AMENDMENT TO HOUSE BILL 816

2    AMENDMENT NO. ______. Amend House Bill 816 as follows:
 
3on page 3, by replacing line 13 with "is amended by changing
4Section 1-5 and by adding Section 1-65 as follows:"; and
 
5on page 3, immediately below line 13, by inserting the
6following:
 
7    "(20 ILCS 1370/1-5)
8    Sec. 1-5. Definitions. In this Act:
9    "Bureau of Communications and Computer Services" means the
10Bureau of Communications and Computer Services, also known as
11the Bureau of Information and Communication Services, created
12by rule (2 Illinois Administrative Code 750.40) within the
13Department of Central Management Services.
14    "Client agency" means each transferring agency, or its
15successor. When applicable, "client agency" may also include

1any other public agency to which the Department provides
2service to the extent specified in an interagency contract with
3the public agency.
4    "Dedicated unit" means the dedicated bureau, division,
5office, or other unit within a transferring agency that is
6responsible for the information technology functions of the
7transferring agency. For the Office of the Governor, "dedicated
8unit" means the Information Technology Office, also known as
9the Office of the Chief Information Officer. For the Department
10of Central Management Services, "dedicated unit" means the
11Bureau of Communications and Computer Services, also known as
12the Bureau of Information and Communication Services.
13    "Department" means the Department of Innovation and
14Technology.
15    "Information technology" means technology, infrastructure,
16equipment, systems, software, networks, and processes used to
17create, send, receive, and store electronic or digital
18information, including, without limitation, computer systems
19and telecommunication services and systems. "Information
20technology" shall be construed broadly to incorporate future
21technologies (such as sensors and balanced private hybrid or
22public cloud posture tailored to the mission of the agency)
23that change or supplant those in effect as of the effective
24date of this Act.
25    "Information technology functions" means the development,
26procurement, installation, retention, maintenance, operation,

1possession, storage, and related functions of all information
2technology.
3    "Information Technology Office" means the Information
4Technology Office, also known as the Office of the Chief
5Information Officer, within the Office of the Governor, created
6by Executive Order 1999-05, or its successor.
7    "Legacy information technology division" means any
8division, bureau, or other unit of a transferring agency which
9has responsibility for information technology functions for
10the agency prior to the transfer of those functions to the
11Department, including, without limitation, the Bureau of
12Communications and Computer Services.
13    "Mobile-friendly" means, with respect to a website, that
14the website is configured in such a way that the website may be
15navigated, viewed, and accessed on a smartphone, tablet
16computer, or similar mobile device.
17    "Secretary" means the Secretary of Innovation and
18Technology.
19    "State agency" means each State agency, department, board,
20and commission directly responsible to the Governor.
21    "Transferring agency" means the Department on Aging; the
22Departments of Agriculture, Central Management Services,
23Children and Family Services, Commerce and Economic
24Opportunity, Corrections, Employment Security, Financial and
25Professional Regulation, Healthcare and Family Services, Human
26Rights, Human Services, Insurance, Juvenile Justice, Labor,

1Lottery, Military Affairs, Natural Resources, Public Health,
2Revenue, State Police, Transportation, and Veterans' Affairs;
3the Capital Development Board; the Deaf and Hard of Hearing
4Commission; the Environmental Protection Agency; the
5Governor's Office of Management and Budget; the Guardianship
6and Advocacy Commission; the Historic Preservation Agency; the
7Illinois Arts Council; the Illinois Council on Developmental
8Disabilities; the Illinois Emergency Management Agency; the
9Illinois Gaming Board; the Illinois Health Information
10Exchange Authority; the Illinois Liquor Control Commission;
11the Illinois Technology Office; the Office of the State Fire
12Marshal; and the Prisoner Review Board. "Transferring agency"
13does not include a State constitutional office, the Office of
14the Executive Inspector General, or any office of the
15legislative or judicial branches of State government.

19    "(a) On or before July 1, 2022, the Department of
20Innovation and Technology shall create a plan to improve the
21provision of digital services, including modernizing websites
22and enhancing the use of data analytics for all State agencies.
23The plan created under this Section shall be posted on the

1on page 4, by replacing lines 7 through 13 with the following:
2    "(b) On or before July 1, 2022, all State agency websites
3intended for use by the public shall be mobile-friendly.
4    (c) On or before July 1, 2022, all State websites intended
5for use by the public shall be accessible for persons with
6disabilities as provided under the Information Technology
7Accessibility Act.".
