1 | AN ACT concerning government.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 1. Short title. This Act may be cited as the | ||||||
5 | Illinois Legislative Youth Advisory Council Act. | ||||||
6 | Section 5. Definition. For purposes of this Act: | ||||||
7 | "Council" means the Illinois Legislative Youth Advisory | ||||||
8 | Council. | ||||||
9 | Section 10. The Illinois Legislative Youth Advisory | ||||||
10 | Council. For the purpose of facilitating communication between | ||||||
11 | the youth of the State of Illinois and the elected branches of | ||||||
12 | State government regarding the issues, interests, and needs | ||||||
13 | important to youth in the State of Illinois, the Illinois | ||||||
14 | Legislative Youth Advisory Council is created. The Council | ||||||
15 | shall have the powers and responsibilities enumerated in this | ||||||
16 | Act, together with such others as may be conferred upon it by | ||||||
17 | law. The Council shall be an entity created under the | ||||||
18 | legislative branch, and maintained and staffed under the | ||||||
19 | executive branch by the Office of the Governor or an agency | ||||||
20 | designated by the Governor that is under the jurisdiction of | ||||||
21 | the Governor. |

1 | Section 15. Advisory Board; members; nomination; term of | ||||||
2 | office; vacancies. | ||||||
3 | (a) An Advisory Board shall be created to facilitate the | ||||||
4 | functions of the Council. The Advisory Board shall consist of 2 | ||||||
5 | members of the House of Representatives, one each appointed by | ||||||
6 | the Speaker of the House of Representatives and the Minority | ||||||
7 | Leader of the House of Representatives; and 2 members of the | ||||||
8 | Senate, one each appointed by the President of the Senate and | ||||||
9 | the Minority Leader of the Senate. The initial term for members | ||||||
10 | of the Advisory Council shall begin on January l, 2020, or the | ||||||
11 | effective date of this Act, whichever occurs later, and expire | ||||||
12 | on January 11, 2022. Thereafter, the term for members of the | ||||||
13 | Advisory Council shall begin on the Thursday following the | ||||||
14 | second Wednesday of January, and expire after 2 years. On or | ||||||
15 | before September 1, 2019, the Advisory Board shall create an | ||||||
16 | application that shall be used in nominating individuals to be | ||||||
17 | members of the Council. The Advisory Board may, from time to | ||||||
18 | time, modify the application with the consent of the Council. | ||||||
19 | While the Council is in session, the Advisory Board may attend | ||||||
20 | meetings of the Council, and may generally advise the Council. | ||||||
21 | Nothing in this Act shall be construed to entitle Advisory | ||||||
22 | Board members to vote on matters pending before the Council. | ||||||
23 | (b) Each member of the House of Representatives shall | ||||||
24 | nominate one qualified individual that resides in the | ||||||
25 | Representative's legislative district to serve as a member of | ||||||
26 | the Council after receiving and reviewing the individual's |

1 | application and considering any recommendation made by a member | ||||||
2 | of the Senate. The Representative shall make the nomination on | ||||||
3 | or before October 31 of each calendar year. After making the | ||||||
4 | nomination, the Representative shall, by first class mail, | ||||||
5 | notify the nominated individual by November 15 of the same | ||||||
6 | year. If the Representative is a member of the majority party, | ||||||
7 | the Representative shall notify the Speaker of the House of | ||||||
8 | Representatives of his or her nomination by November 15 of the | ||||||
9 | same year. If the Representative is a member of the minority | ||||||
10 | party, the Representative shall notify the Minority Leader of | ||||||
11 | the House of Representatives of his or her nomination by | ||||||
12 | November 15 of the same year. | ||||||
13 | (c) Upon receiving a nomination, the Speaker of the House | ||||||
14 | of Representatives or the Minority Leader of the House of | ||||||
15 | Representatives, whichever the case may be, shall accept the | ||||||
16 | nomination, except for good cause shown, and appoint the | ||||||
17 | individual to be a member of the Council. Upon appointing the | ||||||
18 | nominated individual, the Speaker of the House of | ||||||
19 | Representatives or the Minority Leader of the House of | ||||||
20 | Representatives, whichever the case may be, shall notify the | ||||||
21 | individual of his or her appointment by first class mail. A | ||||||
22 | nomination shall not be rejected except for good cause shown. | ||||||
23 | If a nomination is rejected, the Speaker of the House of | ||||||
24 | Representatives or the Minority Leader of the House of | ||||||
25 | Representatives, whichever the case may be, shall state in | ||||||
26 | writing the reason or reasons that the nomination was rejected, |

