2 | AMENDMENT NO. ______. Amend Senate Bill 440 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The Board of Higher Education Act is amended by | ||||||
5 | changing Sections 2, 3, and 4 as follows:
| ||||||
6 | (110 ILCS 205/2) (from Ch. 144, par. 182)
| ||||||
7 | Sec. 2. There is created a Board of Higher Education to | ||||||
8 | consist of 18 16
members as follows: 10 members appointed by | ||||||
9 | the Governor, by and with
the advice and consent of the Senate; | ||||||
10 | one member of a public university
governing board, appointed by | ||||||
11 | the Governor without the advice and consent of
the Senate; one | ||||||
12 | member of a private college or university board of trustees,
| ||||||
13 | appointed by the Governor without the advice and consent of the | ||||||
14 | Senate; the
chairman of the Illinois Community College Board; | ||||||
15 | the
chairman of the Illinois Student Assistance Commission; and | ||||||
16 | 2 student members
selected by the recognized advisory committee |

1 | of students of the Board of
Higher Education, one of whom must | ||||||
2 | be a non-traditional undergraduate student who is at least 24 | ||||||
3 | years old and represents the views of non-traditional students, | ||||||
4 | such as a person who is employed or is a parent ; and 2 | ||||||
5 | full-time faculty members selected by the recognized advisory | ||||||
6 | council of faculty of the Board of Higher Education . Beginning | ||||||
7 | on July 1, 2005, one of the 10 members appointed
by the | ||||||
8 | Governor, by and with the advice and consent of the Senate, | ||||||
9 | must be a
faculty member at an Illinois public university. The | ||||||
10 | Governor shall
designate the
Chairman of the Board to
serve | ||||||
11 | until a successor is designated. The chairmen of the Board of | ||||||
12 | Trustees
of the University of Illinois, the Board of Trustees | ||||||
13 | of Southern Illinois
University, the Board of Governors of | ||||||
14 | State Colleges and Universities, and the
Board of Regents of | ||||||
15 | Regency Universities shall cease to be members of the Board
of | ||||||
16 | Higher Education on the effective date of this amendatory Act | ||||||
17 | of 1995.
No more than 7 of the members appointed by the | ||||||
18 | Governor, excluding the
Chairman, shall be affiliated
with the | ||||||
19 | same political party. The 10 members appointed by
the Governor | ||||||
20 | with the advice and
consent of the Senate shall be citizens of | ||||||
21 | the State and shall be
selected, as far as may be practicable, | ||||||
22 | on the basis of their knowledge
of, or interest or experience | ||||||
23 | in, problems of higher education. If the
Senate is not in | ||||||
24 | session or is in recess, when appointments subject to
its | ||||||
25 | confirmation are made, the Governor shall make temporary
| ||||||
26 | appointments which shall be subject to subsequent Senate |

4 | Sec. 3. Terms; vacancies.
| ||||||
5 | (a) The members of the Board whose appointments are subject | ||||||
6 | to
confirmation by the Senate shall be selected for 6-year | ||||||
7 | terms expiring on
January 31 of odd numbered years. Of the | ||||||
8 | initial appointees, however, 2
shall be designated by the | ||||||
9 | Governor to serve until January 31, 1963, 3
until January 31, | ||||||
10 | 1965, and 3 until January 31, 1967.

11 | Of the 2 appointees to be made by the Governor pursuant to | ||||||
12 | this Act as
amended by the 75th General Assembly, one shall be | ||||||
13 | designated to
serve until January 31, 1971 and one until | ||||||
14 | January 31, 1973.
| ||||||
15 | (b) The members of the Board shall continue to serve after | ||||||
16 | the
expiration of their terms until their successors have been | ||||||
17 | appointed.
| ||||||
18 | (c) Vacancies on the Board in offices appointed by the | ||||||
19 | Governor shall be
filled by appointment by the Governor for the | ||||||
20 | unexpired term. If the
appointment is subject to Senate | ||||||
21 | confirmation and the Senate is not in
session or is in recess | ||||||
22 | when the appointment is made, the appointee shall
serve subject | ||||||
23 | to subsequent Senate approval of the appointment.

24 | (d) Each student member shall serve a term of one year | ||||||
25 | beginning on July
1 of each year, except that the student |

1 | member initially selected under this amendatory Act of the 94th | ||||||
2 | General Assembly shall
serve a term beginning on the date of | ||||||
3 | such selection and expiring on the
next succeeding June 30.
| ||||||
4 | (e) The member of the Board representing public university | ||||||
5 | governing
boards and the member of the Board representing | ||||||
6 | private college and university
boards of trustees, who are | ||||||
7 | appointed by the Governor but not subject to
confirmation by | ||||||
8 | the Senate, shall serve terms of one year beginning on July 1.
| ||||||
9 | The 2 members selected by the Board's recognized advisory | ||||||
10 | council of faculty shall serve terms of one year beginning on | ||||||
11 | July 1 and shall continue to serve after the expiration of | ||||||
12 | their terms until their successors have been selected. | ||||||

15 | Sec. 4. The Board shall hold regular meetings at times | ||||||
16 | specified in its
rules. Special
or additional meetings may be | ||||||
17 | held on call of the Chairman, or upon a call
signed by at least | ||||||
18 | 8 6 members, or upon call of the Governor. Ten Eight members of | ||||||
19 | the Board shall constitute a quorum at all its meetings,
but | ||||||
20 | the approval of a new unit of instruction, research, or public | ||||||
21 | service
for a public institution of higher education, as | ||||||
22 | provided
in Section 7 shall require the concurrence of a | ||||||
23 | majority of all the members
of the Board.

24 | The Chairmen of the Illinois Community College Board and | ||||||
25 | the Illinois
Student Assistance Commission holding membership |

| |||||||
1 | on the Board each may
designate an alternate to attend any | ||||||
2 | meeting of the Board, and an alternate so
designated shall have | ||||||
3 | all rights and privileges of regular membership while
acting | ||||||
4 | for the Chairman who has so designated him or her.
| ||||||
5 | The Board may employ and fix the compensation of | ||||||
6 | professional and clerical
staff and other assistants, | ||||||
7 | including specialists and consultants, as it
may deem | ||||||
8 | necessary, on a full or part time basis.
