SYNOPSIS AS INTRODUCED:
 
10 ILCS 5/6-17  from Ch. 46, par. 6-17

    Amends the Election Code. Provides that the county board of Vermilion County may certify and cause to be submitted to the voters of Vermilion County, at the next general election, the question of dissolution of a municipal board of election commissioners within the county and transfer its function to the Vermilion County clerk.

1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by changing Section
56-17 as follows:
 
6    (10 ILCS 5/6-17)  (from Ch. 46, par. 6-17)
7    Sec. 6-17. Dissolution.
8    (a) Except as provided in subsection (b), whenever Whenever
91,000 of the legal voters in a city of 250,000 population or
10less where this Article 6 and Articles 14 and 18 of this Act or
11the Act of which they are a continuation have been adopted
12shall petition the circuit court in the county in which such
13city is located to submit to a vote of the electors of such
14city the proposition as to whether such city and the electors
15thereof shall reject the Articles, the court shall enter an
16order of record approving such petition and thereupon the court
17shall submit such proposition to the legal voters of such city
18at the next succeeding general, state, county or municipal
19election to be held in such county in not less than 30 days
20after the entry of such order. If 1,000 shall exceed one-eighth
21of the legal voters of any such city then such petition need
22not be signed or made by more than one-eighth of the legal
23voters of such city. Notice of election shall be given by the

1court at least 20 days prior to such election by publication in
2one or more newspapers of general circulation published within
3such city.
4    (b) The county board of Vermilion County may, by ordinance,
5certify and cause to be submitted to the voters of Vermilion
6County, at the next general election, the question of
7dissolution of a municipal board of election commissioners
8within the county and transfer its function to the Vermilion
9County clerk. The ballots which shall be used for voting on the
10dissolution of a municipal board of election commissioners
11shall be substantially in the following form:
12        "Shall the (name of municipal board of election
13    commissioners) within Vermilion County be dissolved and
14    its functions transferred to the Vermilion County clerk?"
15    The votes shall be recorded as "yes" or "no".
16    If a majority of the votes of Vermilion County cast are in
17favor of the proposition to dissolve the municipal board of
18election and transfer its functions to the Vermilion County
19clerk, then the municipal board of election commissioners is
20dissolved.
21    On the effective date of the dissolution, all the rights,
22powers, duties, assets, property, liabilities, obligations,
23and responsibilities of the municipal board of election
24commissioners shall, by operation of law, vest in and be
25assumed by the Vermilion County clerk.
