||
1 | physical setting of the event is conducive to control of liquor | ||||||
2 | sales and distribution; (iii) the ability of the event operator | ||||||
3 | to ensure that the sale or serving of alcoholic liquors and the | ||||||
4 | demeanor of the participants are in accordance with State law | ||||||
5 | and University policies; (iv) regarding the anticipated | ||||||
6 | attendees at the event, the relative proportion of individuals | ||||||
7 | under the age of 21 to individuals age 21 or older; (v) the | ||||||
8 | ability of the venue operator to prevent the sale or | ||||||
9 | distribution of alcoholic liquors to individuals under the age | ||||||
10 | of 21; (vi) whether the event prohibits participants from | ||||||
11 | removing alcoholic beverages from the venue; and (vii) whether | ||||||
12 | the event prohibits participants from providing their own | ||||||
13 | alcoholic liquors to the venue. In addition, any policy | ||||||
14 | submitted by the Board of Trustees to the Illinois Liquor | ||||||
15 | Control Commission must require that any event at which | ||||||
16 | alcoholic liquors are served or sold in buildings under the | ||||||
17 | control of the Board of Trustees shall require the prior | ||||||
18 | written approval of the Office of the Chancellor for the | ||||||
19 | University campus where the event is located. The Board of | ||||||
20 | Trustees shall submit its policy, and any subsequently revised, | ||||||
21 | updated, new, or amended policies, to the Illinois Liquor | ||||||
22 | Control Commission, and any University event, or location for | ||||||
23 | an event, exempted under such policies shall apply for a | ||||||
24 | license under the applicable Sections of this Act. | ||||||
25 | Alcoholic liquors may be served or sold in buildings under
| ||||||
26 | the control of the Board of Trustees of Northern Illinois |
| |||||||
| |||||||
1 | University
for events that the Board may determine are public
| ||||||
2 | events and not student-related activities. The Board of
| ||||||
3 | Trustees shall issue a written policy within 6 months after | ||||||
4 | June 28, 2011 (the
effective date of Public Act 97-45) | ||||||
5 | concerning the types of events that would be eligible
for an | ||||||
6 | exemption. Thereafter, the Board of Trustees may issue
revised, | ||||||
7 | updated, new, or amended policies as it deems
necessary and | ||||||
8 | appropriate. In preparing its written policy, the

9 | Trustees shall, in addition to other factors it considers
| ||||||
10 | relevant and important, give consideration to the following:

11 | (i) whether the event is a student activity or student-related
| ||||||

13 | conducive to control of liquor sales and distribution; (iii)
| ||||||
14 | the ability of the event operator to ensure that the sale or
| ||||||
15 | serving of alcoholic liquors and the demeanor of the
| ||||||
16 | participants are in accordance with State law and University
| ||||||
17 | policies; (iv) the anticipated attendees at the
event and the | ||||||
18 | relative proportion of individuals under the age of
21 to | ||||||
19 | individuals age 21 or older; (v) the ability of the venue
| ||||||
20 | operator to prevent the sale or distribution of alcoholic
| ||||||
21 | liquors to individuals under the age of 21; (vi) whether the
| ||||||
22 | event prohibits participants from removing alcoholic beverages
| ||||||
23 | from the venue; and (vii) whether the event prohibits
| ||||||
24 | participants from providing their own alcoholic liquors to the
| ||||||

