Amends the Illinois Municipal Code. Provides that, on and after the effective date of this amendatory Act, home rule municipalities and non-home rule municipalities may not impose any tax increase or levy any new or additional tax without prior referendum approval. Limits home rule powers. Effective immediately.

1 | | AN ACT concerning local government.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Municipal Code is amended by adding |
5 | | Section 8-3-20 as follows: |
6 | | (65 ILCS 5/8-3-20 new) |
7 | | Sec. 8-3-20. Taxing authority; referendum. Notwithstanding |
8 | | any provision of law to the contrary, on and after the |
9 | | effective date of this amendatory Act of the 100th General |
10 | | Assembly, home rule municipalities and non-home rule |
11 | | municipalities may not impose any tax increase or levy any new |
12 | | or additional tax without prior referendum approval. This |
13 | | Section is a denial and limitation of home rule powers and |
14 | | functions under subsection (g) of Section 6 of Article VII of |
15 | | the Illinois Constitution.

16 | | Section 99. Effective date. This Act takes effect upon |
17 | | becoming law.
