1 | AN ACT concerning transportation.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Illinois Highway Code is amended by changing | |||||||||||||||||||||
5 | Sections 4-221 and 4-222 as follows: | |||||||||||||||||||||
6 | (605 ILCS 5/4-221) | |||||||||||||||||||||
7 | Sec. 4-221. Mix designs. To the extent allowed by federal | |||||||||||||||||||||
8 | law, the Department specifications shall allow the use of | |||||||||||||||||||||
9 | recycled asphalt roofing shingles , including asphalt | |||||||||||||||||||||
10 | rejuvenating agents and binder performance grade modifiers, in | |||||||||||||||||||||
11 | mix designs used for the construction and maintenance of State | |||||||||||||||||||||
12 | highways. All asphalt roofing shingles used in Department | |||||||||||||||||||||
13 | projects shall be from recycling facilities that are approved | |||||||||||||||||||||
14 | by the Illinois Environmental Protection Agency and that are in | |||||||||||||||||||||
15 | compliance with the operational guidelines and | |||||||||||||||||||||
16 | asbestos-testing requirements set forth by the Agency under | |||||||||||||||||||||
17 | received from facilities authorized to process asphalt roofing | |||||||||||||||||||||
18 | shingles for recycling into asphalt pavement in accordance with | |||||||||||||||||||||
19 | (i) permits issued pursuant to Section 39 of the Environmental | |||||||||||||||||||||
20 | Protection Act or (ii) beneficial use determinations issued | |||||||||||||||||||||
21 | pursuant to Section 22.54 of the Environmental Protection Act. | |||||||||||||||||||||
22 | In creating the mix designs used for construction and | |||||||||||||||||||||
23 | maintenance of State highways, it shall be the goal of the |

1 | Department, through its specifications, to maximize the | ||||||
2 | percentage of recycled asphalt roofing shingles and binder | ||||||
3 | replacement and to maximize the use of recycled aggregates and | ||||||
4 | other lowest-cost constituents in the mix , including asphalt | ||||||
5 | rejuvenating agents and binder performance grade modifiers, so | ||||||
6 | long as there is no detrimental impact on life-cycle costs.

9 | Sec. 4-222. Recycled asphalt roofing shingles; cost | ||||||
10 | savings; prohibitions on use in asphalt paving. | ||||||
11 | (a) It shall be the goal of the Department, with regard to | ||||||
12 | its asphalt paving projects and to the extent possible, to | ||||||
13 | reduce the carbon footprint and reduce average costs by | ||||||
14 | maximizing the percentage use of recycled materials or lowest | ||||||
15 | cost alternative materials , including asphalt rejuvenating | ||||||
16 | agents and binder performance grade modifiers, and extending | ||||||
17 | the paving season so long as there is no detrimental impact on | ||||||
18 | life-cycle costs. In furtherance of these goals, the Department | ||||||
19 | shall provide to the Chairpersons of the Transportation | ||||||
20 | Committee in each legislative chamber, within 60 days after the | ||||||
21 | completion of each fiscal year, a written report of the | ||||||
22 | activities initiated or abandoned in each district or region | ||||||
23 | within the Department to meet those goals during the previous | ||||||
24 | year. The report shall also include an analysis of the cost | ||||||
25 | savings directly or indirectly attributed to those activities |

1 | within each district or region. Upon review of the annual | ||||||
2 | report, the Transportation Committees in each chamber may | ||||||
3 | conduct hearings and provide recommendations to the Department | ||||||
4 | regarding the performance of each district or region. | ||||||
5 | (b) No producer of asphalt pavement, operating pursuant to | ||||||
6 | an air permit issued by the Illinois Environmental Protection | ||||||
7 | Agency, shall use recycled asphalt roofing shingles in its | ||||||
8 | pavement product unless the shingles have been processed for | ||||||
9 | recycling into asphalt pavement in accordance with (i) permits | ||||||
10 | issued pursuant to Section 39 of the Environmental Protection | ||||||
11 | Act or (ii) beneficial use determinations issued pursuant to | ||||||
12 | Section 22.54 of the Environmental Protection Act. The | ||||||
13 | prohibition in this subsection (b) shall apply in addition to | ||||||
14 | any other rules, specifications, or other requirements adopted | ||||||
15 | by the Department regarding the use of asphalt roofing shingles | ||||||
16 | in pavement product.
