SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/3-634

    Amends the Illinois Vehicle Code. Provides that in addition to other purposes, moneys in the Illinois Fire Fighters' Memorial Fund shall be used to provide scholarships for graduate study, undergraduate study, or any other post-secondary education approved by the Illinois Firefighter Memorial Foundation (rather than only graduate study or undergraduate study) to children and spouses of fire fighters killed in the line of duty. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 3-634 as follows:
 
6    (625 ILCS 5/3-634)
7    Sec. 3-634. Illinois Fire Fighters' License Plate.
8    (a) The Secretary, upon receipt of an application made in
9the form prescribed by the Secretary of State, may issue
10special registration plates designated to be Illinois Fire
11Fighters' Memorial license plates. The special plates issued
12under this Section shall be affixed only to passenger vehicles
13of the first division, motorcycles having an engine over 150cc,
14motor vehicles of the second division weighing not more than
158,000 pounds, or recreational vehicles as defined in Section
161-169 of this Code, and subject to the staggered registration
17system. Plates issued under this Section shall expire according
18to the multi-year procedure established by Section 3-414.1 of
19this Code.
20    (b) The design and color of the plates shall be wholly
21within the discretion of the Secretary of State. The Secretary
22of State may, in his or her discretion, allow the plates to be
23issued as vanity plates or personalized in accordance with

1Section 3-405.1 of this Code. The plates are not required to
2designate "Land of Lincoln", as prescribed in subsection (b) of
3Section 3-412 of this Code. The Secretary of State shall
4prescribe stickers or decals as provided under Section 3-412.
5    (c) An applicant shall be charged a $27 fee for original
6issuance in addition to the applicable registration fee. Of
7this additional fee, $15 shall be deposited into the Secretary
8of State Special License Plate Fund and $12 shall be deposited
9into the Illinois Fire Fighters' Memorial Fund. For each
10registration renewal period, a $17 fee, in addition to the
11appropriate registration fee, shall be charged. Of this fee, $2
12shall be deposited into the Secretary of State Special License
13Plate Fund and $15 shall be deposited into the Illinois Fire
14Fighters' Memorial Fund.
15    (d) In addition to the purpose specified in Section
162-119(n), moneys in the Illinois Fire Fighters' Memorial Fund
17shall, except as otherwise provided in subsection (e) and
18subject to appropriation by the General Assembly and
19distribution by the Secretary, be used exclusively for the
20following purposes:
21        (1) maintaining the Illinois Fire Fighters' Memorial;
22        (2) holding an annual memorial commemoration and Medal
23    of Honor ceremony and related activities; and
24        (3) providing scholarships, for graduate study,
25    undergraduate study, or any other post-secondary education
26    approved by the Illinois Firefighter Memorial Foundation

1    both, to children and spouses of fire fighters killed in
2    the line of duty.
3    (e) No more than 10% of the annual proceeds of the Illinois
4Fire Fighters' Memorial Fund may, subject to appropriation by
5the General Assembly and distribution by the Secretary, be used
6for exhibits for and the maintenance of the Illinois Fire
7Fighter Museum, except that the 10% limit may be exceeded to
8pay for emergency repairs related to the structural stability
9of the Illinois Fire Fighter Museum. Prior to exceeding the 10%
10limit, the Office of the State Fire Marshal shall obtain the
11approval of a majority of the members of the Illinois Fire
12Fighters Memorial Foundation.

14    Section 99. Effective date. This Act takes effect upon
15becoming law.
