1 | | AN ACT concerning civil law.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 1. Short title. This Act may be cited as the Public |
5 | | Duty Rule Codification Act. |
6 | | Section 5. Findings; purpose. |
7 | | (a) The General Assembly finds: |
8 | | (1) On January 22, 2016, the Illinois Supreme Court, in |
9 | | Coleman v. East Joliet Fire Protection District, 2016 IL |
10 | | 117952, abolished the public duty rule. |
11 | | (2) The public duty rule is an important doctrine that |
12 | | is grounded in the principle that the duty of a local |
13 | | governmental entity to preserve the well-being of the |
14 | | community is owed to the public at large rather than to |
15 | | specific members of the community. |
16 | | (b) It is the purpose of this Act to codify the public duty |
17 | | rule. |
18 | | Section 10. Public duty rule. A local governmental entity |
19 | | and its employees owe no duty of care to individual members of |
20 | | the general public to provide governmental services.
