| 1 | AMENDMENT TO SENATE BILL 3053

| 2 | AMENDMENT NO. ______. Amend Senate Bill 3053 on page 1, | ||||||
| 3 | line 5, by replacing "as" with "and adding Section 35 as"; and | ||||||
| 4 | on page 1, by replacing lines 12 through 15 with the following: | ||||||
| 5 | "(b) Nothing in this Act shall be deemed to apply in any | ||||||
| 6 | manner to a private entity that complies construed to conflict | ||||||
| 7 | with
the X-Ray Retention Act, the federal Health Insurance
| ||||||
| 8 | Portability and Accountability Act of 1996 as amended by the | ||||||
| 9 | Health Information Technology for Economic and Clinical Health | ||||||
| 10 | Act of 2009, the Personal Information Protection Act, and the | ||||||
| 11 | rules
promulgated under those Acts either Act."; and | ||||||
| 12 | on page 2, by replacing line 8 with "information or biometric | ||||||
| 13 | identifiers if: (i) the biometric information or biometric | ||||||
| 14 | identifiers are used"; and | ||||||
| 15 | on page 2, line 12, by changing "or (iii)" to "and (iii)"; and

| 1 | on page 2, by inserting immediately below line 18 the | ||||||
| 2 | following: | ||||||
| 3 | "(740 ILCS 14/35 new) | ||||||
| 4 | Sec. 35. Department of Labor website. The Illinois | ||||||

| 6 | for employers regarding the requirements of this Act.".
