SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Community Behavioral Health Care Professional Loan Repayment Program Act. Creates the Community Behavioral Health Care Professional Loan Repayment Program to be administered by the Illinois Student Assistance Commission. Provides that the Program shall provide loan assistance, subject to appropriation, to eligible mental health and substance use professionals practicing in a community mental health center in an underserved or rural federally designated Mental Health Professional Shortage Area. Provides that applicants must enter into a minimum 2-year contract. Provides that the Commission may extend the contract a third or fourth year to individual applicants upon completion of the initial 2-year obligation. Provides that Program participants who, for any reason, fail to begin or complete the required period of obligated service shall be liable to the Commission for an amount equal to the number of months of obligated service not completed multiplied by $2,500 and interest on the amount at the maximum legal prevailing rate, as determined by the Treasurer of the United States from the date of breach.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Community Behavioral Health Care Professional Loan Repayment
6Program Act.
 
7    Section 5. Purpose. The purpose of the Community Behavioral
8Health Care Professional Loan Repayment Program is to recruit
9and retain qualified mental health and substance use
10professionals to practice in underserved or rural areas and to
11address this State's community-based behavioral healthcare
12workforce shortage that causes disparities in access to
13critical mental health and substance use services.
 
14    Section 10. Definitions. In this Act:
15    "Commission" means the Illinois Student Assistance
16Commission.
17    "Physician" means a person licensed by this State to
18practice medicine in all its branches and includes any person
19holding a temporary license, as provided in the Medical
20Practice Act of 1987.
21    "Program" means the Community Behavioral Health Care
22Professional Loan Repayment Program.

1    "Psychiatrist" or "licensed psychiatrist" means a
2physician who has successfully completed a residency program in
3psychiatry accredited by either the Accreditation Council for
4Graduate Medical Education or the American Osteopathic
5Association.
 
6    Section 15. Establishment of Program. There is created the
7Community Behavioral Health Care Professional Loan Repayment
8Program which shall be administered by the Illinois Student
9Assistance Commission. The Program shall provide loan
10assistance, subject to appropriation, to eligible mental
11health and substance use professionals practicing in a
12community mental health center in an underserved or rural
13federally designated Mental Health Professional Shortage Area.
 
14    Section 20. Applications. Each year, the Commission shall
15receive and consider applications for loan repayment
16assistance under this Act.
 
17    Section 25. Maximum loan time. Applicants must enter into a
18minimum 2-year contract. The Commission may extend the contract
19a third or fourth year to individual applicants upon completion
20of the initial 2-year obligation.
 
21    Section 30. Eligibility. To be eligible for assistance
22under the Community Behavioral Health Care Professional Loan

1Repayment Program, an applicant must meet each of the following
2qualifications:
3    (1) the person must be a United States citizen or eligible
4noncitizen;
5    (2) the person must be a resident of this State;
6    (3) the person must be licensed in this State or expect to
7be licensed in this State as a psychiatrist, nurse
8practitioner, physician assistant, clinical psychologist,
9professional counselor, marriage and family therapist, or
10clinical social worker and must be willing to practice in a
11community mental health center in an underserved or rural
12federally designated Mental Health Professional Shortage Area
13in this State;
14    (4) sign a contract with the Illinois Student Assistance
15Commission guaranteeing his or her minimum commitment of 2
16years of service in a community mental health center in an
17underserved or rural federally designated Mental Health
18Professional Shortage Area in this State; and
19    (5) be indebted to a governmental or commercial lending
20institution for educational expenses incurred in pursuit of the
21applicant's degrees or diploma.
 
22    Section 35. Repayment obligations. Program participants
23who, for any reason, fail to begin or complete the required
24period of obligated service shall be liable to the Commission
25for an amount equal to the number of months of obligated

1service not completed multiplied by $2,500 and interest on the
2amount at the maximum legal prevailing rate, as determined by
3the Treasurer of the United States from the date of breach.
4    Any amount the Commission is entitled to recover shall be
5paid within one year of the date the Commission determines that
6the applicant is in breach of the written contract. Failure to
7pay the Commission by the due date has the following
8consequences:
9        (1) the debt shall be reported to credit reporting
10    agencies. Any loan repayment debt more than 60 days past
11    due shall be reported to all appropriate credit reporting
12    agencies;
13        (2) the debt shall be referred to a debt collection
14    agency and the Attorney General's Office. Any loan
15    repayment debt past due for 3 months shall be referred to a
16    debt agency. If the debt collection agency is unsuccessful
17    in receiving payment in full, the debt shall be referred to
18    the Attorney General's Office for enforced collection; and
19        (3) State payments due to the grantee, such as a State
20    income tax refund, may be offset by the Department of
21    Revenue to repay a delinquent loan repayment debt.
 
22    Section 40. Rules. The Commission shall administer the
23Program and shall adopt rules not inconsistent with this Act
24for the Program's effective implementation.
