1 | AN ACT concerning local government.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Property Tax Code is amended by adding | ||||||
5 | Section 10-705 as follows: | ||||||
6 | (35 ILCS 200/10-705 new) | ||||||
7 | Sec. 10-705. Keystone property. | ||||||
8 | (a) For the purposes of this Section: | ||||||
9 | "Base year" means the last tax year prior to the date | ||||||
10 | of the application during which the property was occupied | ||||||
11 | and assessed and taxes were collected. | ||||||
12 | "Tax year" means the calendar year for which assessed | ||||||
13 | value is determined as of January 1 of that year. | ||||||
14 | "Keystone property" means property that has had a | ||||||
15 | distinguished past and is a prominent property in the | ||||||
16 | Village of Park Forest, a home rule municipality in both | ||||||
17 | Cook and Will Counties, but is not of historical | ||||||
18 | significance or landmark status and meets the following | ||||||
19 | criteria: | ||||||
20 | (1) the property contains an existing industrial | ||||||
21 | structure consisting of more than 100,000 square feet; | ||||||
22 | (2) the property is located on a lot, parcel, or | ||||||
23 | tract of land that is more than 5 acres in area; |

1 | (3) the industrial structure was originally built | ||||||
2 | more than 30 years prior to the date of the | ||||||
3 | application; | ||||||
4 | (4) the property has been vacant for a period of | ||||||
5 | more than 5 consecutive years immediately prior to the | ||||||
6 | date of the application; and | ||||||
7 | (5) the property is not located in a tax increment | ||||||
8 | financing district as of the date of the application. | ||||||
9 | (b) Within one year from the effective date of this | ||||||
10 | amendatory Act of the 100th General Assembly, owners of real | ||||||
11 | property may apply with the municipality in which the property | ||||||
12 | is located to have the property designated as keystone | ||||||
13 | property. If the property meets the criteria for keystone | ||||||
14 | property set forth in subsection (a), then the corporate | ||||||
15 | authorities of the municipality have one year from the | ||||||
16 | effective date of this amendatory Act of the 100th General | ||||||
17 | Assembly within which they may certify the property as keystone | ||||||
18 | property for the purposes of promoting rehabilitation of vacant | ||||||
19 | property and fostering job creation in the fields of | ||||||
20 | manufacturing and research and development. The certification | ||||||
21 | shall be transmitted to the chief county assessment officer as | ||||||
22 | soon as possible after the property is certified. | ||||||
23 | (c) Beginning with the first tax year after the property is | ||||||
24 | certified as keystone property and continuing through the | ||||||
25 | twelfth tax year after the property is certified as keystone | ||||||
26 | property, for the purpose of taxation under this Code, the |

1 | property shall be valued at 33 1/3% of the fair cash value of | ||||||
2 | the land, without regard to buildings, structures, | ||||||
3 | improvements, and other permanent fixtures located on the | ||||||
4 | property. For the first 3 tax years after the property is | ||||||
5 | certified as keystone property, the aggregate tax liability for | ||||||
6 | the property shall be no greater than $75,000. That aggregate | ||||||
7 | tax liability, once collected, shall be distributed to the | ||||||
8 | taxing districts in which the property is located according to | ||||||
9 | each taxing district's proportionate share of that aggregate | ||||||
10 | liability. Beginning with the fourth tax year after the | ||||||
11 | property is certified as keystone property and continuing | ||||||
12 | through the twelfth tax year after the property is certified as | ||||||
13 | keystone property, the property's tax liability for each taxing | ||||||
14 | district in which the property is located shall be increased | ||||||
15 | over the tax liability for the preceding year by the percentage | ||||||
16 | increase, if any, in the total equalized assessed value of all | ||||||
17 | property in the taxing district. | ||||||
18 | No later than March 1 of each year before taxes are | ||||||
19 | extended for the prior tax year, the Village of Park Forest | ||||||
20 | shall certify to the county clerk of the county in which the | ||||||
21 | property is located a percentage reduction to be applied to | ||||||
22 | property taxes to limit the aggregate tax liability on keystone | ||||||
23 | property in accordance with this Section. | ||||||
24 | Section 10. The Illinois Municipal Code is amended by | ||||||
25 | changing Section 11-74.4-3.5 as follows:

