1 | AN ACT concerning elections.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 5. The Election Code is amended by changing Section | |||||||||||||||||||
5 | 6-17 as follows:
| |||||||||||||||||||
6 | (10 ILCS 5/6-17) (from Ch. 46, par. 6-17)

7 | Sec. 6-17. Dissolution. | |||||||||||||||||||
8 | (a) Except as provided in subsection (b), whenever Whenever | |||||||||||||||||||
9 | 1,000 of the legal voters in a city of 250,000
population or | |||||||||||||||||||
10 | less where this Article 6 and Articles 14 and 18 of this
Act or | |||||||||||||||||||
11 | the Act of which they are a continuation have been adopted | |||||||||||||||||||
12 | shall
petition the circuit court in the county in which such | |||||||||||||||||||
13 | city is located to
submit to a vote of the electors of such | |||||||||||||||||||
14 | city the proposition as to whether
such city and the electors | |||||||||||||||||||
15 | thereof shall reject the Articles,
the court shall enter an | |||||||||||||||||||
16 | order of record approving such petition and
thereupon the court
| |||||||||||||||||||
17 | shall submit such proposition to the legal voters of such city | |||||||||||||||||||
18 | at the next
succeeding general, state, county or municipal | |||||||||||||||||||
19 | election to be held in such
county in not less than 30 days | |||||||||||||||||||
20 | after the entry of such order. If 1,000
shall exceed one-eighth | |||||||||||||||||||
21 | of the legal voters of any such city then such petition
need | |||||||||||||||||||
22 | not be signed or made by more than one-eighth of
the legal | |||||||||||||||||||
23 | voters of such city. Notice of election shall be given by the

1 | court at least 20 days prior to such election by
publication in | ||||||
2 | one or more newspapers of general circulation published
within | ||||||
3 | such city.
| ||||||
4 | (b) The county board of Vermilion County may, by ordinance, | ||||||
5 | certify and cause to be submitted to the voters of Vermilion | ||||||
6 | County, at the next general election, the question of | ||||||
7 | dissolution of a municipal board of election commissioners | ||||||
8 | within the county and transfer its function to the Vermilion | ||||||
9 | County clerk. The ballots which shall be used for voting on the | ||||||
10 | dissolution of a municipal board of election commissioners | ||||||
11 | shall be substantially in the following form: | ||||||
12 | "Shall the (name of municipal board of election | ||||||
13 | commissioners) within Vermilion County be dissolved and | ||||||
14 | its functions transferred to the Vermilion County clerk?" | ||||||
15 | The votes shall be recorded as "yes" or "no". | ||||||
16 | If a majority of the votes of Vermilion County cast are in | ||||||
17 | favor of the proposition to dissolve the municipal board of | ||||||
18 | election and transfer its functions to the Vermilion County | ||||||
19 | clerk, then the municipal board of election commissioners is | ||||||
20 | dissolved. | ||||||
21 | On the effective date of the dissolution, all the rights, | ||||||
22 | powers, duties, assets, property, liabilities, obligations, | ||||||
23 | and responsibilities of the municipal board of election | ||||||
24 | commissioners shall, by operation of law, vest in and be | ||||||
25 | assumed by the Vermilion County clerk. | ||||||