1 | and transmit the written rejection to the nominated individual | ||||||
2 | and the Senator that nominated the individual. In such a case, | ||||||
3 | the Senator shall nominate another qualified individual within | ||||||
4 | 5 days. | ||||||
5 | (d) Each Council member's term shall be for one year. A | ||||||
6 | member shall be allowed to serve more than one term, so long as | ||||||
7 | the member continues to meet the requirements for being a | ||||||
8 | member and is appointed for each term. | ||||||
9 | (e) Any vacancies in the Council shall be filled in the | ||||||
10 | same or substantially the same manner as the original | ||||||
11 | appointment within 30 days after the vacancy. | ||||||
12 | Section 20. Members; qualifications. Each member of the | ||||||
13 | Council shall, during his or her term, be: | ||||||
14 | (1) a resident of this State; | ||||||
15 | (2) older than 16 years of age and younger than 22 | ||||||
16 | years of age, except that if a member turns 23 years of age | ||||||
17 | during his or her term, such member shall be allowed to | ||||||
18 | complete the term; and | ||||||
19 | (3) be a student enrolled at a high school, community | ||||||
20 | college, or university in this State, except that if a | ||||||
21 | member graduates from high school or college during his or | ||||||
22 | her term, such member shall be allowed to complete the | ||||||
23 | term. | ||||||
24 | Section 25. Quorum; meetings; committees; leadership |

1 | responsibilities. | ||||||
2 | (a) A majority of those appointed to the Council shall | ||||||
3 | constitute a quorum. | ||||||
4 | (b) The Council shall convene each year on the Saturday | ||||||
5 | following the second Wednesday of January in the State Capitol, | ||||||
6 | unless the General Assembly is in session. An alternative | ||||||
7 | meeting place shall be selected if one or both chambers cannot | ||||||
8 | accommodate the meeting. At the initial meeting, the Council | ||||||
9 | shall: | ||||||
10 | (1) elect a President, Secretary, Treasurer, and | ||||||
11 | Clerk; | ||||||
12 | (2) adopt rules of procedure; | ||||||
13 | (3) form committees to assist in furthering the goals | ||||||
14 | of the Council, and appoint committee chairs and | ||||||
15 | vice-chairs; and | ||||||
16 | (4) announce the date and location of the next meeting | ||||||
17 | of the Council. | ||||||
18 | (c) The Council shall meet as often as is deemed necessary. | ||||||
19 | For all other meetings and committee meetings, the Council may | ||||||
20 | meet by electronic or telephonic means. Members of the Council | ||||||
21 | shall be excused from school to participate in in-person | ||||||
22 | meetings of the Council. | ||||||
23 | (d) The President of the Council shall: | ||||||
24 | (1) convene, direct, and adjourn meetings of the | ||||||
25 | Council; | ||||||
26 | (2) call for a vote on any matter pending before the |

1 | Council; | ||||||
2 | (3) transmit Council reports to the General Assembly; | ||||||
3 | and | ||||||
4 | (4) be the official liaison between the Council and | ||||||
5 | General Assembly. | ||||||
6 | (e) The Secretary of the Council shall: | ||||||
7 | (1) serve as Acting President in the President's | ||||||
8 | absence; | ||||||
9 | (2) prepare and distribute agendas of Council meetings | ||||||
10 | to Council members; and | ||||||
11 | (3) keep and maintain the minutes of Council meetings. | ||||||
12 | (f) The Treasurer of the Council shall: | ||||||
13 | (1) report on the funds available in the Illinois | ||||||
14 | Legislative Youth Advisory Council Fund; and | ||||||
15 | (2) serve as the official liaison between the Council | ||||||
16 | and the State Treasurer and the State Comptroller. | ||||||
17 | (g) The Clerk of the Council shall: | ||||||
18 | (1) record the final votes on any measure called for a | ||||||
19 | vote by the President; and | ||||||
20 | (2) transmit the final vote on all measures called for | ||||||
21 | a vote by the President to the Secretary for inclusion in | ||||||
22 | the minutes. | ||||||
23 | (h) The President in transition shall be appointed by the | ||||||
24 | President of the Senate within 14 days after the effective date | ||||||
25 | of this Act. The President in transition shall meet the | ||||||
26 | qualifications set forth in Section 20 of this Act, and shall |

