AMENDMENT TO HOUSE BILL 269

2    AMENDMENT NO. ______. Amend House Bill 269 on page 1, line
35, by replacing "Section 4" with "Sections 4 and 4a-5"; and
 
4on page 5, line 12, by changing "Commission" to "Commission,
5the salaries and benefits of the Self-Insurers Advisory Board
6employees, the operating costs of the Self-Insurers Advisory
7Board,"; and
 
8on page 10, by replacing lines 3 through 6 with the following:
9"to be extra hazardous, as defined in Section 3, a Commissioner
10may issue an emergency work-stop order on such an employer ex
11parte, prior to holding a hearing, requiring the cessation of
12all business operations of such employer at the place of
13employment or job site while awaiting the ruling of the
14Commission. Whenever a Commissioner issues an emergency
15work-stop order, the Commission shall issue a notice of
16emergency work-stop hearing to be posted at the employer's

1places of employment and job sites."; and
 
2on page 13, by replacing lines 17 through 21 with the
3following:
4"obligations of this Act imposes on employers."; and
 
5on page 15, by replacing lines 23 through 26 with the
6following:
7"of paragraph (a) of this Section may not self-insure for one
8year or until all penalties are paid."; and
 
9on page 16, by deleting line 1; and
 
10on page 22, by inserting immediately below line 18 the
11following:
 
12    "(820 ILCS 305/4a-5)  (from Ch. 48, par. 138.4a-5)
13    Sec. 4a-5. There is hereby created a Self-Insurers Security
14Fund. The State Treasurer shall be the ex-officio custodian of
15the Self-Insurers Security Fund. Moneys Monies in the Fund
16shall be deposited in a separate account in the same manner as
17are State Funds and any interest accruing thereon shall be
18added thereto every 6 months. It shall be subject to audit the
19same as State funds and accounts and shall be protected by the
20general bond given by the State Treasurer. The funds in the
21Self-Insurers Security Fund shall not be subject to

1appropriation and shall be made available for the purposes of
2compensating employees who are eligible to receive benefits
3from their employers pursuant to the provisions of the Workers'
4Compensation Act or Workers' Occupational Diseases Act, when,
5pursuant to this Section, the Board has determined that a
6private self-insurer has become an insolvent self-insurer and
7is unable to pay compensation benefits due to financial
8insolvency. Moneys Monies in the Fund may be used to compensate
9any type of injury or occupational disease which is compensable
10under either Act, and all claims for related administrative
11fees, operating costs of the Board, attorney's attorneys fees,
12and other costs reasonably incurred by the Board. At the
13discretion of the Chairman, moneys in the Self-Insurers
14Security Fund may also be used for paying the salaries and
15benefits of the Self-Insurers Advisory Board employees and the
16operating costs of the Board. Payment from the Self-Insurers
17Security Fund shall be made by the Comptroller only upon the
18authorization of the Chairman as evidenced by properly
19certified vouchers of the Commission, upon the direction of the
20Board.