11 | Assembly , then that Board of Trustees shall issue a written | ||||||
12 | policy within 6 months after July 15, 2016 ( the effective date | ||||||
13 | of Public Act 99-550) this amendatory Act of the 99th General | ||||||
14 | Assembly concerning the types of events that would be eligible | ||||||
15 | for an exemption. Thereafter, the Board of Trustees may issue | ||||||
16 | revised, updated, new, or amended policies as it deems | ||||||
17 | necessary and appropriate. In preparing its written policy, the | ||||||
18 | Board of Trustees shall, in addition to other factors it | ||||||
19 | considers relevant and important, give consideration to the | ||||||
20 | following: (i) whether the event is a student activity or | ||||||
21 | student-related activity; (ii) whether the physical setting of | ||||||
22 | the event is conducive to control of liquor sales and | ||||||
23 | distribution; (iii) the ability of the event operator to ensure | ||||||
24 | that the sale or serving of alcoholic liquors and the demeanor | ||||||
25 | of the participants are in accordance with State law and | ||||||
26 | University policies; (iv) the anticipated attendees at the |
| |||||||
| |||||||
1 | event and the relative proportion of individuals under the age | ||||||
2 | of 21 to individuals age 21 or older; (v) the ability of the | ||||||
3 | venue operator to prevent the sale or distribution of alcoholic | ||||||
4 | liquors to individuals under the age of 21; (vi) whether the | ||||||
5 | event prohibits participants from removing alcoholic beverages | ||||||
6 | from the venue; and (vii) whether the event prohibits | ||||||
7 | participants from providing their own alcoholic liquors to the | ||||||
8 | venue. As used in this paragraph, "public university" means the | ||||||
9 | University of Illinois, Illinois State University, Chicago | ||||||
10 | State University, Governors State University, Southern | ||||||
11 | Illinois University, Northern Illinois University, Eastern | ||||||
12 | Illinois University, Western Illinois University, and | ||||||
13 | Northeastern Illinois University. | ||||||
14 | Alcoholic liquors may be served or sold in buildings under | ||||||
15 | the control of the Board of Trustees of a community college | ||||||
16 | district for events that the Board of Trustees of that | ||||||
17 | community college district may determine are public events and | ||||||
18 | not student-related activities. The Board of Trustees shall | ||||||
19 | issue a written policy within 6 months after July 15, 2016 ( the | ||||||
20 | effective date of Public Act 99-550) this amendatory Act of the | ||||||
21 | 99th General Assembly concerning the types of events that would | ||||||
22 | be eligible for an exemption. Thereafter, the Board of Trustees | ||||||
23 | may issue revised, updated, new, or amended policies as it | ||||||
24 | deems necessary and appropriate. In preparing its written | ||||||
25 | policy, the Board of Trustees shall, in addition to other | ||||||
26 | factors it considers relevant and important, give |
| |||||||
| |||||||
1 | consideration to the following: (i) whether the event is a | ||||||
2 | student activity or student-related activity; (ii) whether the | ||||||
3 | physical setting of the event is conducive to control of liquor | ||||||
4 | sales and distribution; (iii) the ability of the event operator | ||||||
5 | to ensure that the sale or serving of alcoholic liquors and the | ||||||
6 | demeanor of the participants are in accordance with State law | ||||||
7 | and community college district policies; (iv) the anticipated | ||||||
8 | attendees at the event and the relative proportion of | ||||||
9 | individuals under the age of 21 to individuals age 21 or older; | ||||||
10 | (v) the ability of the venue operator to prevent the sale or | ||||||
11 | distribution of alcoholic liquors to individuals under the age | ||||||
12 | of 21; (vi) whether the event prohibits participants from | ||||||
13 | removing alcoholic beverages from the venue; and (vii) whether | ||||||
14 | the event prohibits participants from providing their own | ||||||
15 | alcoholic liquors to the venue. This paragraph does not apply | ||||||
16 | to any community college district authorized to sell or serve | ||||||
17 | alcoholic liquor under any other provision of this Section. | ||||||
18 | Alcoholic liquor may be delivered to and sold at retail in | ||||||
19 | the
Dorchester Senior Business Center owned by the Village of | ||||||
20 | Dolton if the
alcoholic liquor is sold or dispensed only in | ||||||
21 | connection with organized
functions for which the planned | ||||||
22 | attendance is 20 or more persons, and if
the person or facility | ||||||
23 | selling or dispensing the alcoholic liquor has
provided dram | ||||||
24 | shop liability insurance in maximum limits so as to hold
| ||||||
25 | harmless the Village of Dolton and the State from all financial | ||||||
26 | loss,
damage and harm.

