Creates the Bedbug Inspection Act. Requires persons engaged in the business of renting furniture and electronic equipment to inspect the furniture and electronic equipment for bedbugs and other pests before renting to a subsequent customer. Requires that infested furniture or equipment be treated before renting to a subsequent customer. Authorizes an action for damages.

1 | | AN ACT concerning business.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 1. Short title. This Act may be cited as the Bedbug |
5 | | Inspection Act. |
6 | | Section 5. Definitions. In this Act: |
7 | | "Merchant" means a person who, in the ordinary course of |
8 | | business, regularly rents or leases furniture or electronic |
9 | | equipment to customers. |
10 | | "Pest" means undesirable insects including, but not |
11 | | limited to, bedbugs and roaches. |
12 | | "Rent" means the transfer of possession property or right |
13 | | of possession property for consideration. |
14 | | Section 10. Inspection. A merchant must inspect any |
15 | | previously rented furniture and equipment before renting the |
16 | | furniture or equipment to a subsequent customer. |
17 | | Section 15. Treatment required. If an inspection reveals |
18 | | the presence of pests, the merchant must treat the furniture or |
19 | | equipment to eradicate the pests before renting the furniture |
20 | | or equipment to a subsequent customer. |
