    Amends the Illinois Vehicle Code. Deletes language allowing the Department of Transportation to designate streets or highways in the system of State highways as Class III highways and makes changes governing the designation of Class II highways. Deletes language regarding: the maximum length of vehicles on all non-State highways; and the highways that vehicles not exceeding 65 feet in overall length are allowed to access. Provides that combinations of vehicles over 65 feet in length with no overall length limitation are allowed certain access if there is no sign prohibiting access and the route is not being used as a thoroughfare between Class I or Class II highways. Provides that the maximum length limitation on non-designated highways for a truck tractor in combination with a semitrailer is 65 feet overall dimension and 60 feet overall dimension for a truck tractor-semitrailer-trailer or truck tractor semitrailer-semitrailer. Provides that length limitations do not apply on legal holidays and for a tow truck in combination with a disabled vehicle or combination of disabled vehicles. Provides that a unit of local government shall affirm to the Department if it has no Class II designated truck routes. Provides that units of local government may report to the Department, and the Department shall post on its website, any limitations prohibiting the operation of vehicles imposed by ordinance or resolution in the unit of local government's non-designated highway system. Provides that, to be effective, an ordinance or resolution designating a Class II roadway need not require that signs be erected, but the designation shall be reported to the Department. Repeals a provision that requires local units of government to report to the Department all preferred truck routes, designated truck route networks, or whether there are no such truck routes.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Sections 1-126.1, 15-107, 15-116, and 15-316 as follows:
 
6    (625 ILCS 5/1-126.1)
7    Sec. 1-126.1. Highway Designations. The Department of
8Transportation may designate streets or highways in the system
9of State highways as follows:
10        (a) Class I highways include interstate highways,
11    expressways, tollways, and other highways deemed
12    appropriate by the Department department.
13        (b) Class II highways include State highways and
14    designated local roads major arterials not built to
15    interstate highway standards that have at least 11 feet
16    lane widths.
17        (c) (Blank). Class III highways include those State
18    highways that have lane widths of less than 11 feet.
19        (d) Non-designated highways include State highways not
20    designated as Class I or II and are highways in the system
21    of State highways not designated as Class I, II, or III, or
22    local highways which are part of any county, township,
23    municipal, or district road system not designated as Class

1    II. Local authorities also may designate Class II or Class
2    III highways within their systems of highways.

5    Sec. 15-107. Length of vehicles.
6    (a) The maximum length of a single vehicle on any highway
7of this State may not exceed 42 feet except the following:
8        (1) Semitrailers.
9        (2) Charter or regulated route buses may be up to 45
10    feet in length, not including energy absorbing bumpers.
11    (a-1) A motor home as defined in Section 1-145.01 may be up
12to 45 feet in length, not including energy absorbing bumpers.
13The length limitations described in this subsection (a-1) shall
14be exclusive of energy-absorbing bumpers and rear view mirrors.
15    (b) (Blank). On all non-State highways, the maximum length
16of vehicles in combinations is as follows:
17        (1) A truck tractor in combination with a semitrailer
18    may not exceed 65 feet overall dimension. An agency or
19    instrumentality of the State of Illinois or any unit of
20    local government shall not be required to widen or
21    otherwise alter a non-State highway constructed before the
22    effective date of this amendatory Act of the 100th General
23    Assembly to accommodate truck tractors under this
24    paragraph (1).
25        (2) A truck tractor-semitrailer-trailer or truck

1    tractor semitrailer-semitrailer may not exceed 60 feet
2    overall dimension.
3        (3) Combinations specially designed to transport motor
4    vehicles or boats may not exceed 60 feet overall dimension.
5        (4) The distance between the kingpin and the center
6    axle of a semitrailer longer than 48 feet, in combination
7    with a truck tractor, may not exceed 42 feet 6 inches. The
8    limit contained in this paragraph (4) shall not apply to
9    trailers or semitrailers used for the transport of
10    livestock as defined by Section 18b-101.
11    Vehicles operating during daylight hours when transporting
12poles, pipes, machinery, or other objects of a structural
13nature that cannot readily be dismembered are exempt from
14length limitations, provided that no object may exceed 80 feet
15in length and the overall dimension of the vehicle including
16the load may not exceed 100 feet. This exemption does not apply
17to operation on a Saturday, Sunday, or legal holiday. Legal
18holidays referred to in this Section are the days on which the
19following traditional holidays are celebrated: New Year's Day;
20Memorial Day; Independence Day; Labor Day; Thanksgiving Day;
21and Christmas Day.
22    Vehicles and loads operated by a public utility while en
23route to make emergency repairs to public service facilities or
24properties are exempt from length limitations, provided that
25during night operations every vehicle and its load must be
26equipped with a sufficient number of clearance lamps on both