1 | serve until the second Wednesday of the
January following the | ||||||
2 | effective date of this Act. The President in transition shall | ||||||
3 | be responsible for initial outreach and marketing of the | ||||||
4 | Council to the youth of Illinois. The President in transition | ||||||
5 | may use the provisions of Section 35 of this Act to facilitate | ||||||
6 | these duties. | ||||||
7 | (i) The Council may create more leadership positions by | ||||||
8 | rule. | ||||||
9 | Section 30. Powers. The Council may: | ||||||
10 | (1) request the drafting of legislative measures from | ||||||
11 | the Legislative Reference Bureau; | ||||||
12 | (2) provide testimony during any committee meeting of | ||||||
13 | the General Assembly; | ||||||
14 | (3) vote on any matter pending before the General
| ||||||
15 | Assembly and inform the General Assembly of the Council's | ||||||
16 | position on the matter; | ||||||
17 | (4) draft reports and advisory opinions to the General | ||||||
18 | Assembly; | ||||||
19 | (5) perform any other activity that may reasonably | ||||||
20 | inform the General Assembly of the Council's position on | ||||||
21 | any issue of relevance; and | ||||||
22 | (6) conduct periodic seminars for members of the | ||||||
23 | Council concerning leadership, government, and the General | ||||||
24 | Assembly. |

1 | Section 35. Outreach. | ||||||
2 | (a) On or before September 1 of each year, the President of | ||||||
3 | the Council shall notify all high schools, colleges, and | ||||||
4 | universities in this State that the time for applying to become | ||||||
5 | a member of the Council is open, and shall expire on October | ||||||
6 | 31. The notice shall include the requirements for membership, a | ||||||
7 | copy of the application, and the name, district address, and | ||||||
8 | district phone number of the Senators near the high school, | ||||||
9 | college, or university. | ||||||
10 | (b) Upon receiving notice that the application period is | ||||||
11 | open, the high school, college, or university shall make | ||||||
12 | reasonable attempts to notify interested students of the | ||||||
13 | Council. | ||||||
14 | (c) To raise awareness about the Council, the Council may: | ||||||
15 | (1) conduct a public awareness campaign; | ||||||
16 | (2) maintain a website; and | ||||||
17 | (3) work with established youth groups to increase | ||||||
18 | awareness. | ||||||
19 | Section 40. Staff support. Staff and administrative | ||||||
20 | support for the Council shall be provided by the Office of the | ||||||
21 | Governor or an agency designated by the Governor that is under | ||||||
22 | the jurisdiction of the Governor. Staff members shall be | ||||||
23 | uncompensated and shall assist the Council in administrative | ||||||
24 | duties. |

1 | Section 45. Report to the General Assembly and Governor. | ||||||
2 | The Council shall submit an annual report electronically to the | ||||||
3 | General Assembly and the Governor detailing its activities and | ||||||
4 | recommending any proposed legislation. | ||||||
5 | Section 50. Illinois Legislative Youth Advisory Council | ||||||
6 | Fund. The Illinois Legislative Youth Advisory Council Fund is | ||||||
7 | created as a special fund in the State treasury. All moneys in | ||||||
8 | the Fund shall be used to reimburse Council members for actual | ||||||
9 | expenses incurred in traveling to Council meetings, including | ||||||
10 | travel, food, and lodging, and printing the annual report in | ||||||
11 | compliance with Section 45 of this Act. The moneys in the | ||||||
12 | Illinois Legislative Youth Advisory Council Fund are subject to | ||||||
13 | appropriation by the General Assembly. The Illinois | ||||||
14 | Legislative Youth Advisory Council Fund may accept donations | ||||||
15 | and gifts. | ||||||
16 | Section 95. The State Finance Act is amended by adding | ||||||
17 | Section 5.891 as follows: | ||||||
18 | (30 ILCS 105/5.891 new) | ||||||
19 | Sec. 5.891. The Illinois Legislative Youth Advisory | ||||||
20 | Council Fund.

21 | Section 99. Effective date. This Act takes effect upon | ||||||
22 | becoming law.
