AMENDMENT TO HOUSE JOINT RESOLUTION 93

2    AMENDMENT NO. ___. Amend House Joint Resolution 93 by
3replacing from line 2, on page 1, through line 15, on page 4,
4with the following:
 
5    "WHEREAS, The legitimacy of democratic government requires
6the public's trust that elected officials act in the best
7interests of the people of the State; and
 
8    WHEREAS, The trust of the citizens in their government at
9all levels has recently been tested; and
 
10    WHEREAS, The long storied history of this State has also
11shown the strength and commitment of its public servants to
12work to regain that public trust when shaken and ensure that
13citizens receive the honest services to which they are
14rightfully due from their public servants; and

1    WHEREAS, We, as a political body, know that our duty to act
2in the best interests of the State and its citizens requires us
3to rise above partisan and geographical divides while serving
4as their elected representatives; and
 
5    WHEREAS, The laws and operational practices of the State of
6Illinois affect all citizens, their trust in its governance,
7and the integrity of the democratic process; it is necessary
8and appropriate that the legislative and executive branches
9come together to review current State statutes, review
10enforcement of those statutes, take public testimony, and
11determine what additional measures could be enacted to reform
12Illinois government, while remaining mindful of our duty to
13protect the rights enshrined in both our State and federal
14constitutions; therefore, be it
 
15    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE
16HUNDRED FIRST GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
17SENATE CONCURRING HEREIN, that there is created the Joint
18Commission on Ethics and Lobbying Reform; and be it further
 
19    RESOLVED, That the Joint Commission shall have the
20following duties, to:
21        (1) Review the State Officials and Employees Ethics
22    Act, the Illinois Governmental Ethics Act, the Lobbyist
23    Registration Act, the Public Officers Prohibited

1    Activities Act, and Article 50 of the Illinois Procurement
2    Code;
3        (2) Review best practices concerning governmental
4    ethics from local governments and other states;
5        (3) Seek input from experts and the general public
6    concerning proposals to improve governmental ethics; and
7        (4) Make recommendations for changes to the State
8    Officials and Employees Ethics Act, the Illinois
9    Governmental Ethics Act, the Lobbyist Registration Act,
10    the Public Officers Prohibited Activities Act, and Article
11    50 of the Illinois Procurement Code to improve public trust
12    in government; and be it further
 
13    RESOLVED, That the Joint Commission shall consist of the
14following members:
15        (1) 2 members of the General Assembly appointed by the
16    Speaker of the House of Representatives;
17        (2) 2 members of the General Assembly appointed by the
18    President of the Senate;
19        (3) 2 members of the General Assembly appointed by the
20    Minority Leader of the House of Representatives;
21        (4) 2 members of the General Assembly appointed by the
22    Minority Leader of the Senate;
23        (5) 2 ex officio, nonvoting members from the Office of
24    the Attorney General appointed by the Attorney General, one
25    of whom shall be the Executive Inspector General for the

1    Attorney General;
2        (6) 2 ex officio, nonvoting members from the Office of
3    the Secretary of State appointed by the Secretary of State,
4    one of whom shall be the Executive Inspector General for
5    the Secretary of State; and
6        (7) 4 members appointed by the Governor, with no more
7    than 2 of the appointments from the same political party as
8    the Governor; and be it further
 
9    RESOLVED, That no member of the Joint Commission shall be
10or have been registered to lobby State government in Illinois
11during his or her service on the Joint Commission or at any
12time during the five years prior to the effective date of this
13resolution; and be it further
 
14    RESOLVED, That Joint Commission members shall serve
15without compensation; and be it further
 
16    RESOLVED, That the Speaker of the House and President of
17the Senate shall each designate one of the members of the Joint
18Commission as a co-chair and shall designate members of their
19staffs to provide administrative support for the Joint
20Commission as necessary; and be it further
 
21    RESOLVED, That the Joint Commission shall hold public
22hearings at the call of the co-chairs in accordance with the

1Open Meetings Act; and be it further
 
2    RESOLVED, That the Joint Commission may issue periodic
3reports on its activities and shall issue a final report on its
4review and recommendations by March 31, 2020 to the General
5Assembly, the Governor, the Attorney General, the Treasurer,
6the Comptroller, and the Secretary of State.".