1sides and marker lamps on the extreme ends of any projecting
2load to clearly mark the dimensions of the load.
3    A tow truck in combination with a disabled vehicle or
4combination of disabled vehicles, as provided in paragraph (6)
5of subsection (c) of this Section, is exempt from length
6limitations.
7    All other combinations not listed in this subsection (b)
8may not exceed 60 feet overall dimension.
9    (c) Except as provided in subsections (c-1) and (c-2),
10combinations of vehicles may not exceed a total of 2 vehicles
11except the following:
12        (1) A truck tractor semitrailer may draw one trailer.
13        (2) A truck tractor semitrailer may draw one converter
14    dolly or one semitrailer.
15        (3) A truck tractor semitrailer may draw one vehicle
16    that is defined in Chapter 1 as special mobile equipment,
17    provided the overall dimension does not exceed 60 feet.
18        (4) A truck in transit may draw 3 trucks in transit
19    coupled together by the triple saddlemount method.
20        (5) Recreational vehicles consisting of 3 vehicles,
21    provided the following:
22            (A) The total overall dimension does not exceed 60
23        feet.
24            (B) The towing vehicle is a properly registered
25        vehicle capable of towing another vehicle using a
26        fifth-wheel type assembly.

1            (C) The second vehicle in the combination of
2        vehicles is a recreational vehicle that is towed by a
3        fifth-wheel assembly. This vehicle must be properly
4        registered and must be equipped with brakes,
5        regardless of weight.
6            (D) The third vehicle must be the lightest of the 3
7        vehicles and be a trailer or semitrailer designed or
8        used for transporting a boat, all-terrain vehicle,
9        personal watercraft, or motorcycle.
10            (E) The towed vehicles may be only for the use of
11        the operator of the towing vehicle.
12            (F) All vehicles must be properly equipped with
13        operating brakes and safety equipment required by this
14        Code, except the additional brake requirement in
15        subdivision (C) of this subparagraph (5).
16        (6) A tow truck in combination with a disabled vehicle
17    or combination of disabled vehicles, provided the towing
18    vehicle:
19            (A) Is specifically designed as a tow truck having
20        a gross vehicle weight rating of at least 18,000 pounds
21        and equipped with air brakes, provided that air brakes
22        are required only if the towing vehicle is towing a
23        vehicle, semitrailer, or tractor-trailer combination
24        that is equipped with air brakes. For the purpose of
25        this subsection, gross vehicle weight rating, or GVWR,
26        means the value specified by the manufacturer as the

1        loaded weight of the tow truck.
2            (B) Is equipped with flashing, rotating, or
3        oscillating amber lights, visible for at least 500 feet
4        in all directions.
5            (C) Is capable of utilizing the lighting and
6        braking systems of the disabled vehicle or combination
7        of vehicles.
8            (D) Does not engage a tow exceeding 50 highway
9        miles from the initial point of wreck or disablement to
10        a place of repair. Any additional movement of the
11        vehicles may occur only upon issuance of authorization
12        for that movement under the provisions of Sections
13        15-301 through 15-318 of this Code.
14        The Department may by rule or regulation prescribe
15    additional requirements regarding length limitations for a
16    tow truck towing another vehicle.
17        For purposes of this Section, a tow-dolly that merely
18    serves as substitute wheels for another legally licensed
19    vehicle is considered part of the licensed vehicle and not
20    a separate vehicle.
21        (7) Commercial vehicles consisting of 3 vehicles,
22    provided the following:
23            (A) The total overall dimension does not exceed 65
24        feet.
25            (B) The towing vehicle is a properly registered
26        vehicle capable of towing another vehicle using a