8 | later than December 31 of the year in which the payment to the | ||||||
9 | municipal
treasurer, as provided in subsection (b) of Section | ||||||
10 | 11-74.4-8 of this Act, is to
be made with respect to ad valorem | ||||||
11 | taxes levied in the 23rd
calendar year after the year in which | ||||||
12 | the ordinance approving the
redevelopment project area was | ||||||
13 | adopted if the ordinance was adopted on or after
January 15, | ||||||
14 | 1981. | ||||||
15 | (a-5) If the redevelopment project area is located within a | ||||||
16 | transit facility improvement area established pursuant to | ||||||
17 | Section 11-74.4-3, the estimated dates of completion of the | ||||||
18 | redevelopment project and retirement of obligations issued to | ||||||
19 | finance redevelopment project costs (including refunding bonds | ||||||
20 | under Section 11-74.4-7) may not be later than December 31 of | ||||||
21 | the year in which the payment to the municipal treasurer, as | ||||||
22 | provided in subsection (b) of Section 11-74.4-8 of this Act | ||||||
23 | amendatory Act of the 99th General Assembly , is to be made with | ||||||
24 | respect to ad valorem taxes levied in the 35th calendar year | ||||||
25 | after the year in which the ordinance approving the |

1 | redevelopment project area was adopted. | ||||||
2 | (a-7) A municipality may adopt tax increment financing for | ||||||
3 | a redevelopment project area located in a transit facility | ||||||
4 | improvement area that also includes real property located | ||||||
5 | within an existing redevelopment project area established | ||||||
6 | prior to August 12, 2016 ( the effective date of Public Act | ||||||
7 | 99-792) this amendatory Act of 99th General Assembly . In such | ||||||
8 | case: (i) the provisions of this Division shall apply with | ||||||
9 | respect to the previously established redevelopment project | ||||||
10 | area until the municipality adopts, as required in accordance | ||||||
11 | with applicable provisions of this Division, an ordinance | ||||||
12 | dissolving the special tax allocation fund for such | ||||||
13 | redevelopment project area and terminating the designation of | ||||||
14 | such redevelopment project area as a redevelopment project | ||||||
15 | area; and (ii) after the effective date of the ordinance | ||||||
16 | described in (i), the provisions of this Division shall apply | ||||||
17 | with respect to the subsequently established redevelopment | ||||||
18 | project area located in a transit facility improvement area. | ||||||
19 | (b) The estimated dates of completion of the redevelopment | ||||||
20 | project and retirement of obligations issued to finance | ||||||
21 | redevelopment project costs (including refunding bonds under | ||||||
22 | Section 11-74.4-7) may not be later than December 31 of the | ||||||
23 | year in which the payment to the municipal treasurer as | ||||||
24 | provided in subsection (b) of Section 11-74.4-8 of this Act is | ||||||
25 | to be made with respect to ad valorem taxes levied in the 32nd | ||||||
26 | calendar year after the year in which the ordinance approving |

1 | the redevelopment project area was adopted if the ordinance was | ||||||
2 | adopted on September 9, 1999 by the Village of Downs. | ||||||

16 | Section 11-74.4-7) may not be later than December 31 of the | ||||||
17 | year in which the payment to the municipal treasurer as | ||||||
18 | provided in subsection (b) of Section 11-74.4-8 of this Act is | ||||||
19 | to be made with respect to ad valorem taxes levied in the 28th | ||||||
20 | calendar year after the year in which the ordinance approving | ||||||
21 | the redevelopment project area was adopted if the ordinance was | ||||||
22 | adopted on October 12, 1989 by the City of Lawrenceville. | ||||||
23 | (c) The estimated dates of completion
