2 | AMENDMENT NO. ______. Amend House Bill 4953 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Department of Professional Regulation Law | ||||||
5 | of the
Civil Administrative Code of Illinois is amended by | ||||||
6 | adding Section 2105-15.5 as follows: | ||||||
7 | (20 ILCS 2105/2105-15.5 new) | ||||||
8 | Sec. 2105-15.5. Continuing education; sexual harassment | ||||||
9 | prevention training. | ||||||
10 | (a) As used in this Section, "sexual harassment" means any | ||||||
11 | unwelcome sexual advances or requests for sexual favors or any | ||||||
12 | conduct of a sexual nature when: (i) submission to such conduct | ||||||
13 | is made either explicitly or implicitly a term or condition of | ||||||
14 | an individual's employment; (ii) submission to or rejection of | ||||||
15 | such conduct by an individual is used as the basis for | ||||||
16 | employment decisions affecting such individual; or (iii) such |

1 | conduct has the purpose or effect of substantially interfering | ||||||
2 | with an individual's work performance or creating an | ||||||
3 | intimidating, hostile, or offensive working environment. For | ||||||
4 | the purpose of this definition, "working environment" is not | ||||||
5 | limited to a physical location that an employee is assigned to | ||||||
6 | perform his or her duties and does not require an employment | ||||||
7 | relationship. | ||||||
8 | (b) For license renewals occurring on or after January 1, | ||||||
9 | 2020 for a profession that has continuing education | ||||||
10 | requirements, the required continuing education hours shall | ||||||
11 | include at least one hour of sexual harassment prevention | ||||||
12 | training. | ||||||
13 | (c) The Department may adopt rules for the implementation | ||||||
14 | of this Section. ".
