1 | AN ACT concerning State government.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 1. Findings. Identity theft is a major concern for | ||||||
5 | the State of Illinois and its employees in both the receipt and | ||||||
6 | management of personal funds. Easy access to salary information | ||||||
7 | by identity thieves makes it easier for them to open new lines | ||||||
8 | of credit in their victims' names. Preventing reporting of the | ||||||
9 | exact amount of State employee salaries preserves employee | ||||||
10 | privacy by lessening the ease with which identity thieves | ||||||
11 | obtain information and helps protect State employees from | ||||||
12 | identity theft. | ||||||
13 | Section 5. The State Comptroller Act is amended by changing | ||||||
14 | Sections 20 and 27 as follows:

16 | Sec. 20. Annual report. The Comptroller shall annually, as | ||||||
17 | soon as possible after the close
of the fiscal year but no | ||||||
18 | later than December 31, make out and present
to the Governor, | ||||||
19 | the President of the Senate, the Speaker of the House
of | ||||||
20 | Representatives, the Minority Leader of the Senate, and the | ||||||
21 | Minority
Leader of the House of Representatives a report, | ||||||
22 | showing the amount of
warrants drawn on the treasury, on other |

1 | funds held by the State
Treasurer and on any public funds held | ||||||
2 | by State agencies, during the
preceding fiscal year, and | ||||||
3 | stating, particularly, on what account they
were drawn, and if | ||||||
4 | drawn on the contingent fund, to whom and for what
they were | ||||||
5 | issued. He or she shall, also, at the same time, report to the
| ||||||
6 | Governor, the President of the Senate, the Speaker of the House | ||||||
7 | of
Representatives, the Minority Leader of the Senate, and the | ||||||
8 | Minority
Leader of the House of Representatives the amount of | ||||||
9 | money received into
the treasury, into other funds held by the | ||||||
10 | State Treasurer and into any
other funds held by State agencies | ||||||
11 | during the preceding fiscal year, and
stating particularly, the | ||||||
12 | source from which the same may be derived, and
also a general | ||||||
13 | account of all the business of his office during the
preceding | ||||||
14 | fiscal year. The report shall also summarize for the previous
| ||||||
15 | fiscal year the information required under Section 19.
| ||||||
16 | Within 60 days after the expiration of each calendar year, | ||||||
17 | the Comptroller
shall compile, from records maintained and | ||||||
18 | available in his
office, a list of all persons including those | ||||||
19 | employed in the Office of the Comptroller, who have been | ||||||
20 | employed by the State during the past
calendar year and paid | ||||||
21 | from funds in the hands of the State Treasurer.

22 | The list shall be arranged according to counties and shall | ||||||
23 | state in
alphabetical order the name of each employee, the | ||||||
24 | address in the county
in which he votes, except as specified | ||||||
25 | below, the position and the
total salary paid to him or her | ||||||
26 | during
the past calendar year , rounded to the nearest hundred |

1 | dollar . For persons employed by the Department of
Corrections, | ||||||
2 | Department of Children and Family Services, Department of | ||||||
3 | Juvenile Justice, Office of the State's Attorneys Appellate | ||||||
4 | Prosecutor, and the Department
of State Police, as well as | ||||||
5 | their spouses, no address shall be listed. The list so compiled | ||||||
6 | and
arranged shall be kept
on file in the office of the | ||||||
7 | Comptroller and be open to inspection by
the public at all | ||||||
8 | times.

9 | No person who utilizes the names obtained from this list | ||||||
10 | for solicitation
shall represent that such solicitation is | ||||||
11 | authorized by any officer or agency
of the State of Illinois. | ||||||
12 | Violation of this provision is a Business Offense
punishable by | ||||||
13 | a fine not to exceed $3,000.

16 | Sec. 27. Comptroller's online ledger. The Comptroller | ||||||
17 | shall establish and maintain an online repository of the | ||||||
18 | State's financial transactions, to be known as the | ||||||
19 | Comptroller's "Online Ledger". The Comptroller shall establish | ||||||
20 | rules and regulations pertaining to the establishment and | ||||||
21 | maintenance of the "Online Ledger". Any listing of an | ||||||
22 | immediately preceding year's amount of State employee salaries | ||||||
23 | on the "Online Ledger" shall list the total amount paid to a | ||||||
24 | State employee during that past calendar year, or a monthly | ||||||
25 | reporting of a State employee's salary from that past calendar |

1 | year, as rounded to the nearest hundred dollar. Any monthly | ||||||
2 | reporting of a State employee's salary for the current year | ||||||
3 | shall also be listed as rounded to the nearest hundred dollar. | ||||||
4 | The Comptroller, in his or her discretion, may list the | ||||||
5 | unadjusted total salary amount paid to a State employee for any | ||||||
6 | previous year other than the rounded salary amount for the | ||||||
7 | immediately preceding calendar year.