1        fifth-wheel type assembly or a goose-neck hitch ball.
2            (C) The third vehicle must be the lightest of the 3
3        vehicles and be a trailer or semitrailer.
4            (D) All vehicles must be properly equipped with
5        operating brakes and safety equipment required by this
6        Code.
7            (E) The combination of vehicles must be operated by
8        a person who holds a commercial driver's license (CDL).
9            (F) The combination of vehicles must be en route to
10        a location where new or used trailers are sold by an
11        Illinois or out-of-state licensed new or used trailer
12        dealer.
13    (c-1) A combination of 3 vehicles is allowed access to any
14State designated highway if:
15        (1) the length of neither towed vehicle exceeds 28.5
16    feet;
17        (2) the overall wheel base of the combination of
18    vehicles does not exceed 62 feet; and
19        (3) the combination of vehicles is en route to a
20    location where new or used trailers are sold by an Illinois
21    or out-of-state licensed new or used trailer dealer.
22    (c-2) A combination of 3 vehicles is allowed access from
23any State designated highway onto any county, township, or
24municipal highway for a distance of 5 highway miles for the
25purpose of delivery or collection of one or both of the towed
26vehicles if:

1        (1) the length of neither towed vehicle exceeds 28.5
2    feet;
3        (2) the combination of vehicles does not exceed 40,000
4    pounds in gross weight and 8 feet 6 inches in width;
5        (3) there is no sign prohibiting that access;
6        (4) the route is not being used as a thoroughfare
7    between State designated highways; and
8        (5) the combination of vehicles is en route to a
9    location where new or used trailers are sold by an Illinois
10    or out-of-state licensed new or used trailer dealer.
11    (d) On Class I highways there are no overall length
12limitations on motor vehicles operating in combinations
13provided:
14        (1) The length of a semitrailer, unladen or with load,
15    in combination with a truck tractor may not exceed 53 feet.
16        (2) The distance between the kingpin and the center of
17    the rear axle of a semitrailer longer than 48 feet, in
18    combination with a truck tractor, may not exceed 45 feet 6
19    inches. The limit contained in this paragraph (2) shall not
20    apply to trailers or semi-trailers used for the transport
21    of livestock as defined by Section 18b-101.
22        (3) The length of a semitrailer or trailer, unladen or
23    with load, operated in a truck tractor-semitrailer-trailer
24    or truck tractor semitrailer-semitrailer combination, may
25    not exceed 28 feet 6 inches.
26        (4) Maxi-cube combinations, as defined in Chapter 1,

1    may not exceed 65 feet overall dimension.
2        (5) Combinations of vehicles specifically designed to
3    transport motor vehicles or boats may not exceed 65 feet
4    overall dimension. The length limitation is inclusive of
5    front and rear bumpers but exclusive of the overhang of the
6    transported vehicles, as provided in paragraph (i) of this
7    Section.
8        (6) Stinger-steered semitrailer vehicles specifically
9    designed to transport motor vehicles or boats and
10    automobile transporters, as defined in Chapter 1, may not
11    exceed 80 feet overall dimension. The length limitation is
12    inclusive of front and rear bumpers but exclusive of the
13    overhang of the transported vehicles, as provided in
14    paragraph (i) of this Section.
15        (7) A truck in transit transporting 3 trucks coupled
16    together by the triple saddlemount method may not exceed 97
17    feet overall dimension.
18        (8) A towaway trailer transporter combination may not
19    exceed 82 feet overall dimension.
20    Vehicles operating during daylight hours when transporting
21poles, pipes, machinery, or other objects of a structural
22nature that cannot readily be dismembered are exempt from
23length limitations, provided that no object may exceed 80 feet
24in length and the overall dimension of the vehicle including
25the load may not exceed 100 feet. This exemption does not apply
26to operation on a Saturday, Sunday, or legal holiday. Legal

