    Amends the Nurse Practice Act and the Medical Practice Act of 1987. Requires the Department of Financial and Professional Regulation to adopt rules to include implicit bias training in the continuing education requirements for licensees under the Acts. 1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Medical Practice Act of 1987 is amended by
5changing Section 20 as follows:
 
6    (225 ILCS 60/20)  (from Ch. 111, par. 4400-20)
7    (Section scheduled to be repealed on December 31, 2019)
8    Sec. 20. Continuing education. The Department shall
9promulgate rules of continuing education for persons licensed
10under this Act that require an average of 50 hours of
11continuing education per license year. These rules shall be
12consistent with requirements of relevant professional
13associations, specialty societies, or boards. The rules shall
14also address variances in part or in whole for good cause,
15including, but not limited to, temporary illness or hardship.
16In establishing these rules, the Department shall consider
17educational requirements for medical staffs, requirements for
18specialty society board certification or for continuing
19education requirements as a condition of membership in
20societies representing the 2 categories of licensee under this
21Act. These rules shall assure that licensees are given the
22opportunity to participate in those programs sponsored by or
23through their professional associations or hospitals which are

1relevant to their practice. Each licensee is responsible for
2maintaining records of completion of continuing education and
3shall be prepared to produce the records when requested by the
4Department.
5    By January 1, 2020, the Department shall adopt rules to
6include implicit bias training in continuing education
7requirements. As used in this Section, "implicit bias" means
8the unconscious attitudes or stereotypes that can affect
9behaviors, decisions, and actions in the treatment of women and
10minority groups.

12    Section 10. The Nurse Practice Act is amended by changing
13Sections 55-35, 60-40, and 65-60 as follows:

16    Sec. 55-35. Continuing education for LPN licensees. The
17Department may adopt rules of continuing education for licensed
18practical nurses that require 20 hours of continuing education
19per 2-year license renewal cycle. The rules shall address
20variances in part or in whole for good cause, including without
21limitation illness or hardship. The continuing education rules
22must ensure that licensees are given the opportunity to
23participate in programs sponsored by or through their State or
24national professional associations, hospitals, or other

1providers of continuing education. Each licensee is
2responsible for maintaining records of completion of
3continuing education and shall be prepared to produce the

14    Sec. 60-40. Continuing education for RN licensees. The
15Department may adopt rules of continuing education for
16registered professional nurses licensed under this Act that
17require 20 hours of continuing education per 2-year license
18renewal cycle. The rules shall address variances in part or in
19whole for good cause, including without limitation illness or
20hardship. The continuing education rules must ensure that
21licensees are given the opportunity to participate in programs
22sponsored by or through their State or national professional
23associations, hospitals, or other providers of continuing
24education. Each licensee is responsible for maintaining
25records of completion of continuing education and shall be

1prepared to produce the records when requested by the
2Department.
3    By January 1, 2020, the Department shall adopt rules to
4include implicit bias training in continuing education
5requirements. As used in this Section, "implicit bias" means

12    Sec. 65-60. Continuing education. The Department shall
13adopt rules of continuing education for persons licensed under
14this Article as advanced practice registered nurses that
15require 80 hours of continuing education per 2-year license
16renewal cycle. Completion of the 80 hours of continuing
17education shall be deemed to satisfy the continuing education
18requirements for renewal of a registered professional nurse
19license as required by this Act.
20    The 80 hours of continuing education required under this
21Section shall be completed as follows:
22        (1) A minimum of 50 hours of the continuing education
23    shall be obtained in continuing education programs as
24    determined by rule that shall include no less than 20 hours
25    of pharmacotherapeutics, including 10 hours of opioid

1    prescribing or substance abuse education. Continuing
2    education programs may be conducted or endorsed by
3    educational institutions, hospitals, specialist
4    associations, facilities, or other organizations approved
5    to offer continuing education under this Act or rules and
6    shall be in the advanced practice registered nurse's
7    specialty.
8        (2) A maximum of 30 hours of credit may be obtained by
9    presentations in the advanced practice registered nurse's
10    clinical specialty, evidence-based practice, or quality
11    improvement projects, publications, research projects, or
12    preceptor hours as determined by rule.
13    The rules adopted regarding continuing education shall be
14consistent to the extent possible with requirements of relevant
15national certifying bodies or State or national professional
16associations.
17    The rules shall not be inconsistent with requirements of
18relevant national certifying bodies or State or national
19professional associations. The rules shall also address
20variances in part or in whole for good cause, including but not
21limited to illness or hardship. The continuing education rules
22shall assure that licensees are given the opportunity to
23participate in programs sponsored by or through their State or
24national professional associations, hospitals, or other
25providers of continuing education. Each licensee is

10    Section 99. Effective date. This Act takes effect upon