| |||||||
| |||||||
1 | Alcoholic liquors may be delivered to and sold at retail in | ||||||
2 | any
building used as an Illinois State Armory provided:
| ||||||
3 | (i) the Adjutant General's written consent to the | ||||||
4 | issuance of a
license to sell alcoholic liquor in such | ||||||
5 | building is filed with the
Commission;
| ||||||
6 | (ii) the alcoholic liquor is sold or dispensed only in | ||||||
7 | connection
with organized functions held on special | ||||||
8 | occasions;
| ||||||
9 | (iii) the organized function is one for which the | ||||||
10 | planned attendance
is 25 or more persons; and
| ||||||
11 | (iv) the facility selling or dispensing the alcoholic | ||||||
12 | liquors has
provided dram shop liability insurance in | ||||||
13 | maximum limits so as to save
harmless the facility and the | ||||||
14 | State from all financial loss, damage or harm.
| ||||||
15 | Alcoholic liquors may be delivered to and sold at retail in | ||||||
16 | the Chicago
Civic Center, provided that:
| ||||||
17 | (i) the written consent of the Public Building | ||||||
18 | Commission which
administers the Chicago Civic Center is | ||||||
19 | filed with the Commission;
| ||||||
20 | (ii) the alcoholic liquor is sold or dispensed only in | ||||||
21 | connection with
organized functions held on special | ||||||
22 | occasions;
| ||||||
23 | (iii) the organized function is one for which the | ||||||
24 | planned attendance is
25 or more persons;
| ||||||
25 | (iv) the facility selling or dispensing the alcoholic | ||||||
26 | liquors has
provided dram shop liability insurance in |
| |||||||
| |||||||
1 | maximum limits so as to hold
harmless the Civic Center, the | ||||||
2 | City of Chicago and the State from all
financial loss, | ||||||
3 | damage or harm; and
| ||||||
4 | (v) all applicable local ordinances are complied with.
| ||||||
5 | Alcoholic liquors may be delivered or sold in any building | ||||||
6 | belonging to
or under the control of any city, village or | ||||||
7 | incorporated town where more
than 75% of the physical | ||||||
8 | properties of the building is used for commercial
or | ||||||
9 | recreational purposes, and the building is located upon a pier | ||||||
10 | extending
into or over the waters of a navigable lake or stream | ||||||
11 | or on the shore of a
navigable lake or stream.
In accordance | ||||||
12 | with a license issued under this Act, alcoholic liquor may be | ||||||
13 | sold, served, or delivered in buildings and facilities under
| ||||||
14 | the control
of the Department of Natural Resources during | ||||||
15 | events or activities lasting no more than 7 continuous days | ||||||
16 | upon the written approval of the
Director of
Natural Resources | ||||||
17 | acting as the controlling government authority. The Director
of
| ||||||
18 | Natural Resources may specify conditions on that approval, | ||||||
19 | including but not
limited to
requirements for insurance and | ||||||
20 | hours of operation.
Notwithstanding any other provision of this | ||||||
21 | Act, alcoholic liquor sold by a
United States Army Corps of | ||||||
22 | Engineers or Department of Natural
Resources
concessionaire | ||||||
23 | who was operating on June 1, 1991 for on-premises consumption
| ||||||
24 | only is not subject to the provisions of Articles IV and IX. | ||||||
25 | Beer and wine
may be sold on the premises of the Joliet Park | ||||||
26 | District Stadium owned by
the Joliet Park District when written |
| |||||||
| |||||||
1 | consent to the issuance of a license
to sell beer and wine in | ||||||
2 | such premises is filed with the local liquor
commissioner by | ||||||
3 | the Joliet Park District. Beer and wine may be sold in
| ||||||
4 | buildings on the grounds of State veterans' homes when written | ||||||
5 | consent to
the issuance of a license to sell beer and wine in | ||||||
6 | such buildings is filed
with the Commission by the Department | ||||||
7 | of Veterans' Affairs, and the
facility shall provide dram shop | ||||||
8 | liability in maximum insurance coverage
limits so as to save | ||||||
9 | the facility harmless from all financial loss, damage
or harm. | ||||||
10 | Such liquors may be delivered to and sold at any property owned | ||||||
11 | or
held under lease by a Metropolitan Pier and Exposition | ||||||
12 | Authority or
Metropolitan Exposition and Auditorium Authority.
| ||||||
13 | Beer and wine may be sold and dispensed at professional | ||||||
14 | sporting events
and at professional concerts and other | ||||||
15 | entertainment events conducted on
premises owned by the Forest | ||||||
16 | Preserve District of Kane County, subject to
the control of the | ||||||
17 | District Commissioners and applicable local law,
provided that | ||||||
18 | dram shop liability insurance is provided at maximum coverage
| ||||||
19 | limits so as to hold the District harmless from all financial | ||||||
20 | loss, damage
and harm.
| ||||||
21 | Nothing in this Section shall preclude the sale or delivery | ||||||
22 | of beer and
wine at a State or county fair or the sale or | ||||||
23 | delivery of beer or wine at a
city fair in any otherwise lawful | ||||||
24 | manner.
| ||||||
25 | Alcoholic liquors may be sold at retail in buildings in | ||||||
26 | State parks
under the control of the Department of Natural |
| |||||||
| |||||||
1 | Resources,
provided:
| ||||||
2 | a. the State park has overnight lodging facilities with | ||||||
3 | some
restaurant facilities or, not having overnight | ||||||
4 | lodging facilities, has
restaurant facilities which serve | ||||||
5 | complete luncheon and dinner or
supper meals,
| ||||||
6 | b. (blank), and
| ||||||
7 | c. the alcoholic liquors are sold by the State park | ||||||
8 | lodge or
restaurant concessionaire only during the hours | ||||||
9 | from 11 o'clock a.m. until
12 o'clock midnight. | ||||||
10 | Notwithstanding any other provision of this Act,
alcoholic | ||||||
11 | liquor sold by the State park or restaurant concessionaire | ||||||
12 | is not
subject to the provisions of Articles IV and IX.