1holidays referred to in this Section are the days on which the
2following traditional holidays are celebrated: New Year's Day;
3Memorial Day; Independence Day; Labor Day; Thanksgiving Day;

5    Vehicles and loads operated by a public utility while en
6route to make emergency repairs to public service facilities or
7properties are exempt from length limitations, provided that
8during night operations every vehicle and its load must be
9equipped with a sufficient number of clearance lamps on both
10sides and marker lamps on the extreme ends of any projecting
11load to clearly mark the dimensions of the load.
12    A tow truck in combination with a disabled vehicle or
13combination of disabled vehicles, as provided in paragraph (6)
14of subsection (c) of this Section, is exempt from length
15limitations.
16    The length limitations described in this paragraph (d)
17shall be exclusive of safety and energy conservation devices,
18such as bumpers, refrigeration units or air compressors and
19other devices, that the Department may interpret as necessary
20for safe and efficient operation; except that no device
21excluded under this paragraph shall have by its design or use
22the capability to carry cargo.
23    Section 5-35 of the Illinois Administrative Procedure Act
24relating to procedures for rulemaking shall not apply to the
25designation of highways under this paragraph (d).
26    (e) On Class II highways there are no overall length

1limitations on motor vehicles operating in combinations,
2provided:
3        (1) The length of a semitrailer, unladen or with load,
4    in combination with a truck tractor, may not exceed 53 feet
5    overall dimension.
6        (2) The distance between the kingpin and the center of
7    the rear axle of a semitrailer longer than 48 feet, in
8    combination with a truck tractor, may not exceed 45 feet 6
9    inches. The limit contained in this paragraph (2) shall not
10    apply to trailers or semi-trailers used for the transport
11    of livestock as defined by Section 18b-101.
12        (3) A truck tractor-semitrailer-trailer or truck
13    tractor semitrailer-semitrailer combination may not exceed
14    65 feet in dimension from front axle to rear axle.
15        (4) The length of a semitrailer or trailer, unladen or
16    with load, operated in a truck tractor-semitrailer-trailer
17    or truck tractor semitrailer-semitrailer combination, may
18    not exceed 28 feet 6 inches.
19        (5) Maxi-cube combinations, as defined in Chapter 1,
20    may not exceed 65 feet overall dimension.
21        (6) A combination of vehicles, specifically designed
22    to transport motor vehicles or boats, may not exceed 65
23    feet overall dimension. The length limitation is inclusive
24    of front and rear bumpers but exclusive of the overhang of
25    the transported vehicles, as provided in paragraph (i) of
26    this Section.

1        (7) Stinger-steered semitrailer vehicles specifically
2    designed to transport motor vehicles or boats may not
3    exceed 80 feet overall dimension. The length limitation is

6    paragraph (i) of this Section.
7        (8) A truck in transit transporting 3 trucks coupled

8    Local authorities, with respect to streets and highways
9under their jurisdiction, may also by ordinance or resolution
10allow length limitations of this subsection (e).
11    The length limitations described in this paragraph (e)
12shall be exclusive of safety and energy conservation devices,
13such as bumpers, refrigeration units or air compressors and
14other devices, that the Department may interpret as necessary
15for safe and efficient operation; except that no device
16excluded under this paragraph shall have by its design or use
17the capability to carry cargo.
18    Section 5-35 of the Illinois Administrative Procedure Act
19relating to procedures for rulemaking shall not apply to the
20designation of highways under this paragraph (e).
21    (e-1) (Blank). Combinations of vehicles not exceeding 65
22feet overall length are allowed access as follows:
23        (1) From any State designated highway onto any county,
24    township, or municipal highway for a distance of 5 highway
25    miles for the purpose of loading and unloading, provided:
26            (A) The vehicle does not exceed 80,000 pounds in

