Amends the Illinois Vehicle Code. Provides that, beginning with the next registration year after the effective date in which the Secretary of State distributes newly designed standard registration plates for motor vehicles, the Secretary of State shall issue one registration plate (instead of 2) for newly registered motor vehicles and the registration plate shall be attached to the rear (instead of front and rear) of the motor vehicle. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Vehicle Code is amended by changing |
5 | | Sections 1-171, 3-412, and 3-413 as follows:
|
6 | | (625 ILCS 5/1-171) (from Ch. 95 1/2, par. 1-171)
|
7 | | Sec. 1-171. Registration - Registration Sticker. |
8 | | Registration. The registration certificate or certificates, |
9 | | registration
plates and registration stickers issued under the |
10 | | laws of this State pertaining
to the registration of vehicles.
|
11 | | Registration Sticker or Stickers. A device or devices to be |
12 | | attached to
a rear registration plate that will renew the |
13 | | registration and registration
plate or plates for a |
14 | | pre-determined period not to exceed one registration
year |
15 | | except as provided in subsection (1) of Section 3-414 of this |
16 | | Code.
Should the Secretary of State determine it is advisable |
17 | | to require a registration
sticker to be attached to a front |
18 | | registration plate, he may require such
action and provide the |
19 | | necessary additional sticker. Such determination
shall be |
20 | | publicly announced at least 30 days in advance of a new annual
|
21 | | registration year.

22 | | Beginning with the next registration year after the |
23 | | effective date of this amendatory Act of the 101st General |

9 | | Sec. 3-412. Registration plates and registration stickers |
10 | | to be
furnished by the Secretary of State. |
11 | | (a) The Secretary of State upon registering a vehicle |
12 | | subject to annual
registration for the first time shall issue |
13 | | or shall cause to be issued to the
owner one registration plate |
14 | | for a motorcycle, trailer, semitrailer, moped, autocycle, or |
15 | | truck-tractor, 2 registration plates for other motor vehicles
|
16 | | and, where applicable, current registration stickers for motor |
17 | | vehicles of the
first division. Beginning with the next |
18 | | registration year after the effective date of this amendatory |
19 | | Act of the 101st General Assembly in which the Secretary of |
20 | | State distributes newly designed standard registration plates |
21 | | for motor vehicles, the Secretary of State upon registering a |
22 | | vehicle subject to annual
registration for the first time shall |
23 | | issue or shall cause to be issued to the
owner one registration |
24 | | plate for a motorcycle, trailer, semitrailer, motorized
|
25 | | pedalcycle or truck-tractor, one registration plate for other |

and, when applicable, current registration |
2 | | stickers for motor vehicles of the
first division. |
3 | | The provisions of this Section may be made applicable to |
4 | | such
vehicles of the second division, as the Secretary of State |
5 | | may, from time to
time, in his discretion designate. On |
6 | | subsequent annual registrations
during the term of the |
7 | | registration plate as provided in Section 3-414.1, the
|
8 | | Secretary shall issue or cause to be issued registration |
9 | | stickers as evidence
of current registration. However, the |
10 | | issuance of annual registration stickers
to vehicles |
11 | | registered under the provisions of Sections 3-402.1 and 3-405.3 |
12 | | of
this Code may not be required if the Secretary deems the |
13 | | issuance unnecessary.
|
14 | | (b) Every registration plate shall have displayed upon it |
15 | | the registration
number assigned to the vehicle for which it is |
16 | | issued, the name of this State,
which may be abbreviated, the |
17 | | year number for which it was issued, which may
be abbreviated, |
18 | | the phrase "Land of Lincoln" (except as otherwise provided in
|
19 | | this Code), and such other letters or numbers as the Secretary
|
20 | | may prescribe. However, for apportionment plates issued to |
21 | | vehicles registered
under Section 3-402.1 and fleet plates |
22 | | issued to vehicles registered under
Section 3-405.3, the phrase |
23 | | "Land of Lincoln" may be omitted to allow for
the word |
24 | | "apportioned", the word "fleet", or other similar language to |
25 | | be
displayed. Registration plates issued to a vehicle |
26 | | registered as a fleet
vehicle may display a designation |

