1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by adding Section 2310-218 as follows:
 
7    (20 ILCS 2310/2310-218 new)
8    Sec. 2310-218. Phlebotomy on children and adults with
9intellectual and developmental disabilities.
10    (a) As used in this Section, "phlebotomist" means a person
11specifically trained to draw blood for diagnostic purposes in a
12health care setting.
13    (b) The Department shall develop and make available
14training materials that ensure that all phlebotomists are
15trained in the most current methods of drawing blood from
16children and adults with intellectual and developmental
17disabilities. The materials shall conform to the best available
18practices used for drawing blood in a safe manner that is as
19comfortable as possible for the individual from whom blood is
20drawn and for the families, guardians, caretakers, or
21companions of the individual accompanying him or her while
22blood is drawn. The Department shall review these materials
23every 3 years to ensure that they conform with the best

1available practices.
2    (c) The Department shall ensure that health care providers,
3as that term is defined under the Health Care Services Lien
4Act, and laboratories, as that term is defined under the
5Illinois Clinical Laboratory and Blood Bank Act, that employ a
6phlebotomist incorporate the training described in subsection
7(b) as part of a phlebotomist's initial employment training and
8as part of any ongoing training to maintain competencies and
9certifications as a phlebotomist.
10    (d) This Section does not apply to nonprofit blood banks or
11the affiliated laboratories of nonprofit blood banks.
