1 | AN ACT concerning local government.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||||
4 | Section 5. The Peace Officer and Probation Officer Firearm | |||||||||||||||||||||
5 | Training Act is amended by changing Sections 1 and 3 as | |||||||||||||||||||||
6 | follows:
| |||||||||||||||||||||
7 | (50 ILCS 710/1) (from Ch. 85, par. 515)
| |||||||||||||||||||||
8 | Sec. 1. Definitions. As used in this Act: | |||||||||||||||||||||
9 | (a) "Peace officer"
means (i) any person who by virtue of | |||||||||||||||||||||
10 | his office or public employment is
vested by law with a primary | |||||||||||||||||||||
11 | duty to maintain public order or to make
arrests for offenses, | |||||||||||||||||||||
12 | whether that duty extends to all offenses or is
limited to | |||||||||||||||||||||
13 | specific offenses, and who is employed in such capacity by any
| |||||||||||||||||||||
14 | county or municipality ; or (ii) any retired law enforcement | |||||||||||||||||||||
15 | officers qualified under federal law to carry a concealed | |||||||||||||||||||||
16 | weapon ; or (iii) for the purpose of carrying a concealed weapon | |||||||||||||||||||||
17 | under federal and State law, a qualified retired law | |||||||||||||||||||||
18 | enforcement officer is a person who meets the definition under | |||||||||||||||||||||
19 | paragraph (2) of subsection (c) of the federal Law Enforcement | |||||||||||||||||||||
20 | Officer Safety Act . | |||||||||||||||||||||
21 | (a-5) "Probation officer" means a county probation officer | |||||||||||||||||||||
22 | authorized by the Chief Judge of the Circuit Court to carry a | |||||||||||||||||||||
23 | firearm as part of his or her duties under Section 12 of the |

1 | Probation and Probation Officers Act and Section 24-2 of the | ||||||
2 | Criminal Code of 2012. | ||||||
3 | (b)
"Firearms" means any weapon or device defined as a | ||||||
4 | firearm in Section
1.1 of "An Act relating to the acquisition, | ||||||
5 | possession and transfer of
firearms and firearm ammunition, to | ||||||
6 | provide a penalty for the violation
thereof and to make an | ||||||
7 | appropriation in connection therewith", approved
August 3, | ||||||
8 | 1967, as amended.

11 | Sec. 3. The Board is charged with enforcing this Act and | ||||||
12 | making
inspections to insure compliance with its provisions, | ||||||
13 | and is empowered
to promulgate rules necessary for its | ||||||
14 | administration and enforcement, including those relating to | ||||||
15 | the annual certification of retired law enforcement officers | ||||||
16 | qualified under federal law to carry a concealed weapon.
All | ||||||
17 | units of government
or other agencies
which employ or utilize | ||||||
18 | peace officers, probation officers, or that certify retired law | ||||||
19 | enforcement officers qualified under federal law to carry a | ||||||
20 | concealed weapon, shall cooperate with
the Board by furnishing | ||||||
21 | relevant information which the Board may
require. For an | ||||||
22 | employer who is unable or unwilling to make an annual | ||||||
23 | certification under this Section, the Board shall make the | ||||||
24 | certification for an otherwise qualified retired law | ||||||
25 | enforcement officer. The Executive Director of the Board shall |

1 | report annually, no later
than February 1, to the Board, with | ||||||
2 | copies to the Governor and the General
Assembly, the results of
| ||||||
3 | these inspections and provide other related information and
| ||||||
4 | recommendations as it deems proper.

6 | Section 99. Effective date. This Act takes effect upon | ||||||
7 | becoming law.
