SYNOPSIS AS INTRODUCED:
 
5 ILCS 377/10-10

    Amends the State Employee Health Savings Account Law. Provides that each employer under the Act may (rather than shall) make available to each eligible individual a health savings account program, if that individual chooses to enroll in the program. Provides that an employer who makes a health savings account program available may make an annual contribution, in an amount determined by the employer, into an eligible individual's health savings account. Removes language requiring an employer to annually deposit an amount equal to one-third of the annual deductible into an eligible individual's health savings account. Makes conforming changes.

1    AN ACT concerning government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Employee Health Savings Account Law is
5amended by changing Section 10-10 as follows:
 
6    (5 ILCS 377/10-10)
7    Sec. 10-10. Application; authorized contributions.
8    (a) Each Beginning in calendar year 2012, each employer may
9shall make available to each eligible individual a health
10savings account program, if that individual chooses to enroll
11in the program except that, for an employer who provides
12coverage pursuant to any one or more of subsections (i) through
13(n) of Section 10 of the State Employee Group Insurance Act,
14that employer may make available a health savings account
15program. An employer who makes a health savings account program
16available may make an annual contribution, in an amount
17determined by the employer, shall annually deposit an amount
18equal to one-third of the annual deductible into an eligible
19individual's health savings account. Unused funds in a health
20savings account shall become the property of the account holder
21at the end of a taxable year.
22    (b) Beginning in calendar year 2012, an eligible individual
23may deposit contributions into a health savings account in

1accordance with the restrictions set forth in subsection (e) of
2Section 10-5.
