4 | | "Section 5. The Election Code is amended by changing |
5 | | Section 12-5 and by adding Section 28-8.2 as follows:

7 | | Sec. 12-5. Notice for public questions. For all elections |
8 | | held after July
1, 1999, notice of public
questions shall be |
9 | | required only as set forth in this
Section and Section 28-8.2 |
10 | | of this Code or as set forth in Section 17-3 or 19-3 of the |
11 | | School Code. Not
more than 60
30 days nor less than 40 10 days |
12 | | before the date of a
regular election at which a public |
13 | | question is to be submitted to the voters of
a political or |
14 | | governmental subdivision, and at least 20 days before an

15 | | emergency referendum, the election authority shall publish |
16 | | notice of the
referendum. The notice shall be published once in |

having general circulation in the |
2 | | political or governmental subdivision. The
notice shall also be |
3 | | given at least 10 days before the date of the election by

4 | | posting a copy of the notice at the principal office of the |
5 | | election
authority. The local election official shall also post |
6 | | a copy of the notice at
the principal office of the political |
7 | | or governmental
subdivision, or if there is no principal office |
8 | | at the building in which the
governing body of the political or |
9 | | governmental subdivision held its first
meeting of the calendar |
10 | | year in which the referendum is being held. The
election |
11 | | authority and the political or governmental subdivision may, |
12 | | but are
not required to, post the notice electronically on |
13 | | their World Wide Web pages.
The notice, which shall appear over |
14 | | the name or title of the election
authority, shall be |
15 | | substantially in the following form:

16 | | NOTICE IS HEREBY GIVEN that at the election to be held |
17 | | on
(insert day of the week),
(insert date of election), the |
18 | | following proposition will be
submitted to the voters of |
19 | | (name of political or governmental subdivision):

20 | | (insert the public question as it will appear on the |
21 | | ballot)
|
22 | | The polls at the election will be open at 6:00 o'clock |
23 | | A.M. and will
continue to be open until 7:00 o'clock P.M. |

1 | | The notice shall also include any additional information |
2 | | required by the statute authorizing the public question and |
3 | | Section 28-8.2 of this Code . The notice may include an |
4 | | explanation, in neutral and plain language, of the question and |
5 | | its purposes supplied by the governing body of the political or |
6 | | governmental subdivision to whose voters the question is to be |
7 | | submitted. The notice shall set forth the
precincts and polling |
8 | | places at which the referendum will be conducted only in
the |
9 | | case of emergency referenda.

12 | | Sec. 28-8.2. Revenue referenda disclosure. |
13 | | (a) For purposes of this Section, "revenue referenda" means |
14 | | referenda by a unit of local government, including a school |
15 | | district, seeking to impose or increase a retailers' occupation |
16 | | tax, a use tax, a service occupation tax, a service use tax, or |
17 | | a property tax, or regarding the issuance of bonds. |
18 | | (b) Revenue referenda shall contain the following |
19 | | information: |
20 | | (1) the amount of the new or increased tax or bond; |
21 | | (2) the amount that this proposed imposition or |
22 | | increase will impact the unit of local government's current |
23 | | taxes or bonds; |
24 | | (3) if a bond, the projected life of the bond and the |
25 | | estimated amounts of principal, interest, and total debt |

1 | | service; and |
2 | | (4) an example of the impact the new property tax or |
3 | | bond is estimated to have on a family owning a residence |
4 | | worth $100,000, both before and after the issuance of the |
5 | | property tax or bond. |
6 | | (c) In addition to other notice and publication |
7 | | requirements as may be otherwise required by law, the unit of |
8 | | local government proposing revenue referenda shall publish the |
9 | | referenda questions, along with the required disclosures under |
10 | | subsection (b) of this Section, no more than 60 days nor less |
11 | | than 40 days prior to the referenda appearing on the ballot in |
12 | | a newspaper of general circulation published in the unit of |
13 | | local government or school district and on the unit of local |
14 | | government's or school district's website and community |
15 | | newsletter, if they have one. |
16 | | Section 99. Effective date. This Act takes effect upon |
17 | | becoming law.".
