1 | AN ACT concerning government.
| ||||||
2 | Be it enacted by the People of the State of Illinois, | ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The State Police Act is amended by changing | ||||||
5 | Section 9 as follows:
| ||||||
6 | (20 ILCS 2610/9) (from Ch. 121, par. 307.9)
| ||||||
7 | Sec. 9. Appointment; qualifications.
| ||||||
8 | (a) Except as otherwise provided in this Section, the | ||||||
9 | appointment of
Department of State Police officers shall be | ||||||
10 | made from those applicants who
have been certified by the Board | ||||||
11 | as being qualified for appointment. All
persons so appointed | ||||||
12 | shall, at the time of their appointment, be not less than
21 | ||||||
13 | years of age, or 20 years of age and have successfully | ||||||
14 | completed an associate's degree or 60 credit hours 2 years of
| ||||||
15 | law enforcement studies at an accredited college or university. | ||||||
16 | Any person
appointed subsequent to successful completion of an | ||||||
17 | associate's degree or 60 credit hours at an accredited college | ||||||
18 | or university 2 years of such law
enforcement studies shall not | ||||||
19 | have power of arrest, nor shall he or she be permitted
to carry | ||||||
20 | firearms, until he or she reaches 21 years of age. In addition,
| ||||||
21 | all persons so certified for appointment shall be of sound mind | ||||||
22 | and body, be of
good moral character, be citizens of the United | ||||||
23 | States, have no criminal
records, possess such prerequisites of |

1 | training, education , and experience as
the Board may from time | ||||||
2 | to time prescribe so long as persons who have an associate's | ||||||
3 | degree or 60 credit hours at an accredited college or | ||||||
4 | university are not disqualified , and shall be required to pass
| ||||||
5 | successfully such mental and physical tests and examinations as | ||||||
6 | may be
prescribed by the Board. All Notwithstanding any Board | ||||||
7 | rule to the contrary, all persons who meet one of the following | ||||||
8 | requirements are deemed to have met the collegiate educational | ||||||
9 | requirements: | ||||||
10 | (i) have been honorably discharged and who have been | ||||||
11 | awarded a Southwest Asia Service Medal, Kosovo Campaign | ||||||
12 | Medal, Korean Defense Service Medal, Afghanistan Campaign | ||||||
13 | Medal, Iraq Campaign Medal, or Global War on Terrorism | ||||||
14 | Expeditionary Medal by the United States Armed Forces; | ||||||
15 | (ii) are active members of the Illinois National Guard | ||||||
16 | or a reserve component of the United States Armed Forces | ||||||
17 | and who have been awarded a Southwest Asia Service Medal, | ||||||
18 | Kosovo Campaign Medal, Korean Defense Service Medal, | ||||||
19 | Afghanistan Campaign Medal, Iraq Campaign Medal, or Global | ||||||
20 | War on Terrorism Expeditionary Medal as a result of | ||||||
21 | honorable service during deployment on active duty; | ||||||
22 | (iii) have been honorably discharged who served in a | ||||||
23 | combat mission by proof of hostile fire pay or imminent | ||||||
24 | danger pay during deployment on active duty; or | ||||||
25 | (iv) have at least 3 years of full active and | ||||||
26 | continuous military duty and received an honorable |

1 | discharge before hiring. | ||||||
2 | Preference shall be given in such appointments to
persons | ||||||
3 | who have honorably served in the military or naval services of | ||||||
4 | the
United States. All appointees shall serve a probationary | ||||||
5 | period of 12 months
from the date of appointment and during | ||||||
6 | that period may be discharged at the
will of the Director. | ||||||
7 | However, the Director may in his or her sole discretion
extend | ||||||
8 | the probationary period of an officer up to an additional 6 | ||||||
9 | months when
to do so is deemed in the best interest of the | ||||||
10 | Department. Nothing in this subsection (a) limits the Board's | ||||||
11 | ability to prescribe education prerequisites or requirements | ||||||
12 | to certify Department of State Police officers for promotion as | ||||||
13 | provided in Section 10 of this Act.

14 | (b) Notwithstanding the other provisions of this Act, after | ||||||
15 | July 1,
1977 and before July 1, 1980, the Director of State | ||||||
16 | Police may appoint and
promote not more than 20 persons having | ||||||
17 | special qualifications as special
agents as he or she deems | ||||||
18 | necessary to carry out the Department's objectives. Any
such | ||||||
19 | appointment or promotion shall be ratified by the Board.

20 | (c) During the 90 days following the effective date of this | ||||||
21 | amendatory Act
of 1995, the Director of State Police may | ||||||
22 | appoint up to 25 persons as State
Police officers. These | ||||||
23 | appointments shall be made in accordance with the
requirements | ||||||
24 | of this subsection (c) and any additional criteria that may be
| ||||||
25 | established by the Director, but are not subject to any other | ||||||
26 | requirements of
this Act. The Director may specify the initial |
| |||||||
| |||||||
1 | rank for each person appointed
under this subsection.
| ||||||
2 | All appointments under this subsection (c) shall be made | ||||||
3 | from personnel
certified by the Board. A person certified by | ||||||
4 | the Board and appointed by the
Director under this subsection | ||||||
5 | must have been employed by the Illinois Commerce
Commission on | ||||||
6 | November 30, 1994 in a job title
subject to the Personnel Code | ||||||
7 | and in a position for which the person was
eligible to earn | ||||||
8 | "eligible creditable service" as a "noncovered employee", as
| ||||||
9 | those terms are defined in Article 14 of the Illinois Pension | ||||||
10 | Code.
| ||||||
11 | Persons appointed under this subsection (c) shall | ||||||
12 | thereafter be subject to
the same requirements and procedures | ||||||
13 | as other State police officers. A person
appointed under this | ||||||
14 | subsection must serve a probationary period of 12 months
from | ||||||
15 | the date of appointment, during which he or she may be | ||||||
16 | discharged at the
will of the Director.

17 | This subsection (c) does not affect or limit the Director's | ||||||
18 | authority to
appoint other State Police officers under | ||||||
19 | subsection (a) of this Section.
