AMENDMENT TO SENATE BILL 1103

2    AMENDMENT NO. ______. Amend Senate Bill 1103 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Director of the Department of Natural
5Resources, on behalf of the State of Illinois, is authorized to
6release by quitclaim deed a certain scenic easement in Scott
7County, Illinois, hereinafter referred to as Parcel 1, in
8exchange for consideration of replacement property rights of
9equal or greater value.
10    PARCEL 1:
11    All that part of the South Half of Section 34, Township 15
12    North, Range 14 West of the Third Principal Meridian in
13    Scott County, Illinois, bounded as follows: on the North by
14    the Southerly right of way line of the Norfolk and Western
15    Railway Company; on the West by the Easterly bank of the
16    Illinois River, including any riparian rights or
17    accretions thereto; on the East by the centerline of the

1    top of the levee along the Easterly bank of the Illinois
2    River.
 
3    Section 10. This transaction is deemed be to the mutual
4advantage of both parties, and each party shall be responsible
5for any and all title costs associated with that party's
6respective properties.
 
7    Section 15. The conveyance of Parcel 1 as authorized by
8Section 5 shall be made subject to: existing public utilities,
9existing public roads, and any and all reservations, easements,
10encumbrances, covenants, and restrictions of record.
 
11    Section 20. The Director of the Department of Natural
12Resources shall obtain an opinion of title from the Illinois
13Attorney General certifying that the State of Illinois will
14receive merchantable title to the replacement real property or
15scenic easement.
 
16    Section 25. This Act is inoperative if consideration is not
17acceptable to the Department of Natural Resources.
 
18    Section 99. Effective date. This Act takes effect upon
19becoming law.".
