2 | AMENDMENT NO. ______. Amend Senate Bill 272 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 1. Short title. This Act may be cited as the State | ||||||
5 | Facility Water Management Plan Act. | ||||||
6 | Section 5. Definitions. As used in this Act: | ||||||
7 | "Department" means the Department of Public Health. | ||||||
8 | "Facility" means a correctional institution or facility as | ||||||
9 | defined under Section 3-1-2 of the Unified Code of Corrections, | ||||||
10 | a developmental disability facility as defined under Section | ||||||
11 | 1-107 of the Mental Health and Developmental Disabilities Code, | ||||||
12 | a mental health facility as defined under Section 1-114 of the | ||||||
13 | Mental Health and Developmental Disabilities Code, or a | ||||||
14 | State-operated mental health facility as defined under Section | ||||||
15 | 1-114.1 of the Mental Health and Developmental Disabilities | ||||||
16 | Code. |

1 | Section 10. Water management plan required. | ||||||
2 | (a) Every facility must develop a water management plan | ||||||
3 | that includes: | ||||||
4 | (1) the establishment of a water management team; | ||||||
5 | (2) a complete breakdown of the potable water system at | ||||||
6 | the facility and the elements of the water system; | ||||||
7 | (3) identification of potential issues and risks to the | ||||||
8 | potable water system; | ||||||
9 | (4) potential remedies and controls for the issues and | ||||||
10 | risks faced by the potable water system; and | ||||||
11 | (5) how detected problems with the potable water system | ||||||
12 | will be communicated to occupants, employees, and the | ||||||
13 | Department.

14 | Each facility shall develop a plan under this Section by | ||||||
15 | January 1, 2019. | ||||||
16 | (b) Each facility shall review its water management plan | ||||||
17 | annually for effectiveness. A facility shall also review its | ||||||
18 | water management plan at any time when one or more of the | ||||||
19 | following occurs: | ||||||
20 | (1) Legionella is detected at the facility; | ||||||
21 | (2) any construction, modification, or repair | ||||||
22 | activities that may affect a potable water system at the | ||||||
23 | facility is completed; or | ||||||
24 | (3) any other condition specified by the Department by | ||||||
25 | rule occurs. |

1 | Section 15. Legionella sampling; management plan required. | ||||||
2 | Each facility shall conduct a Legionella culture sampling and | ||||||
3 | develop a management plan for the facility's potable water | ||||||
4 | systems by January 1, 2019. The plan developed under this | ||||||
5 | Section shall include: | ||||||
6 | (1) provisions requiring Legionella culture sampling | ||||||
7 | annually and at 90-day intervals when Legionella is, or may | ||||||
8 | be, associated with the facility; | ||||||
9 | (2) provisions requiring actions in response to | ||||||
10 | Legionella culture analysis results, including responsive | ||||||
11 | actions, remediation, potential issues, and potential | ||||||
12 | remedies; and | ||||||
13 | (3) any other provisions specified by the Department by | ||||||
14 | rule.

15 | Section 99. Effective date. This Act takes effect upon | ||||||
16 | becoming law.".