1        gross weight and 8 feet 6 inches in width.
2            (B) There is no sign prohibiting that access.
3            (C) The route is not being used as a thoroughfare
4        between State designated highways.
5        (2) From any State designated highway onto any county
6    or township highway for a distance of 5 highway miles or
7    onto any municipal highway for a distance of one highway
8    mile for the purpose of food, fuel, repairs, and rest,
9    provided:
10            (A) The vehicle does not exceed 80,000 pounds in
11        gross weight and 8 feet 6 inches in width.
12            (B) There is no sign prohibiting that access.
13            (C) The route is not being used as a thoroughfare
14        between State designated highways.
15    (e-2) Except as provided in subsection (e-3), combinations
16of vehicles over 65 feet in length, with no overall length
17limitation except as provided in subsections (d) and (e) of
18this Section, are allowed access as follows:
19        (1) From a Class I highway onto any street or highway
20    for a distance of one highway mile for the purpose of
21    loading, unloading, food, fuel, repairs, and rest,
22    provided there is no sign prohibiting that access.
23        (2) From a Class I or Class II highway onto any
24    non-designated highway State highway or any locally
25    designated highway for a distance of 5 highway miles for
26    the purpose of loading, unloading, food, fuel, repairs, and

1    rest if:
2            (A) there is no sign prohibiting that access; and
3            (B) the route is not being used as a thoroughfare
4        between Class I or Class II highways.
5    (e-3) Combinations of vehicles over 65 feet in length
6operated by household goods carriers or towaway trailer
7transporter combinations, with no overall length limitations
8except as provided in subsections (d) and (e) of this Section,
9have unlimited access to points of loading, unloading, or
10delivery to or from a manufacturer, distributor, or dealer.
11    (f) On Class III and other non-designated State highways,
12the maximum length limitations for vehicles in combination are
13as follows:
14        (1) A truck tractor in combination with a semitrailer
15    may not exceed 65 feet Truck tractor-semitrailer
16    combinations must comply with a maximum 65 feet extreme
17    overall dimension. An agency or instrumentality of the
18    State of Illinois or any unit of local government shall not
19    be required to widen or otherwise alter a Class III or
20    other non-designated State highway constructed before
21    January 1, 2018 the effective date of this amendatory Act
22    of the 100th General Assembly to accommodate truck
23    tractor-semitrailer combinations under this paragraph (1).
24        (2) Semitrailers, unladen or with load, may not exceed
25    53 feet overall dimension.
26        (3) A truck tractor-semitrailer-trailer or truck

1    tractor semitrailer-semitrailer may not exceed 60 feet No
2    truck tractor-semitrailer-trailer or truck tractor
3    semitrailer-semitrailer combination may exceed 60 feet
4    extreme overall dimension.
5        (4) The distance between the kingpin and the center
6    axle of a semitrailer longer than 48 feet, in combination
7    with a truck tractor, may not exceed 42 feet 6 inches. The
8    limit contained in this paragraph (4) shall not apply to
9    trailers or semi-trailers used for the transport of
10    livestock as defined by Section 18b-101.
11    (g) Length limitations in the preceding subsections of this
12Section 15-107 do not apply to the following:
13        (1) Vehicles operated in the daytime, except on
14    Saturdays, Sundays, or legal holidays, when transporting
15    poles, pipe, machinery, or other objects of a structural
16    nature that cannot readily be dismembered, provided the
17    overall length of vehicle and load may not exceed 100 feet
18    and no object exceeding 80 feet in length may be
19    transported unless a permit has been obtained as authorized
20    in Section 15-301. As used in this Section, "legal holiday"
21    means any of the following days: New Year's Day; Memorial
22    Day; Independence Day; Labor Day; Thanksgiving Day; and
23    Christmas Day.
24        (2) Vehicles and loads operated by a public utility
25    while en route to make emergency repairs to public service
26    facilities or properties, but during night operation every

