AMENDMENT TO HOUSE BILL 1874

2    AMENDMENT NO. ______. Amend House Bill 1874 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Finance Act is amended by adding
5Section 6z-107 as follows:
 
6    (30 ILCS 105/6z-107 new)
7    Sec. 6z-107. Roadside Memorial Fund. Money in the Roadside
8Memorial Fund, created by Public Act 96-667, shall be used by
9the Department of Transportation to pay fees imposed under
10subsection (f) of Section 20 of the Roadside Memorial Act, for
11veterans tombstone reimbursement, and for impaired driving
12prevention programs. 85% of money deposited into the Roadside
13Memorial Fund shall be distributed to the Department of
14Veterans' Affairs for tombstone reimbursement; 12% shall be
15used for impaired driving probation programs; and 3% shall be
16used for memorial markers on any State, municipal, township, or

1county road.
 
2    Section 10. The Criminal and Traffic Assessment Act is
3amended by changing Sections 15-10 and 15-30 as follows:
 
4    (705 ILCS 135/15-10)
5    (This Section may contain text from a Public Act with a
6delayed effective date)
7    (Section scheduled to be repealed on January 1, 2021)
8    Sec. 15-10. SCHEDULE 2; felony DUI offenses.
9    SCHEDULE 2: For a felony under Section 11-501 of the
10Illinois Vehicle Code, Section 5-7 of the Snowmobile
11Registration and Safety Act, Section 5-16 of the Boat
12Registration and Safety Act, or a similar provision of a local
13ordinance, the Clerk of the Circuit Court shall collect $1,709
14and remit as follows:
15    (1) As the county's portion, $399 to the county treasurer,
16who shall deposit the money as follows:
17        (A) $20 into the Court Automation Fund;
18        (B) $20 into the Court Document Storage Fund;
19        (C) $5 into the Circuit Court Clerk Operation and
20    Administrative Fund;
21        (D) $300 into the county's General Fund;
22        (E) $10 into the Child Advocacy Center Fund;
23        (F) $2 into the State's Attorney Records Automation
24    Fund;

1        (G) $2 into the Public Defender Records Automation
2    Fund;
3        (H) $20 into the County Jail Medical Costs Fund; and
4        (I) $20 into the Probation and Court Services Fund.
5    (2) As the State's portion, $1,160 $1,110 to the State
6Treasurer, who shall deposit the money as follows:
7        (A) $730 into the State Police Operations Assistance
8    Fund;
9        (B) $5 into the Drivers Education Fund;
10        (C) $100 into the Trauma Center Fund;
11        (D) $5 into the Spinal Cord Injury Paralysis Cure
12    Research Trust Fund;
13        (E) $5 into the State Police Merit Board Public Safety
14    Fund;
15        (F) $160 into the Traffic and Criminal Conviction
16    Surcharge Fund;
17        (G) $5 into the Law Enforcement Camera Grant Fund; and
18        (H) $100 into the Violent Crime Victims Assistance
19    Fund; and .
20        (I) $50 into the Roadside Memorial Fund.
21    (3) As the arresting agency's portion, $200 to the
22treasurer of the unit of local government of the arresting
23agency, who shall deposit the money into the DUI Fund of that
24unit of local government or as provided in subsection (c) of
25Section 10-5 of this Act if the arresting agency is a State
26agency, unless more than one agency is responsible for the

1arrest in which case the amount shall be remitted to each unit
2of government equally.

9    SCHEDULE 6: For a misdemeanor under Section 11-501 of the
10Illinois Vehicle Code, Section 5-7 of the Snowmobile
11Registration and Safety Act, Section 5-16 of the Boat
12Registration and Safety Act, or a similar provision of a local
13ordinance, the Clerk of the Circuit Court shall collect $1,381
14and remit as follows:
15    (1) As the county's portion, $322 to the county treasurer,
16who shall deposit the money as follows:
17        (A) $20 into the Court Automation Fund;
18        (B) $20 into the Court Document Storage Fund;
19        (C) $5 into the Circuit Court Clerk Operation and
20    Administrative Fund;
21        (D) $8 into the Circuit Court Clerk Electronic Citation
22    Fund;
23        (E) $225 into the county's General Fund;
24        (F) $10 into the Child Advocacy Center Fund;
25        (G) $2 into the State's Attorney Records Automation

1    Fund;
2        (H) $2 into the Public Defenders Records Automation
3    Fund;
4        (I) $10 into the County Jail Medical Costs Fund; and

7Treasurer, who shall deposit the money as follows:
8        (A) $330 into the State Police Operations Assistance
9    Fund;
10        (B) $5 into the Drivers Education Fund;
11        (C) $5 into the State Police Merit Board Public Safety
12    Fund;
13        (D) $100 into the Trauma Center Fund;
14        (E) $5 into the Spinal Cord Injury Paralysis Cure
15    Research Trust Fund;
16        (F) $22 into the Fire Prevention Fund;
17        (G) $160 into the Traffic and Criminal Conviction
18    Surcharge Fund;
19        (H) $5 into the Law Enforcement Camera Grant Fund; and
20        (I) $75 into the Violent Crime Victims Assistance Fund;
21    and .
22        (J) $50 into the Roadside Memorial Fund.
23    (3) As the arresting agency's portion, $352 as follows,
24unless more than one agency is responsible for the arrest in
25which case the amount shall be remitted to each unit of
26government equally:

1        (A) if the arresting agency is a local agency, to the
2    treasurer of the unit of local government of the arresting
3    agency, who shall deposit the money as follows:
4            (i) $2 into the E-citation Fund of the unit of
5        local government; and
6            (ii) $350 into the DUI Fund of the unit of local
7        government; or
8        (B) as provided in subsection (c) of Section 10-5 of
9    this Act if the arresting agency is a State agency.

11    Section 99. Effective date. This Act takes effect July 1,
122019.".