1 | | determined by the Secretary.
|
2 | | The Secretary may in his discretion prescribe
that letters |
3 | | be used as prefixes only on registration plates issued to |
4 | | vehicles
of the first division which are registered under this |
5 | | Code and only as suffixes
on registration plates issued to |
6 | | other vehicles. Every registration sticker
issued as evidence |
7 | | of current registration shall designate the year number
for |
8 | | which it is issued and such other letters or numbers as the |
9 | | Secretary may
prescribe and shall be of a contrasting color |
10 | | with the registration plates and
registration stickers of the |
11 | | previous year.
|
12 | | (c) Each registration plate and the required letters and |
13 | | numerals thereon,
except the year number for which issued, |
14 | | shall be of sufficient size to be
plainly readable from a |
15 | | distance of 100 feet during daylight, and shall be
coated with |
16 | | reflectorizing material. The dimensions of the plate issued to
|
17 | | vehicles of the first division shall be 6 by 12 inches.
|
18 | | (d) The Secretary of State shall issue for every passenger |
19 | | motor vehicle
rented without a driver the same type of |
20 | | registration plates as the type of
plates issued for a private |
21 | | passenger vehicle.
|
22 | | (e) The Secretary of State shall issue for every passenger
|
23 | | car used as a taxicab or livery, distinctive registration |
24 | | plates.
|
25 | | (f) The Secretary of State shall issue for every motorcycle
|
26 | | distinctive registration plates distinguishing between
|

1 | | motorcycles having 150 or more cubic centimeters piston
|
2 | | displacement, or having less than 150 cubic centimeter
piston |
3 | | displacement.
|
4 | | (g) Registration plates issued to vehicles for-hire may
|
5 | | display a designation as determined by the Secretary that
such |
6 | | vehicles are for-hire.
|
7 | | (h) (Blank).
|
8 | | (i) The Secretary of State shall issue for every public and |
9 | | private
ambulance registration plates identifying the vehicle |
10 | | as an ambulance.
The Secretary shall forward to the Department |
11 | | of Healthcare and Family Services registration
information for |
12 | | the purpose of verification of claims filed with the
Department |
13 | | by ambulance owners for payment for services to public |
14 | | assistance
recipients.

15 | | (j) The Secretary of State shall issue for every public and |
16 | | private
medical carrier or rescue vehicle livery registration |
17 | | plates displaying
numbers within ranges of numbers reserved |
18 | | respectively for medical carriers
and rescue vehicles. The |
19 | | Secretary shall forward to the Department of Healthcare and |
20 | | Family Services registration information for the purpose of |
21 | | verification of claims filed
with the Department by owners of |
22 | | medical carriers or rescue vehicles for
payment for services to |
23 | | public assistance recipients.

24 | | (k) The Secretary of State shall issue distinctive license |
25 | | plates or distinctive license plate stickers for every vehicle |
26 | | exempted from subsections (a) and (a-5) of Section 12-503 by |

1 | | subsection (g) of that Section, and by subsection (g-5) of that |
2 | | Section before its deletion by this amendatory Act of the 95th |
3 | | General Assembly. The Secretary shall issue these plates or |
4 | | stickers immediately upon receiving the physician's |
5 | | certification required under subsection (g) of Section 12-503. |
6 | | New plates or stickers shall also be issued when the |
7 | | certification is renewed as provided in that subsection.
|
8 | | (l) The Secretary of State shall issue distinctive |
9 | | registration plates for low-speed vehicles. |
10 | | (m) The Secretary of State shall issue distinctive |
11 | | registration plates for autocycles. The dimensions of the plate |
12 | | issued to autocycles shall be 4 by 7 inches. |

15 | | Sec. 3-413. Display of registration plates, registration |
16 | | stickers,
and drive-away permits; registration plate covers. |
17 | | (a) Registration plates issued for a
motor vehicle other |
18 | | than a motorcycle, autocycle, trailer, semitrailer,
|
19 | | truck-tractor, apportioned bus, or apportioned truck shall be |
20 | | attached
thereto, one in the front and one in the
rear. |
21 | | Beginning with the next registration year after the effective |
22 | | date of this amendatory Act of the 101st General Assembly in |
23 | | which the Secretary of State distributes newly designed |
24 | | standard registration plates for motor vehicles, the |
25 | | registration plate issued for a
motor vehicle other than a |

