2 | AMENDMENT NO. ______. Amend House Bill 2402 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The Illinois Vehicle Code is amended by | ||||||
5 | changing Sections 11-1421 and 12-602 as follows:
| ||||||
6 | (625 ILCS 5/11-1421) (from Ch. 95 1/2, par. 11-1421)
| ||||||
7 | Sec. 11-1421. Conditions for operating ambulances and | ||||||
8 | rescue vehicles.
| ||||||
9 | (a) No person shall operate an ambulance or rescue vehicle
| ||||||
10 | in a manner not conforming to the motor vehicle laws
and | ||||||
11 | regulations of this State or of any political subdivision of | ||||||
12 | this State
as such laws and regulations apply to motor vehicles | ||||||
13 | in
general, unless in compliance with the following conditions:
| ||||||
14 | 1. The person operating the ambulance shall be either | ||||||
15 | responding to a
bona fide emergency call or specifically | ||||||
16 | directed by a licensed physician
to disregard traffic laws |

| |||||||
1 | in operating the ambulance during and for the
purpose of | ||||||
2 | the specific trip or journey that is involved;
| ||||||
3 | 2. The ambulance or rescue vehicle shall be equipped | ||||||
4 | with a siren
producing
an audible signal of an intensity of | ||||||
5 | at least 100 decibels , but not to exceed 101 decibels at a | ||||||
6 | distance of 50 feet
from the siren, or at an audible signal | ||||||
7 | that is otherwise consistent with the National Fire | ||||||
8 | Protection Association's standards on audible siren signal | ||||||
9 | intensity, and with a lamp or lamps emitting an | ||||||
10 | oscillating, rotating
or flashing red beam directed in part | ||||||
11 | toward the front of the vehicle, and
these lamps shall have | ||||||
12 | sufficient intensity to be visible at 500 feet in
normal | ||||||
13 | sunlight, and in addition to other lighting requirements, | ||||||
14 | excluding
those vehicles operated in counties with a | ||||||
15 | population in excess of 2,000,000,
may also operate with a | ||||||
16 | lamp or lamps emitting an oscillating, rotating, or
| ||||||
17 | flashing
green light;
| ||||||
18 | 3. The aforesaid siren and lamp or lamps shall be in | ||||||
19 | operation at all
times when it is reasonably necessary to | ||||||
20 | warn pedestrians and other drivers
of the approach thereof | ||||||
21 | during such trip or journey;
| ||||||
22 | 4. Whenever the ambulance or rescue vehicle is operated | ||||||
23 | at a speed in
excess of 40 miles per hour, the ambulance or | ||||||
24 | rescue vehicle shall be operated
in complete conformance | ||||||
25 | with every other motor vehicle law and regulation
of this | ||||||
26 | State and of the political subdivision in which the |

| |||||||
1 | ambulance or
rescue vehicle is operated, relating to the | ||||||
2 | operation of motor vehicles,
as such provision applies to | ||||||
3 | motor vehicles in
general, except laws and regulations | ||||||
4 | pertaining to compliance with official
traffic-control | ||||||
5 | devices or to vehicular operation upon the right half of
| ||||||
6 | the roadway; and
| ||||||
7 | 5. The ambulance shall display registration plates | ||||||
8 | identifying the vehicle
as an ambulance.
| ||||||
9 | (b) The foregoing provisions do not relieve the driver of | ||||||
10 | an ambulance
or rescue vehicle from the duty of driving with | ||||||
11 | due regard for the safety
of all persons, nor do such | ||||||
12 | provisions protect the driver from the consequences
resulting | ||||||
13 | from the reckless disregard for the safety of others.

| ||||||
16 | Sec. 12-602. Mufflers, prevention of noise.
| ||||||
17 | (a) Every motor vehicle driven or operated upon the | ||||||
18 | highways of this State
shall at all times be equipped with an | ||||||
19 | adequate muffler or exhaust system
in constant operation and | ||||||
20 | properly maintained to prevent any excessive or
unusual noise. | ||||||
21 | No such muffler or exhaust system shall be equipped with a
| ||||||
22 | cutout, bypass or similar device. No person shall modify the | ||||||
23 | exhaust system
of a motor vehicle in a manner which will | ||||||
24 | amplify or increase the noise of
such vehicle above that | ||||||
25 | emitted by the muffler originally installed on the
vehicle, and |

| |||||||
1 | such original muffler shall comply with all the requirements
of | ||||||
2 | this Section.
| ||||||
3 | (b) No person shall drive or operate a motor vehicle of the | ||||||
4 | first division that is not a motorcycle or a motor vehicle of | ||||||
5 | the second division weighing no more than 10,000 pounds with a | ||||||
6 | noise level intensity at a distance of 50 feet from the | ||||||
7 | centerline of the lane of travel that exceeds: | ||||||
8 | (1) 76 decibels on a highway with a speed limit of 35 | ||||||
9 | miles per hour or less; | ||||||
10 | (2) 78 decibels when driving or operating the motor | ||||||
11 | vehicle on a grade exceeding 3% on a highway with a speed | ||||||
12 | limit of 35 miles per hour or less; or | ||||||
13 | (3) 82 decibels on a highway with a speed limit of more | ||||||
14 | than 35 miles per hour. | ||||||
15 | (c) No person shall drive or operate a motorcycle with a | ||||||
16 | noise level intensity at a distance of 50 feet from the | ||||||
17 | centerline of the lane of travel that exceeds: | ||||||
18 | (1) 82 decibels on a highway with a speed limit of 35 | ||||||
19 | miles per hour or less; | ||||||
20 | (2) 84 decibels when driving or operating a motorcycle | ||||||
21 | on a grade exceeding 3% on a highway with a speed limit of | ||||||
22 | 35 miles per hour or less; or | ||||||
23 | (3) 86 decibels on a highway with a speed limit of more | ||||||
24 | than 35 miles per hour. | ||||||
25 | (d) Except as otherwise provided in this Section, no person | ||||||
26 | shall drive or operate a motor vehicle with a noise level |

| |||||||
1 | intensity at a distance of 50 feet from the centerline of the | ||||||
2 | lane of travel that exceeds: | ||||||
3 | (1) 86 decibels on a highway with a speed limit of 35 | ||||||
4 | miles per hour or less; | ||||||
5 | (2) 88 decibels when driving or operating the motor | ||||||
6 | vehicle on a grade exceeding 3% on a highway with a speed | ||||||
7 | limit of 35 miles per hour or less; or | ||||||
8 | (3) 90 decibels on a highway with a speed limit of more | ||||||
9 | than 35 miles per hour. | ||||||
10 | (e) A violation of subsections (b), (c), or (d) of this | ||||||
11 | Section shall be punishable by a maximum fine of $75 for a | ||||||
12 | first offense, a maximum fine of $150 for a second offense, and | ||||||
13 | impoundment of the motor vehicle or motorcycle for a third or | ||||||
14 | subsequent offense. | ||||||

16 | Section 99. Effective date. This Act takes effect upon | ||||||
17 | becoming law.".
