1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Professional Regulation Law of
5the Civil Administrative Code of Illinois is amended by adding
6Section 2105-20 as follows:
 
7    (20 ILCS 2105/2105-20 new)
8    Sec. 2105-20. Criminal history records checks. Licensees
9or applicants applying for expedited licensure through an
10interstate compact enacted into law by the General Assembly,
11including, but not limited to, the Interstate Medical Licensure
12Compact Act, who have designated Illinois as the principal
13state of licensure for the purposes of the compact shall have
14his or her fingerprints submitted to the Department of State
15Police in an electronic format that complies with the form and
16manner for requesting and furnishing criminal history record
17information as prescribed by the Department of State Police.
18These fingerprints shall be checked against the Department of
19State Police and Federal Bureau of Investigation criminal
20history record databases now and hereafter filed. The
21Department of State Police shall charge applicants or licensees
22a fee for conducting the criminal history records check, which
23shall be deposited into the State Police Services Fund and

1shall not exceed the actual cost of the records check. The
2Department of State Police shall furnish, pursuant to positive
3identification, records of Illinois convictions to the
4Department. The Department may require applicants or licensees
5to pay a separate fingerprinting fee, either to the Department
6or to a vendor designated or approved by the Department. The
7Department, in its discretion, may allow an applicant or
8licensee who does not have reasonable access to a designated
9vendor to provide his or her fingerprints in an alternative
10manner. The Department may adopt any rules necessary to
11implement this Section. Communication between the Department
12and an interstate compact governing body, including, but not
13limited to, the Interstate Commission as defined in Section 180
14of the Interstate Medical Licensure Compact Act, may not
15include information received from the Federal Bureau of
16Investigation relating to a State and federal criminal history
17records check.
 
18    Section 99. Effective date. This Act takes effect upon
19becoming law.