1 | | motorcycle, trailer, semitrailer,
truck-tractor, apportioned |
2 | | bus, or apportioned truck shall be attached
to the rear of the |
3 | | vehicle. |
4 | | The registration plate issued for a motorcycle, autocycle, |
5 | | trailer or
semitrailer required to be registered hereunder and |
6 | | any apportionment
plate issued to a bus under the provisions of |
7 | | this Code shall be attached
to the rear thereof. |
8 | | The registration plate issued for a truck-tractor or
an |
9 | | apportioned truck required to be registered hereunder shall be
|
10 | | attached to the front thereof.
|
11 | | (b) Except for vehicles with rear loaded motorized |
12 | | forklifts, every registration plate shall at all times be |
13 | | securely fastened
in a horizontal position to the vehicle for |
14 | | which it is issued so as to
prevent the plate from swinging and |
15 | | at a height of not less than 5
inches from the ground, |
16 | | measuring from the bottom of such plate, in a
place and |
17 | | position to be clearly visible and shall be maintained in a
|
18 | | condition to be clearly legible, free
from any materials that |
19 | | would obstruct the visibility of the plate. A registration |
20 | | plate on a motorcycle may be mounted vertically as long as it |
21 | | is otherwise clearly visible. Registration stickers issued as
|
22 | | evidence of renewed annual registration shall be attached to |
23 | | registration
plates as required by the Secretary of State, and |
24 | | be clearly visible at
all times. For those vehicles with rear |
25 | | loaded motorized forklifts, if the rear plate is securely |
26 | | fastened in a horizontal position as prescribed, the plate and |

1 | | registration sticker shall not be required to be clearly |
2 | | visible at all times as a result of the rear mounted motorized |
3 | | forklift obstructing the view.
|
4 | | (c) Every drive-away permit issued pursuant to this
Code |
5 | | shall
be firmly attached to the motor vehicle in the manner |
6 | | prescribed by the Secretary of State. If a drive-away permit is |
7 | | affixed to a motor vehicle in any other manner the
permit shall |
8 | | be void and of no effect.
|
9 | | (d) The Illinois prorate decal issued to a foreign |
10 | | registered
vehicle part of a fleet prorated or apportioned with |
11 | | Illinois, shall be
displayed on a registration plate and |
12 | | displayed on the front of such
vehicle in the same manner as an |
13 | | Illinois registration plate.
|
14 | | (e) The registration plate issued for a camper body mounted |
15 | | on a
truck displaying registration plates shall be attached to |
16 | | the rear of
the camper body.
|
17 | | (f) No person shall operate a vehicle, nor permit the |
18 | | operation of a
vehicle, upon which is displayed an Illinois |
19 | | registration plate, plates
or registration stickers, except as |
20 | | provided for in subsection (b) of Section 3-701 of this Code, |
21 | | after the termination of the registration
period for which |
22 | | issued or after the expiration date set pursuant to
Sections |
23 | | 3-414 and 3-414.1 of this Code.
|
24 | | (g) A person may not operate any motor vehicle that is |
25 | | equipped with registration plate covers. A violation of this |
26 | | subsection (g) or a similar provision of a local ordinance is |
|

1 | | an offense against laws and ordinances regulating the movement |
2 | | of traffic. |
3 | | (h) A person may not sell or offer for sale a registration |
4 | | plate cover. A violation of this subsection (h) is a business |
5 | | offense. |
6 | | (i) A person may not advertise for the purpose of promoting |
7 | | the sale of registration plate covers. A violation of this |
8 | | subsection (i) is a business offense. |
9 | | (j) A person may not modify the original manufacturer's |
10 | | mounting location of the rear registration plate on any vehicle |
11 | | so as to conceal the registration or to knowingly cause it to |
12 | | be obstructed in an effort to hinder a peace officer from |
13 | | obtaining the registration for the enforcement of a violation |
14 | | of this Code, Section 27.1 of the Toll Highway Act concerning |
15 | | toll evasion, or any municipal ordinance. Modifications |
16 | | prohibited by this subsection (j) include but are not limited |
17 | | to the use of an electronic device. A violation of this |
18 | | subsection (j) is a Class A misdemeanor. |

21 | | Section 99. Effective date. This Act takes effect upon |
22 | | becoming law.
