AMENDMENT TO HOUSE BILL 895

2    AMENDMENT NO. ______. Amend House Bill 895, AS AMENDED,
3with reference to page and line numbers of House Amendment No.
42, on page 1, line 5, by deleting "Section 5. The Election Code
5is amended by changing"; and
 
6by deleting line 6 on page 1 through line 9 on page 2; and
 
7on page 109, line 23, by replacing "Crohn's disease" with
8"Crohn's disease (including, but not limited to, ulcerative
9colitis),"; and
 
10on page 130, by replacing lines 2 through 8 with the following:
11        "(1) accept, solicit, or offer any form of remuneration
12    from or to a qualifying patient, primary caregiver,
13    cultivation center, or dispensing organization, including
14    each principal officer, board member, agent, and employee,
15    to certify a patient, other than accepting payment from a

1    patient for the fee associated with the required
2    examination, except for the limited purpose of performing a
3    medical cannabis-related research study;"; and
 
4on page 130, immediately below line 8, by inserting the
5following:
6        "(1.5) accept, solicit, or offer any form of
7    remuneration from or to a medical cannabis cultivation
8    center or dispensary organization for the purposes of
9    referring a patient to a specific dispensary
10    organization;"; and
 
11on page 130, line 9, by replacing "(1.5)" with "(1.10)"; and
 
12on page 132, line 12, by replacing "including certification"
13with "except when the referral is limited to certification
14purposes only"; and
 
15on page 149, line 9, by replacing "18" with "21 18"; and
 
16on page 149, line 11, after "cannabis", by inserting "or
17paraphernalia used for smoking or vaping medical cannabis"; and
 
18on page 169, immediately below line 24, by inserting the
19following:
20    "(q) The Department of Financial and Professional

1Regulation may issue nondisciplinary citations for minor
2violations which may be accompanied by a civil penalty not to
3exceed $10,000 per violation. The penalty shall be a civil
4penalty or other condition as established by rule. The citation
5shall be issued to the licensee and shall contain the
6licensee's name, address, and license number, a brief factual
7statement, the Sections of the law or rule allegedly violated,
8and the civil penalty, if any, imposed. The citation must
9clearly state that the licensee may choose, in lieu of
10accepting the citation, to request a hearing. If the licensee
11does not dispute the matter in the citation with the Department
12of Financial and Professional Regulation within 30 days after
13the citation is served, then the citation shall become final
14and shall not be subject to appeal.".