13 | Alcoholic liquors may be sold at retail in buildings on | ||||||
14 | properties
under the control of the Historic Sites and | ||||||
15 | Preservation Division of the
Historic Preservation
Agency or | ||||||
16 | the Abraham Lincoln Presidential Library and Museum provided:
| ||||||
17 | a. the property has overnight lodging facilities with | ||||||
18 | some restaurant
facilities or, not having overnight | ||||||
19 | lodging facilities, has restaurant
facilities which serve | ||||||

| ||||||

the buildings has been filed with the | ||||||
23 | commission by the Historic Sites and
Preservation Division

Preservation Agency or the Abraham Lincoln | ||||||
25 | Presidential Library and Museum,
and
| ||||||
26 | c. the alcoholic liquors are sold by the lodge or |
| |||||||
| |||||||
1 | restaurant
concessionaire only during the hours from 11 | ||||||
2 | o'clock a.m. until 12 o'clock
midnight.
| ||||||
3 | The sale of alcoholic liquors pursuant to this Section does | ||||||
4 | not
authorize the establishment and operation of facilities | ||||||
5 | commonly called
taverns, saloons, bars, cocktail lounges, and | ||||||
6 | the like except as a part
of lodge and restaurant facilities in | ||||||
7 | State parks or golf courses owned
by Forest Preserve Districts | ||||||
8 | with a population of less than 3,000,000 or
municipalities or | ||||||
9 | park districts.
| ||||||
10 | Alcoholic liquors may be sold at retail in the Springfield
| ||||||
11 | Administration Building of the Department of Transportation | ||||||
12 | and the
Illinois State Armory in Springfield; provided, that | ||||||
13 | the controlling
government authority may consent to such sales | ||||||
14 | only if
| ||||||
15 | a. the request is from a not-for-profit organization;
| ||||||
16 | b. such sales would not impede normal operations of the | ||||||
17 | departments
involved;
| ||||||
18 | c. the not-for-profit organization provides dram shop | ||||||
19 | liability in
maximum insurance coverage limits and agrees | ||||||
20 | to defend, save harmless
and indemnify the State of | ||||||
21 | Illinois from all financial loss, damage or harm;
| ||||||
22 | d. no such sale shall be made during normal working | ||||||
23 | hours of the
State of Illinois; and
| ||||||
24 | e. the consent is in writing.
| ||||||
25 | Alcoholic liquors may be sold at retail in buildings in | ||||||
26 | recreational
areas of river conservancy districts under the |
| |||||||
| |||||||
1 | control of, or leased
from, the river conservancy districts. | ||||||
2 | Such sales are subject to
reasonable local regulations as | ||||||
3 | provided in Article IV; however, no such
regulations may | ||||||
4 | prohibit or substantially impair the sale of alcoholic
liquors | ||||||
5 | on Sundays or Holidays.
| ||||||
6 | Alcoholic liquors may be provided in long term care | ||||||
7 | facilities owned or
operated by a county under Division 5-21 or | ||||||
8 | 5-22 of the Counties Code,
when approved by the facility | ||||||
9 | operator and not in conflict
with the regulations of the | ||||||
10 | Illinois Department of Public Health, to
residents of the | ||||||
11 | facility who have had their consumption of the alcoholic
| ||||||
12 | liquors provided approved in writing by a physician licensed to | ||||||
13 | practice
medicine in all its branches.
| ||||||
14 | Alcoholic liquors may be delivered to and dispensed in | ||||||
15 | State housing
assigned to employees of the Department of | ||||||
16 | Corrections.
No person shall furnish or allow to be furnished | ||||||
17 | any alcoholic
liquors to any prisoner confined in any jail, | ||||||
18 | reformatory, prison or house
of correction except upon a | ||||||
19 | physician's prescription for medicinal purposes.