1    vehicle and its load must be equipped with a sufficient
2    number of clearance lamps on both sides and marker lamps
3    upon the extreme ends of any projecting load to clearly
4    mark the dimensions of the load.
5        (3) A tow truck in combination with a disabled vehicle
6    or combination of disabled vehicles, as provided in
7    paragraph (6) of subsection (c) of this Section, is exempt
8    from length limitations. A tow truck in combination with a
9    disabled vehicle or combination of disabled vehicles,
10    provided the towing vehicle meets the following
11    conditions:
12            (A) It is specifically designed as a tow truck
13        having a gross vehicle weight rating of at least 18,000
14        pounds and equipped with air brakes, provided that air
15        brakes are required only if the towing vehicle is
16        towing a vehicle, semitrailer, or tractor-trailer
17        combination that is equipped with air brakes.
18            (B) It is equipped with flashing, rotating, or
19        oscillating amber lights, visible for at least 500 feet
20        in all directions.
21            (C) It is capable of utilizing the lighting and
22        braking systems of the disabled vehicle or combination
23        of vehicles.
24            (D) It does not engage in a tow exceeding 50 miles
25        from the initial point of wreck or disablement.
26    The Department may by rule or regulation prescribe

1additional requirements regarding length limitations for a tow
2truck towing another vehicle. The towing vehicle, however, may
3tow any disabled vehicle from the initial point of wreck or
4disablement to a point where repairs are actually to occur.
5This movement shall be valid only on State routes. The tower
6must abide by posted bridge weight limits.
7    All other combinations not listed in this subsection (f)
8may not exceed 60 feet overall dimension. For the purpose of
9this subsection, gross vehicle weight rating, or GVWR, shall
10mean the value specified by the manufacturer as the loaded
11weight of the tow truck. Legal holidays referred to in this
12Section shall be specified as the day on which the following
13traditional holidays are celebrated:
14    New Year's Day;
15    Memorial Day;
16    Independence Day;
17    Labor Day;
18    Thanksgiving Day; and
19    Christmas Day.
20    (h) The load upon any vehicle operated alone, or the load
21upon the front vehicle of a combination of vehicles, shall not
22extend more than 3 feet beyond the front wheels of the vehicle
23or the front bumper of the vehicle if it is equipped with a
24front bumper. The provisions of this subsection (h) shall not
25apply to any vehicle or combination of vehicles specifically
26designed for the collection and transportation of waste,

1garbage, or recyclable materials during the vehicle's
2operation in the course of collecting garbage, waste, or
3recyclable materials if the vehicle is traveling at a speed not
4in excess of 15 miles per hour during the vehicle's operation
5and in the course of collecting garbage, waste, or recyclable
6materials. However, in no instance shall the load extend more
7than 7 feet beyond the front wheels of the vehicle or the front
8bumper of the vehicle if it is equipped with a front bumper.
9    (i) The load upon the front vehicle of an automobile
10transporter or a stinger-steered vehicle specifically designed
11to transport motor vehicles shall not extend more than 4 feet
12beyond the foremost part of the transporting vehicle and the
13load upon the rear transporting vehicle shall not extend more
14than 6 feet beyond the rear of the bed or body of the vehicle.
15This paragraph shall only be applicable upon highways
16designated in paragraphs (d) and (e) of this Section.
17    (j) Articulated vehicles comprised of 2 sections, neither
18of which exceeds a length of 42 feet, designed for the carrying
19of more than 10 persons, may be up to 60 feet in length, not
20including energy absorbing bumpers, provided that the vehicles
21are:
22        1. operated by or for any public body or motor carrier
23    authorized by law to provide public transportation
24    services; or
25        2. operated in local public transportation service by
26    any other person and the municipality in which the service

1    is to be provided approved the operation of the vehicle.

10Sec. 15-116. Highway designations Designated truck route
11system.
12    (a) The Department of Transportation shall maintain and
13provide a listing of all Class I and , Class II, and Class III
14designated streets and highways as defined in Chapter 1 of this
15Code.
16    (b) The Department shall also maintain and provide a
17listing of all local streets or highways that have been
18designated Class II or Class III by local agencies.
19    (c) Local agencies shall be responsible for reporting to
20the Department all streets and highways under their
21jurisdiction designated Class II and Class III. Local agencies
22shall also provide to the Department reference contact names
23and telephone numbers.
24    (d) The Department shall also maintain and provide an
25official map of the Designated State Truck Route System that

1includes State and local streets and highways that have been
2designated Class I, or Class II, or Class III.
3    (e) If a unit of local government has no Class II
4designated truck routes, the unit of local government shall
5affirm to the Department that it has no such truck routes.
6    (f) Each unit of local government may report to the
7Department, and the Department shall post on its official
8website, any limitations prohibiting the operation of vehicles
9imposed by ordinance or resolution in the unit of local
10government's non-designated highway system.

