SYNOPSIS AS INTRODUCED:
 
20 ILCS 2610/50 new

    Amends the State Police Act. Provides that an Illinois State Police officer may use a patrol vehicle to transport a sick or injured person if an ambulance or specialized emergency medical service vehicle is not available or on-scene, or a medical emergency exists. Exempts the Illinois State Police and the State Police officer from liability for an act or omission in providing medical emergency transportation, unless the act or omission constitutes willful or wanton misconduct.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Police Act is amended by adding
5Section 50 as follows:
 
6    (20 ILCS 2610/50 new)
7    Sec. 50. Medical emergency transportation.
8    (a) A State Police officer may use a patrol vehicle to
9transport a sick or injured person if an ambulance or
10specialized emergency medical service vehicle is not available
11or on-scene, or a medical emergency exists.
12    (b) If a State Police officer transports a sick or injured
13person under this Section, neither the Illinois State Police
14nor the State Police officer shall be liable as a result the
15State Police officer's act or omission in providing medical
16emergency transportation, including any assistance related
17thereto, unless the act or omission constitutes willful and
18wanton misconduct.
19    (c) As used in this Section:
20    "Ambulance" has the meaning defined in Section 3.85 of the
21Emergency Medical Services (EMS) Systems Act.
22    "Medical emergency" means a person is in need of immediate
23medical attention for a sickness or injury and delay in

1receiving that attention may endanger his or her life.
2    "Specialized emergency medical services vehicle" has the
3meaning defined in Section 3.85 of the Emergency Medical
4Services (EMS) Systems Act.