20 | Alcoholic liquors may be sold at retail or dispensed at the | ||||||
21 | Willard Ice
Building in Springfield, at the State Library in | ||||||
22 | Springfield, and at
Illinois State Museum facilities by (1) an
| ||||||
23 | agency of the State, whether legislative, judicial or | ||||||
24 | executive, provided
that such agency first obtains written | ||||||
25 | permission to sell or dispense
alcoholic liquors from the | ||||||
26 | controlling government authority, or by (2) a
not-for-profit |
| |||||||
| |||||||
1 | organization, provided that such organization:
| ||||||
2 | a. Obtains written consent from the controlling | ||||||
3 | government authority;
| ||||||
4 | b. Sells or dispenses the alcoholic liquors in a manner | ||||||
5 | that does not
impair normal operations of State offices | ||||||
6 | located in the building;
| ||||||
7 | c. Sells or dispenses alcoholic liquors only in | ||||||
8 | connection with an
official activity in the building;
| ||||||

19 | The controlling government authority for the Willard Ice | ||||||
20 | Building in
Springfield shall be the Director of the Department | ||||||
21 | of Revenue. The
controlling government authority for Illinois | ||||||
22 | State Museum facilities shall
be the Director of the Illinois | ||||||
23 | State Museum. The controlling government
authority for the | ||||||
24 | State Library in Springfield shall be the Secretary of State.
| ||||||
25 | Alcoholic liquors may be delivered to and sold at retail or | ||||||
26 | dispensed
at any facility, property or building under the |
| |||||||

1 | jurisdiction of the
Historic Sites and Preservation Division of | ||||||
2 | the
Historic Preservation Agency
or the Abraham

consumption at the Michael Bilandic Building at | ||||||
7 | 160 North LaSalle Street,
Chicago IL 60601, after the normal | ||||||
8 | business hours of any day care or child care
facility located | ||||||
9 | in the building, by (1) a commercial tenant or subtenant
| ||||||
10 | conducting business on the premises under a lease made pursuant | ||||||
11 | to Section
405-315 of the Department of Central Management | ||||||
12 | Services Law (20 ILCS
405/405-315), provided that such tenant | ||||||
13 | or subtenant who accepts delivery of,
sells, or dispenses | ||||||
14 | alcoholic liquors shall procure and maintain dram shop
| ||||||
15 | liability insurance in maximum coverage limits and in which the | ||||||
16 | carrier
agrees to defend, indemnify, and save harmless the | ||||||
17 | State of Illinois from
all financial loss, damage, or harm | ||||||
18 | arising out of the delivery, sale, or
dispensing of alcoholic | ||||||
19 | liquors, or by (2) an agency of the State, whether
legislative, | ||||||
20 | judicial, or executive, provided that such agency first obtains
| ||||||
21 | written permission to accept delivery of and sell or dispense | ||||||
22 | alcoholic liquors
from the Director of Central Management | ||||||
23 | Services, or by (3) a not-for-profit
organization, provided | ||||||
24 | that such organization:
| ||||||
25 | a. obtains written consent from the Department of | ||||||
26 | Central Management
Services;

| |||||||
| |||||||
1 | b. accepts delivery of and sells or dispenses the | ||||||
2 | alcoholic liquors in a
manner that does not impair normal | ||||||

building;

connection with an official activity in the | ||||||

insurance in maximum coverage limits and in | ||||||
9 | which the carrier agrees to
defend, save harmless, and | ||||||
10 | indemnify the State of Illinois from all
financial loss, | ||||||
11 | damage, or harm arising out of the selling or dispensing of
| ||||||
12 | alcoholic liquors.
| ||||||
13 | Nothing in this Act shall prevent a not-for-profit | ||||||
14 | organization or agency
of the State from employing the services | ||||||
15 | of a catering establishment for
the selling or dispensing of | ||||||
16 | alcoholic liquors at functions authorized by
the Director of | ||||||
17 | Central Management Services.

18 | Alcoholic liquors may be sold at retail or dispensed at the | ||||||
19 | James R.
Thompson Center in Chicago, subject to the provisions | ||||||
20 | of Section 7.4 of the
State Property Control Act, and 222 South | ||||||
21 | College Street in Springfield,
Illinois by (1) a commercial | ||||||
22 | tenant or subtenant conducting business on the
premises under a | ||||||
23 | lease or sublease made pursuant to Section 405-315 of the
| ||||||
24 | Department of Central Management Services Law (20 ILCS | ||||||
25 | 405/405-315), provided
that such tenant or subtenant who
sells | ||||||
26 | or dispenses alcoholic liquors shall procure and maintain dram |
| |||||||
| |||||||

amounts as the Authority | ||||||
6 | reasonably determines is necessary.

