AMENDMENT TO HOUSE BILL 160

2    AMENDMENT NO. ______. Amend House Bill 160 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Cannabis Control Act is amended by changing
5Section 5.2 as follows:
 
6    (720 ILCS 550/5.2)  (from Ch. 56 1/2, par. 705.2)
7    Sec. 5.2. Delivery of cannabis on school grounds.
8    (a) Any person who violates subsection (e) of Section 5 in
9any school, on the real property comprising any school, or any
10conveyance owned, leased or contracted by a school to transport
11students to or from school or a school related activity, or on
12any public way within 500 feet of the real property comprising
13any school, or in any conveyance owned, leased or contracted by
14a school to transport students to or from school or a school
15related activity, and at the time of the violation persons
16under the age of 18 are present, the offense is committed

1during school hours, or the offense is committed at times when
2persons under the age of 18 are reasonably expected to be
3present in the school, in the conveyance, on the real property,
4or on the public way, such as when after-school activities are
5occurring, is guilty of a Class 1 felony, the fine for which
6shall not exceed $200,000;
7    (b) Any person who violates subsection (d) of Section 5 in
8any school, on the real property comprising any school, or any
9conveyance owned, leased or contracted by a school to transport
10students to or from school or a school related activity, or on
11any public way within 500 feet of the real property comprising
12any school, or in any conveyance owned, leased or contracted by
13a school to transport students to or from school or a school
14related activity, and at the time of the violation persons
15under the age of 18 are present, the offense is committed
16during school hours, or the offense is committed at times when
17persons under the age of 18 are reasonably expected to be
18present in the school, in the conveyance, on the real property,
19or on the public way, such as when after-school activities are
20occurring, is guilty of a Class 2 felony, the fine for which
21shall not exceed $100,000;
22    (c) Any person who violates subsection (c) of Section 5 in
23any school, on the real property comprising any school, or any
24conveyance owned, leased or contracted by a school to transport
25students to or from school or a school related activity, or on
26any public way within 500 feet of the real property comprising

1any school, or in any conveyance owned, leased or contracted by
2a school to transport students to or from school or a school
3related activity, and at the time of the violation persons
4under the age of 18 are present, the offense is committed

9occurring, is guilty of a Class 3 felony, the fine for which
10shall not exceed $50,000;
11    (d) Any person who violates subsection (b) of Section 5 in
12any school, on the real property comprising any school, or any
13conveyance owned, leased or contracted by a school to transport
14students to or from school or a school related activity, or on
15any public way within 500 feet of the real property comprising
16any school, or in any conveyance owned, leased or contracted by
17a school to transport students to or from school or a school
18related activity, and at the time of the violation persons
19under the age of 18 are present, the offense is committed
20during school hours, or the offense is committed at times when
21persons under the age of 18 are reasonably expected to be
22present in the school, in the conveyance, on the real property,
23or on the public way, such as when after-school activities are
24occurring, is guilty of a Class 4 felony, the fine for which
25shall not exceed $25,000;
26    (e) Any person who violates subsection (a) of Section 5 in

1any school, on the real property comprising any school, or in
2any conveyance owned, leased or contracted by a school to
3transport students to or from school or a school related
4activity, on any public way within 500 feet of the real
5property comprising any school, or any conveyance owned, leased
6or contracted by a school to transport students to or from
7school or a school related activity, and at the time of the
8violation persons under the age of 18 are present, the offense
9is committed during school hours, or the offense is committed
10at times when persons under the age of 18 are reasonably
11expected to be present in the school, in the conveyance, on the
12real property, or on the public way, such as when after-school
13activities are occurring, is guilty of a Class A misdemeanor.
14    (f) This Section does not apply to a violation that occurs
15in or on the grounds of a building that is designated as a
16school but is no longer operational or active as a school,
17including a building that is temporarily or permanently closed
18by a unit of local government.

20    Section 99. Effective date. This Act takes effect upon
21becoming law.".
