| 1 | AMENDMENT TO HOUSE BILL 2438

| 2 | AMENDMENT NO. ______. Amend House Bill 2438, AS AMENDED, by | ||||||
| 3 | inserting immediately above Section 5 the following:
| ||||||
| 4 | "Section 2. The University of Illinois Hospital Act is | ||||||
| 5 | amended by adding Section 8b as follows: | ||||||
| 6 | (110 ILCS 330/8b new) | ||||||
| 7 | Sec. 8b. Mental health services for physicians. | ||||||
| 8 | Notwithstanding any other law to the contrary, the University | ||||||
| 9 | of Illinois Hospital shall provide mental health services to a | ||||||
| 10 | physician providing health care services in the University of | ||||||
| 11 | Illinois Hospital who is responsible for a medical error, | ||||||
| 12 | including a medical error resulting in the death of a patient. | ||||||
| 13 | Section 4. The Hospital Licensing Act is amended by adding | ||||||
| 14 | Section 6.27 as follows: | ||||||

| 1 | (210 ILCS 85/6.27 new) | ||||||
| 2 | Sec. 6.27. Mental health services for physicians. | ||||||
| 3 | Notwithstanding any other law to the contrary, a hospital | ||||||
| 4 | licensed under this Act shall provide mental health services to | ||||||
| 5 | a physician providing health care services in that hospital who | ||||||
| 6 | is responsible for a medical error, including a medical error | ||||||
| 7 | resulting in the death of a patient.".
