New Act
505 ILCS 30/3  from Ch. 56 1/2, par. 66.3

    Creates Prohibit Animal Remains in Pet Food Act. Provides that pet food is prohibited in the State if it contains: (1) any animal remains from an animal that has been euthanized by the use of any drug injected intravenously or through a nonvascular route; or (2) any dog or cat remains, regardless of how the dog or cat was killed. Makes conforming changes to the Illinois Commercial Feed Act of 1961. Effective immediately.

1    AN ACT concerning pet food.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Prohibit Animal Remains in Pet Food Act.
 
6    Section 5. Prohibitions; pet food. Pet food is prohibited
7in this State if it contains: (1) any animal remains from an
8animal that has been euthanized by the use of any drug injected
9intravenously or through a nonvascular route; or (2) any dog or
10cat remains, regardless of how the dog or cat was killed.
 
11    Section 50. The Illinois Commercial Feed Act of 1961 is
12amended by changing Section 3 as follows:
 
13    (505 ILCS 30/3)  (from Ch. 56 1/2, par. 66.3)
14    Sec. 3. Definitions of words and terms. When used in this
15Act unless the context otherwise requires:
16    (a) The term "person" means any individual, partnership,
17corporation and association.
18    (b) The term "distribute" means to offer for sale, sell,
19exchange, give away or barter commercial feed or to supply,
20furnish or otherwise provide commercial feed to a contract
21feeder.

1    (c) The term "distributor" means any person who
2distributes.
3    (d) The term "commercial feed" means all materials,
4including customer formula feeds, which are distributed for use
5as feed, or labeled with a guaranteed analysis for use as feed,
6or for mixing in feed for birds or animals other than man
7except:
8        (1) Whole unmixed seed or grain or physically altered
9    entire unmixed seed or grain, providing such seed or grain
10    is not adulterated within the meaning of Section 7 of this
11    Act.
12        (2) Unground hay, straw, stover, silage, cobs, husks
13    and hulls when not mixed with other materials and not
14    adulterated within the meaning of Section 7 of this Act.
15        (3) Individual chemical compounds when not mixed with
16    other materials and not adulterated within the meaning of
17    Section 7 of this Act.
18    (e) The term "feed ingredient" means each of the
19constituent materials making up a commercial feed.
20    (f) The term "mineral feed" means a commercial feed
21intended to supply primarily mineral elements or inorganic
22nutrients.
23    (g) The term "drug" means any article intended for use in
24the diagnosis, cure, mitigation, treatment, or prevention of
25disease in animals other than man and articles other than feed
26intended to affect the structure or any function of the

1animal's body.
2    (h) The term "customer-formula feed" means commercial feed
3which consists of a mixture of commercial feeds and/or feed
4ingredients each batch of which mixture is mixed according to
5the specific instructions of the final purchaser.
6    (i) The term "manufacture" means to grind, mix or blend or
7further process a commercial feed for distribution.
8    (j) The term "brand name" means any word, name, symbol,
9device, or any combination thereof, identifying the commercial
10feed of a distributor or manufacturer and distinguishing it
11from that of others.
12    (k) The term "product name" means the name of the
13commercial feed which identifies it as to kind, class, or
14specific use.
15    (l) The term "label" means a display of written, printed or
16graphic matter upon or affixed to the container in which a
17commercial feed is distributed, or on the invoice or delivery
18slip with which a commercial feed or customer-formula feed is
19distributed.
20    (m) The term "ton" means a net weight of 2000 pounds
21avoirdupois.
22    (n) The term "per cent" or "percentage" means percentage by
23weight.
24    (o) The term "official sample" means any sample of feed
25taken by the Director or his agent and designated as "official"
26by the Director or his agent.

1    (p) The term "contract feeder" means a person who, as an
2independent contractor, feeds commercial feed to animals
3pursuant to a contract whereby such commercial feed is
4supplied, furnished or otherwise provided to such person and
5whereby such person's remuneration is determined all or in part
6by feed consumption, mortality, profits or amount or quality of
7product.
8    (q) The term "seed" means agricultural, grass, vegetable or
9other seeds as determined by the Department.
10    (r) The term "grain" means corn, wheat, rye, oats, barley,
11flaxseed, sorghum, soybeans, mixed grain, and any other food
12grains, feed grains, and oilseeds for which standards are
13established under the United States Grain Standards Act.
14    (s) The term "pet food" means any commercial feed prepared
15and distributed for consumption by dogs and cats that does not
16contain any animal remains from an animal that has been
17euthanized by the use of any drug injected intravenously or
18through another nonvascular route or the remains of any dog or
19cat.
20    (t) The term "specialty pet food" means any commercial feed
21prepared and distributed for consumption by specialty pets.
22    (u) The term "specialty pet" means any animal normally
23maintained in confinement, including but not limited to,
24gerbils, hamsters, birds, fish, snakes, turtles, and zoo
25animals.
26    (v) The term "animal" means any living creature, domestic

1or wild, but does not include man.
2    (w) The term "Department" means the Department of
3Agriculture of the State of Illinois.
4    (x) The term "Director" means the Director of the
5Department of Agriculture of the State of Illinois or duly
6authorized representative.

8    Section 99. Effective date. This Act takes effect upon
