1 | AN ACT concerning transportation.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Illinois Highway Code is amended by changing | ||||||
5 | Sections 6-901 and 6-906 as follows:
| ||||||

7 | Sec. 6-901.
Annually, the General Assembly shall | ||||||
8 | appropriate to the
Department of Transportation from the road | ||||||
9 | fund, the general revenue
fund, any other State funds or a | ||||||
10 | combination of those funds, $15,000,000
for apportionment to | ||||||
11 | counties for the use of road districts for the
construction of | ||||||
12 | bridges 20 feet or more in length, as provided in
Sections | ||||||
13 | 6-902 through 6-905.
| ||||||
14 | The Department of Transportation shall apportion among the | ||||||
15 | several
counties of this State for the use of road districts | ||||||
16 | the amounts
appropriated under this Section. The amount | ||||||
17 | apportioned to a county
shall be in the proportion which the | ||||||
18 | total mileage of township or
district roads in the county bears | ||||||
19 | to the total mileage of all township
and district roads in the | ||||||
20 | State. To be eligible for the expenditure of the apportioned | ||||||
21 | funds, a road district shall levy taxes for road and bridge | ||||||
22 | purposes under Section 8 of the Motor Fuel Tax Law. Each county | ||||||
23 | shall allocate to the
several road districts in the county the |

1 | funds so apportioned to the
county. The allocation to road | ||||||
2 | districts shall be made in the same
manner and be subject to | ||||||
3 | the same conditions and qualifications as are
provided by | ||||||
4 | Section 8 of the "Motor Fuel Tax Law", approved March 25,
1929, | ||||||
5 | as amended, with respect to the allocation to road districts of
| ||||||
6 | the amount allotted from the Motor Fuel Tax Fund for | ||||||
7 | apportionment to
counties for the use of road districts, but no | ||||||
8 | allocation shall be made
to any road district that has not | ||||||
9 | levied taxes for road and bridge
purposes and for bridge | ||||||
10 | construction purposes at the maximum rates
permitted by | ||||||
11 | Sections 6-501, 6-508 and 6-512 of this Act, without
| ||||||
12 | referendum. "Road district" and "township or district road" | ||||||
13 | have the
meanings ascribed to those terms in this Act.

14 | Road districts in counties in which a property tax | ||||||
15 | extension limitation is
imposed under the Property Tax | ||||||
16 | Extension Limitation Law that are made
ineligible for receipt | ||||||
17 | of this appropriation due to the imposition of a
property tax | ||||||
18 | extension limitation may become eligible if, at the time the
| ||||||
19 | property tax extension limitation was imposed, the road | ||||||
20 | district was levying at
the required rate and continues to levy | ||||||
21 | the maximum allowable amount
after the imposition of the | ||||||
22 | property tax extension limitation. The road
district
also | ||||||
23 | becomes
eligible if it levies at or above the rate required for | ||||||
24 | eligibility by Section
8 of the
Motor Fuel Tax Law.

25 | The amounts apportioned under this Section for allocation | ||||||
26 | to road
districts may be used only for bridge construction as |
| |||||||
| |||||||
1 | provided in this
Division. So much of those amounts as are not | ||||||
2 | obligated under Sections
6-902 through 6-904 and for which | ||||||
3 | local funds have not been committed
under Section 6-905 within | ||||||
4 | 48 months of the date
when such apportionment is
made lapses | ||||||
5 | and shall not be paid to the county treasurer for
distribution | ||||||
6 | to road districts .

9 | Sec. 6-906.
So much of the amount apportioned to a county | ||||||
10 | under
Section 6-901 that is obligated under Sections 6-902 | ||||||
11 | through 6-904 and
for which local funds have been committed | ||||||
12 | under Section 6-905, within 4
years from the date the | ||||||
13 | apportionment is made, shall, upon
certification by the | ||||||
14 | Department, be paid to the county treasurer, who
shall apply | ||||||
15 | those funds to the payment of such obligations. Any funds
| ||||||
16 | allocated to a county under Section 6-901 that are not | ||||||
17 | obligated within 48
months under Sections 6-902 through 6-904 | ||||||
18 | shall revert to the Road Fund.
| ||||||
19 | The funds reverted to the Road Fund under this Section | ||||||
20 | shall be considered lapse pool funds to provide additional | ||||||
21 | monetary assistance to township road districts that have | ||||||
22 | insufficient funding for the construction of bridges that are | ||||||
23 | 20 feet or more in length under Section 6-901 of this Code. The | ||||||
24 | township road district shall be subject to the local | ||||||
25 | contribution requirements under Section 6-905 of this Code. The |

1 | Department shall adopt rules to implement this Section. | ||||||
