3 | | replacing everything after the enacting clause with the |
4 | | following:

5 | | "Section 5. The Toll Bridge Act is amended by changing |
6 | | Section 7 as follows:

8 | | Sec. 7. Toll rates; electronic toll collection. |
9 | | (a) The county board shall fix the rates of toll, and may |
10 | | from time to
time, alter and change the same, including by |
11 | | establishing a toll rate schedule, setting a maximum toll rate |
12 | | that may be adjusted from time to time, or by establishing |
13 | | another toll rate structure, and in case of the neglect of the |
14 | | owner of
the bridge to keep the same in proper repair and safe |
15 | | for the crossing of
persons and property, may prohibit the |
16 | | taking of toll. |

1 | | (b) Notwithstanding any law to the contrary, the county |
2 | | board may enter into an agreement establishing a toll rate |
3 | | schedule for a period not to exceed 99 years. This amendatory |
4 | | Act of the 101st General Assembly is declarative of existing |
5 | | law and shall be given retroactive effect. |
6 | | (c) Except as regarding toll bridges or as otherwise |
7 | | provided by law, nothing in Public Act 101-398 this amendatory |
8 | | Act of the 101st General Assembly shall be construed to |
9 | | authorize a county, municipality, local government, or private |
10 | | operator to impose a toll upon any public road, street, or |
11 | | highway; nor shall any provision of Public Act 101-398 this |
12 | | amendatory Act of the 101st General Assembly be construed to |
13 | | authorize, pursuant to an intergovernmental agreement or |
14 | | otherwise, the imposition of any toll upon any public road, |
15 | | street, or highway. |
16 | | (d) The General Assembly finds that electronic toll |
17 | | collection systems in Illinois should be standardized to |
18 | | promote safety, efficiency, and traveler convenience. If |
19 | | electronic toll collection is used on such bridge, the county |
20 | | shall cause the configuration of the electronic toll collection |
21 | | system to be compatible with the electronic toll collection |
22 | | system used by the Illinois State Toll Highway Authority. The |
23 | | municipality or private operator may enter into an agreement |
24 | | with the Illinois State Toll Highway Authority to provide for |
25 | | such compatibility or to have the Authority provide electronic |
26 | | toll collection or toll violation enforcement services. Any |
