2 | AMENDMENT NO. ______. Amend Senate Bill 2657 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Consumer Fraud and Deceptive Business | ||||||
5 | Practices Act is amended by adding Section 2VVV as follows: | ||||||
6 | (815 ILCS 505/2VVV new) | ||||||
7 | Sec. 2VVV. Credit card and debit card transaction fees | ||||||
8 | prohibited. | ||||||
9 | (a) As used in this Section, "transaction fee" means any | ||||||
10 | per transaction fee, item fee, item rate fee, per item rate | ||||||
11 | fee, communication fee, address verification fee, or | ||||||
12 | authorization fee imposed on the person or consumer by the | ||||||
13 | service provider for accepting or processing a credit or debit | ||||||
14 | card. | ||||||
15 | (b) No service provider accepting and processing credit or | ||||||
16 | debit card payments on behalf of a person may impose a |

1 | transaction fee upon the person or the consumer. It is an | ||||||
2 | unlawful practice within the meaning of this Act for a service | ||||||
3 | provider to impose a transaction fee upon the person or | ||||||
4 | consumer in connection with the processing of credit or debit | ||||||
5 | card payments. ".
