AMENDMENT TO SENATE BILL 239

2    AMENDMENT NO. ______. Amend Senate Bill 239 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the
5In-Building Radio Coverage Enhancement Act.
 
6    Section 5. Purpose. This Act implements the provisions of
7the International Fire Code that assure proper communications
8among emergency response personnel to protect life and
9commercial buildings during fire and other hazardous threats
10through the enhancement of in-building radio signal strength of
11the public safety radio system.
 
12    Section 10. Definitions. As used in this Act:
13    "Approved radio coverage" means that emergency responders
14are able to transmit and receive radio signals of the public
15safety radio system signal in 95% of all areas on each floor of

1a commercial building and in 99% of its critical building
2areas.
3    "Authority having jurisdiction" means an organization,
4office, or individual responsible for enforcing the
5requirements of a code or standard, or for approving equipment,
6materials, an installation, or a procedure.
7    "Commercial building" means a building other than a
8single-family home; a dwelling containing 2 or fewer
9apartments, condominiums, or townhomes; or a farm building as
10exempted from Section 3 of the Illinois Architecture Practice
11Act.
12    "Critical building area" includes a fire command center,
13fire pump room, exit stair, exit passageway, elevator lobby,
14standpipe cabinet, sprinkler sectional valve location, and
15other areas deemed critical by the authority having
16jurisdiction.
17    "In-building emergency radio coverage enhancement system"
18means the products, such as repeaters, transmitters,
19receivers, signal boosters and battery charging systems, used
20to provide reliable 2-way wireless radio signal coverage for
21emergency responders inside buildings.
22    "Public safety radio system" means a radio system
23provisioned, installed, and maintained for the purpose of
24providing wireless communication to serve the requirements of
25emergency response agencies.

1    Section 15. Approved radio coverage required; in-building
2emergency radio enhancement systems.
3    (a) Within 18 months after the effective date of this Act:
4        (1) each applicant for a new construction permit for a
5    commercial building shall include an assessment of whether
6    the commercial building has approved radio coverage; and
7        (2) each owner of a commercial building not under
8    paragraph (1) shall conduct an assessment to determine
9    whether the commercial building has approved radio
10    coverage.
11    (b) All new and existing commercial buildings shall have
12approved radio coverage to assure proper emergency response and
13recovery mechanisms are available. If an assessment under
14subsection (a) demonstrates that the in-building radio signal
15strength of a public safety radio system fails to provide
16approved radio coverage, then:
17        (1) if it is a commercial building under paragraph (1)
18    of subsection (a), an approved emergency radio coverage
19    enhancement system shall be installed and maintained in
20    accordance with Sections 510 and 1103.2 of the 2018
21    International Fire Code and the 2016 edition of National
22    Fire Protection Association Standard 1221 before occupancy
23    of the commercial building; or
24        (2) if it is a commercial building under paragraph (2)
25    of subsection (a), an approved emergency radio coverage
26    enhancement system shall be installed and maintained in

1    accordance with Sections 510 and 1103.2 of the 2018
2    International Fire Code and the 2016 edition of National
3    Fire Protection Association Standard 1221 within 18 months
4    of the completion of the assessment.
5    The in-building emergency radio enhancement system shall
6be listed by a nationally recognized testing laboratory that is
7accredited by the United States Occupational Safety and Health
8Administration to test and certify to American National
9Standards Institute/Underwriters Laboratories Standard 2524.
 
10    Section 20. Existing public safety radio systems. This Act
11does not require improvement of existing public safety radio
12systems.
 
13    Section 25. Rules. The Office of the State Fire Marshal
14shall adopt rules to implement and enforce this Act, including
15rules for an accelerated timeline to conduct assessments of
16compliance with approved radio coverage in schools, hospitals,
17and other areas of mass congregation as determined by the
18Office of the State Fire Marshal.
 
19    Section 99. Effective date. This Act takes effect upon
20becoming law.".
