2 | AMENDMENT NO. ______. Amend Senate Bill 3001 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Illinois Highway Code is amended by | ||||||
5 | changing Sections 4-221 and 4-222 as follows: | ||||||
6 | (605 ILCS 5/4-221) | ||||||
7 | Sec. 4-221. Mix designs. To the extent allowed by federal | ||||||
8 | law, the Department specifications shall allow the use of | ||||||
9 | recycled asphalt roofing shingles received from facilities | ||||||
10 | authorized to process asphalt roofing shingles for recycling | ||||||
11 | into asphalt pavement in accordance with (i) permits issued | ||||||
12 | pursuant to Section 39 of the Environmental Protection Act or | ||||||
13 | (ii) beneficial use determinations issued pursuant to Section | ||||||
14 | 22.54 of the Environmental Protection Act as well as asphalt | ||||||
15 | additive agents and binder performance grade modifiers . In | ||||||
16 | creating the mix designs used for construction and maintenance |

1 | of State highways, it shall be the goal of the Department, | ||||||
2 | through its specifications, to maximize the percentage of | ||||||
3 | recycled asphalt roofing shingles and binder replacement and to | ||||||
4 | maximize the use of recycled aggregates and other lowest-cost | ||||||
5 | constituents in the mix , including asphalt additive agents and | ||||||
6 | binder performance grade modifiers, so long as there is no | ||||||
7 | detrimental impact on life-cycle costs.

10 | Sec. 4-222. Recycled asphalt roofing shingles; cost | ||||||
11 | savings; prohibitions on use in asphalt paving. | ||||||
12 | (a) It shall be the goal of the Department, with regard to | ||||||
13 | its asphalt paving projects and to the extent possible, to | ||||||
14 | reduce the carbon footprint and reduce average costs by | ||||||
15 | maximizing the percentage use of recycled materials or lowest | ||||||
16 | cost alternative materials , including asphalt additive agents | ||||||
17 | and binder performance grade modifiers, and extending the | ||||||
18 | paving season so long as there is no detrimental impact on | ||||||
19 | life-cycle costs. In furtherance of these goals, the Department | ||||||
20 | shall provide to the Chairpersons of the Transportation | ||||||
21 | Committee in each legislative chamber, within 60 days after the | ||||||
22 | completion of each fiscal year, a written report of the | ||||||
23 | activities initiated or abandoned in each district or region | ||||||
24 | within the Department to meet those goals during the previous | ||||||
25 | year. The report shall also include an analysis of the cost |

1 | savings directly or indirectly attributed to those activities | ||||||
2 | within each district or region. Upon review of the annual | ||||||
3 | report, the Transportation Committees in each chamber may | ||||||
4 | conduct hearings and provide recommendations to the Department | ||||||
5 | regarding the performance of each district or region. | ||||||
6 | (b) No producer of asphalt pavement, operating pursuant to | ||||||
7 | an air permit issued by the Illinois Environmental Protection | ||||||
8 | Agency, shall use recycled asphalt roofing shingles in its | ||||||
9 | pavement product unless the shingles have been processed for | ||||||
10 | recycling into asphalt pavement in accordance with (i) permits | ||||||
11 | issued pursuant to Section 39 of the Environmental Protection | ||||||
12 | Act or (ii) beneficial use determinations issued pursuant to | ||||||
13 | Section 22.54 of the Environmental Protection Act. The | ||||||
14 | prohibition in this subsection (b) shall apply in addition to | ||||||
15 | any other rules, specifications, or other requirements adopted | ||||||
16 | by the Department regarding the use of asphalt roofing shingles | ||||||
17 | in pavement product.