13    Sec. 15-316. When the Department or local authority may
14restrict right to use highways.
15    (a) Except as provided in subsection (g), local authorities
16with respect to highways under their jurisdiction may by
17ordinance or resolution prohibit the operation of vehicles upon
18any such highway or impose restrictions as to the weight of
19vehicles to be operated upon any such highway, for a total
20period of not to exceed 90 days, measured in either consecutive
21or nonconsecutive days at the discretion of local authorities,
22in any one calendar year, whenever any said highway by reason
23of deterioration, rain, snow, or other climate conditions will
24be seriously damaged or destroyed unless the use of vehicles
25thereon is prohibited or the permissible weights thereof

1reduced.
2    (b) The local authority enacting any such ordinance or
3resolution shall erect or cause to be erected and maintained
4signs designating the provision of the ordinance or resolution
5at each end of that portion of any highway affected thereby,
6and the ordinance or resolution shall not be effective unless
7and until such signs are erected and maintained. To be
8effective, an ordinance or resolution passed to designate a
9Class II roadway need not require that signs be erected, but
10the designation shall be reported to the Department.
11    (c) Local authorities with respect to highways under their
12jurisdiction may also, by ordinance or resolution, prohibit the
13operation of trucks or other commercial vehicles, or may impose
14limitations as the weight thereof, on designated highways,
15which prohibitions and limitations shall be designated by
16appropriate signs placed on such highways.
17    (c-1) (Blank).
18    (c-5) Highway commissioners, with respect to roads under
19their authority, may not permanently post a road or portion
20thereof at a reduced weight limit unless the decision to do so
21is made in accordance with Section 6-201.22 of the Illinois
22Highway Code.
23    (d) The Department shall likewise have authority as
24hereinbefore granted to local authorities to determine by
25resolution and to impose restrictions as to the weight of
26vehicles operated upon any highway under the jurisdiction of

1said department, and such restrictions shall be effective when
2signs giving notice thereof are erected upon the highway or
3portion of any highway affected by such resolution.

6    (e) When any vehicle is operated in violation of this
7Section, the owner or driver of the vehicle shall be deemed
8guilty of a violation and either the owner or the driver of the
9vehicle may be prosecuted for the violation. Any person, firm,
10or corporation convicted of violating this Section shall be
11fined $50 for any weight exceeding the posted limit up to the
12axle or gross weight limit allowed a vehicle as provided for in
13subsections (a) or (b) of Section 15-111 and $75 per every 500
14pounds or fraction thereof for any weight exceeding that which
15is provided for in subsections (a) or (b) of Section 15-111.
16    (f) A municipality is authorized to enforce a county weight
17limit ordinance applying to county highways within its
18corporate limits and is entitled to the proceeds of any fines
19collected from the enforcement.
20    (g) An ordinance or resolution enacted by a county or
21township pursuant to subsection (a) of this Section shall not
22apply to cargo tank vehicles with two or three permanent axles
23when delivering propane for emergency heating purposes if the
24cargo tank is loaded at no more than 50 percent capacity, the
25gross vehicle weight of the vehicle does not exceed 32,000
26pounds, and the driver of the cargo tank vehicle notifies the

1appropriate agency or agencies with jurisdiction over the
2highway before driving the vehicle on the highway pursuant to
3this subsection. The cargo tank vehicle must have an operating
4gauge on the cargo tank which indicates the amount of propane
5as a percent of capacity of the cargo tank. The cargo tank must
6have the capacity displayed on the cargo tank, or documentation
7of the capacity of the cargo tank must be available in the
8vehicle. For the purposes of this subsection, propane weighs
94.2 pounds per gallon. This subsection does not apply to
10municipalities. Nothing in this subsection shall allow cargo
11tank vehicles to cross bridges with posted weight restrictions
12if the vehicle exceeds the posted weight limit.
