| 1 | AN ACT concerning transportation.
| ||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The Illinois Vehicle Code is amended by changing | ||||||
| 5 | Section 3-634 as follows:
| ||||||
| 6 | (625 ILCS 5/3-634)
| ||||||
| 7 | Sec. 3-634. Illinois Fire Fighters' License Plate.
| ||||||
| 8 | (a) The Secretary, upon receipt of an application made in | ||||||
| 9 | the form
prescribed by the Secretary of State, may issue | ||||||
| 10 | special registration plates
designated to be Illinois Fire | ||||||
| 11 | Fighters' Memorial license plates. The special
plates issued | ||||||
| 12 | under
this Section shall be affixed only to passenger vehicles | ||||||
| 13 | of the first division, motorcycles having an engine over 150cc,
| ||||||
| 14 | motor vehicles of the second
division weighing not more than | ||||||
| 15 | 8,000 pounds, or
recreational vehicles as defined in Section | ||||||
| 16 | 1-169 of this Code,
and subject to the
staggered registration | ||||||
| 17 | system. Plates issued under this Section shall
expire according | ||||||
| 18 | to the multi-year
procedure established by Section 3-414.1 of | ||||||
| 19 | this Code.
| ||||||
| 20 | (b) The design and color of the plates shall be wholly | ||||||
| 21 | within the discretion
of the Secretary of State. The Secretary | ||||||
| 22 | of State may, in his or her
discretion, allow the plates to be | ||||||
| 23 | issued as vanity plates or personalized in
accordance with | ||||||

| |||||||
| 1 | Section 3-405.1 of this Code. The plates are not required to
| ||||||
| 2 | designate "Land of Lincoln", as prescribed in subsection (b) of | ||||||
| 3 | Section 3-412
of this Code. The Secretary of State shall | ||||||
| 4 | prescribe stickers or decals as
provided under Section 3-412.
| ||||||
| 5 | (c) An applicant shall be charged a $27 fee for original | ||||||
| 6 | issuance in
addition to the applicable registration fee. Of
| ||||||
| 7 | this additional fee, $15 shall be deposited into the Secretary | ||||||
| 8 | of State
Special License Plate Fund and $12 shall be
deposited | ||||||
| 9 | into the Illinois Fire Fighters' Memorial Fund.
For each | ||||||
| 10 | registration renewal period, a $17 fee, in addition to the
| ||||||
| 11 | appropriate registration fee, shall be charged.
Of this fee, $2 | ||||||
| 12 | shall be deposited into the Secretary of State Special License
| ||||||
| 13 | Plate Fund and $15 shall be deposited into
the Illinois Fire | ||||||
| 14 | Fighters' Memorial Fund.
| ||||||
| 15 | (d) In addition to the purpose specified in Section | ||||||
| 16 | 2-119(n), moneys in
the Illinois Fire Fighters' Memorial Fund | ||||||
| 17 | shall, except as otherwise provided in subsection (e) and | ||||||
| 18 | subject to appropriation by
the General Assembly and | ||||||
| 19 | distribution by the Secretary, be used exclusively by the | ||||||
| 20 | Office of the State Fire Marshal for the following purposes: | ||||||
| 21 | (1) maintaining
the Illinois Fire Fighters' Memorial;
| ||||||
| 22 | (2) holding an annual memorial
commemoration and Medal | ||||||
| 23 | of Honor ceremony and related activities; and | ||||||
| 24 | (3) providing scholarships, for graduate study, | ||||||
| 25 | undergraduate study, or any other post-secondary education | ||||||
| 26 | approved by the Illinois Firefighter Memorial Foundation | ||||||

| |||||||
| 1 | both, to children and spouses of fire fighters
killed in | ||||||
| 2 | the line of duty. | ||||||
| 3 | (e) No more than 10% of the annual proceeds of the Illinois | ||||||
| 4 | Fire Fighters' Memorial Fund may, subject to appropriation by | ||||||
| 5 | the General Assembly and distribution by the Secretary, be used | ||||||
| 6 | by the Office of the State Fire Marshal for exhibits for and | ||||||
| 7 | the maintenance of the Illinois Fire Fighter Museum, except | ||||||
| 8 | that the 10% limit may be exceeded to pay for emergency repairs | ||||||
| 9 | related to the structural stability of the Illinois Fire | ||||||
| 10 | Fighter Museum. Prior to exceeding the 10% limit, the Office of | ||||||
| 11 | the State Fire Marshal shall obtain the approval of a majority | ||||||
| 12 | of the members of the Illinois Fire Fighters Memorial | ||||||
| 13 | Foundation.

| 16 | becoming law.