1 | Nothing in this Act shall prevent a not-for-profit | ||||||
2 | organization or agency
of the State from employing the services | ||||||
3 | of a catering establishment for
the selling or dispensing of | ||||||
4 | alcoholic liquors at functions authorized by
the Department of | ||||||
5 | Central Management Services.
| ||||||
6 | Alcoholic liquors may be sold or delivered in a building | ||||||
7 | that is owned
by McLean County, situated on land owned by the | ||||||
8 | county in the City of
Bloomington, and used by the McLean | ||||||
9 | County Historical Society if the sale
or delivery is approved | ||||||
10 | by an ordinance adopted by the county board, and
the | ||||||
11 | municipality in which the building is located may not prohibit | ||||||
12 | that
sale or delivery, notwithstanding any other provision of | ||||||
13 | this Section. The
regulation of the sale and delivery of | ||||||
14 | alcoholic liquor in a building that
is owned by McLean County, | ||||||
15 | situated on land owned by the county, and used
by the McLean | ||||||
16 | County Historical Society as provided in this paragraph is an
| ||||||
17 | exclusive power and function of the State and is a denial and | ||||||
18 | limitation
under Article VII, Section 6, subsection (h) of the | ||||||
19 | Illinois Constitution
of the power of a home rule municipality | ||||||
20 | to regulate that sale and delivery.
| ||||||
21 | Alcoholic liquors may be sold or delivered in any building | ||||||
22 | situated on
land held in trust for any school district | ||||||
23 | organized under Article 34 of
the School Code, if the building | ||||||
24 | is not used for school purposes and if the
sale or delivery is | ||||||
25 | approved by the board of education.
| ||||||
26 | Alcoholic liquors may be delivered to and sold at retail in |
| |||||||
| |||||||
1 | any building owned by a public library district, provided that | ||||||
2 | the delivery and sale is approved by the board of trustees of | ||||||
3 | that public library district and is limited to library | ||||||
4 | fundraising events or programs of a cultural or educational | ||||||
5 | nature. Before the board of trustees of a public library | ||||||
6 | district may approve the delivery and sale of alcoholic | ||||||
7 | liquors, the board of trustees of the public library district | ||||||
8 | must have a written policy that has been approved by the board | ||||||
9 | of trustees of the public library district governing when and | ||||||
10 | under what circumstances alcoholic liquors may be delivered to | ||||||
11 | and sold at retail on property owned by that public library | ||||||
12 | district. The written policy must (i) provide that no alcoholic | ||||||
13 | liquor may be sold, distributed, or consumed in any area of the | ||||||
14 | library accessible to the general public during the event or | ||||||
15 | program, (ii) prohibit the removal of alcoholic liquor from the | ||||||
16 | venue during the event, and (iii) require that steps be taken | ||||||
17 | to prevent the sale or distribution of alcoholic liquor to | ||||||
18 | persons under the age of 21. Any public library district that | ||||||
19 | has alcoholic liquor delivered to or sold at retail on property | ||||||
20 | owned by the public library district shall provide dram shop | ||||||
21 | liability insurance in maximum insurance coverage limits so as | ||||||
22 | to save harmless the public library districts from all | ||||||
23 | financial loss, damage, or harm. | ||||||
24 | Alcoholic liquors may be sold or delivered in buildings | ||||||
25 | owned
by the Community Building Complex Committee of Boone | ||||||
26 | County,
Illinois if the person or facility selling or |

1 | dispensing the
alcoholic liquor has provided dram shop | ||||||
2 | liability insurance with coverage and
in amounts that the | ||||||
3 | Committee reasonably determines are necessary.
| ||||||
4 | Alcoholic liquors may be sold or delivered in the building | ||||||
5 | located at
1200 Centerville Avenue in Belleville, Illinois and | ||||||
6 | occupied by either the
Belleville Area Special Education | ||||||
7 | District or the Belleville Area Special
Services
Cooperative. | ||||||
8 | Alcoholic liquors may be delivered to and sold at the Louis | ||||||
9 | Joliet
Renaissance Center, City Center Campus, located at 214 | ||||||
10 | N. Ottawa Street,
Joliet, and
the Food Services/Culinary Arts | ||||||
11 | Department facilities, Main Campus, located at
